Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Received a week's worth of calls from Rebecca Outlaw, Fraud Division at the 210 number. She stated that she had a case on her desk that I had committed fraud and should contact her immediately or have my attorney contact her.  I never returned her call because I have not done anything illegal.

Any caller who wants you to send money via prepaid debit card is a scammer - no exceptions! Your caller's name is correct - she is an "outlaw".

I keep getting a call from this number telling me her name is Mrs. Outlaw and she has a fraud case on her desk with my name on it but never states that she works for the SAPD Fraud division. Come to find out she is a debt collector. TOTAL SCAM!! Wants me to send her money with a MoneyPak for greendot or she will send the FEDS to my house...smh I work at a law office and told her to contact my attorney....she never called.

They called claiming I had a payday loan in 2012. This is not the case. I told the young lady that I would be contacting the Arizona attorney general. She told me to tell the attorney general hello. This is a scam

This is a scam they told me that they were calling for Advance America.net When I typed the web address in google this is what poped up.

The Washington State Department of Financial Institutions (DFI) has received several reports of possible scams conducted by individuals claiming to represent Cash Advance America and Advance America Payday Loans.

One Washington consumer reports that he has received multiple harassing collection calls from a person claiming to represent Cash Advance America. The caller claims that the consumer owes debt for a 2007 payday loan, but refuses to provide any details about the debt. The consumer states that he did not take out any payday loans in 2007.

Two other consumers received phone calls from people claiming to represent Cash Advance America and Advance America Payday Loans where the callers offered loans in exchange for an upfront fee. Although one consumer had never applied for a payday loan, the callers insisted that they were calling to discuss her online application for a payday loan. The other consumer reports that, when she refused to wire money to the caller, the caller threatened legal action against her.

Cash Advance America and Advance America Payday Loans are not licensed by Washington State Department of Financial Institutions to provide loans. They are also not licensed to do business in Washington State.

There is a company called Advance America which is licensed by DFI to provide payday loans. However, there is no indication that Advance America is related to the apparent scams described above.

Verify License

DFI strongly recommends that consumers deal only with those lenders that are properly licensed to conduct business. Consumers can determine whether lenders are properly licensed using the ?Verify a License? feature on the DFI?s website at www.dfi.wa.gov/consumers/findcompany.htm.

Payday Loan Debt Collection Laws

Collection activities are subject to the federal Fair Debt Collection Practices Act. Therefore, if you have questions regarding debt collection laws please contact the Federal Trade Commission at 1-877-FTC HELP, or online at www.ftc.gov.

Debt collectors cannot state or imply that failure to pay a debt is a crime. They cannot call before 8:00 a.m. or after 9:00 p.m. They cannot harass or abuse consumers, or contact consumers' places of employment.

Report Fraud

Washington State residents, if you are suspicious of unlicensed activity by a payday lender please contact the Washington State Department of Financial Institutions at 1-877-RING-DFI (746-4334), or online at www.dfi.wa.gov.

If you live in another state, find your state regulator.

If you feel you have been the victim of a loan scam please contact the Federal Trade Commission at 1-877-FTC-HELP (382-4357) or online at www.ftc.gov; or contact the Consumer Financial Protection Bureau (855) 411-CFPB or online at www.consumerfinance.gov. Because the scammers have access to bank account information and social security numbers, victims should consider themselves victims of identity theft and take appropriate precautions. The Federal Trade Commission has information for victims of identity theft available online at www.ftc.gov.
