| D Lewis 2013-03-25 18:52:26 Unknown |
This calling service will not stop calling my home. It ask if you are a particular person, then press 1. Nothing happens if you press 1. If you call the back, you only get voicemail. I can not tell you how irritating this is!

I happened upon this thread while looking up the number that keeps calling me on Google. I, like others, get a phone call EVERY morning asking if I am "Quicksilver Signs", and am instructed to press "1" if I am or disconnect immediately if I am not. I press "1" to try and find out what the heck they want, but it hangs up from their end. Quicksilver Signs is a business, and owes no money to anyone. Yet I receive these calls endlessly. Why does it hang up? Why bother with the annoying calls if nobody will tell me what they want?! How do you make it stop if you don't even know for sure who it is?

You, like "Irritated", didn't bother to read before posting if you believe there is "no way to make it stop". Grinding your hands here isn't getting it done. Trying to starve out their autodialer is futile. With another change in phone numbers you will inherit the leftover nuisance callers for the new number AND the current one, based on your residential address. Would you like to try a simple and permanent solution or come back this Winter with the same complaint?

If you're in an agreement of payment with them then they don't have thye right to call you everyday unless you default on the repayment schedule and it is harrassment contact a lawyer BUT start recording the calls, otherwise you won't have a leg to stand on

Your "not me" complaints were all made verbally. How do you plan to prove you were harassed? Here's a hint: Pinnacle isn't going to help you win that argument. See my advice from October 2011, currently three short comments behind yours.

i have been receiving calls from this number with no way to make it stop. they are calling for a person that DOES NOT live at my house. i DO NOT know the person they are calling for ,and i am very tempted to change my number to get the calls to stop. i've been woken up by the calls early in the morning and have gotten them late in the afternoon. i am tired of being harassed by somebody else's problem. please make it stop before i have to make unnecessary changes or report you for harassment. this has been going on far too long. the calls have been coming in since i received this number when we moved here around February 2012, and i am still getting the calls today August 16, 2012. i have tried to be patient and wait to see if it would stop, but as you see it hasn't.

I was issued a new phone number two months ago. Beginning a few weeks ago I get frequent automated calls for someone I do not know (obviously, a person who previously had this number). I finally got through to a live person at the calling number and complained. He said the calls would stop but they have not. This should be illegal and constitutes harassment. I understand it is a collection agency for a finance company. I have never done business with them or any other existing finance company.

I answered and a recorded message said if I am (an unknown name) to press 1. If I am not (unknown name) to disconnect immediately. I hung up.

I answer this call, and no one responds when I say "hello." They just hang up.

This number keeps calling asking for Beverly Green. I explain I've had this number for close to 10 years and I am not Beverly and they promise to remove me from the list and yet they keep calling. Most recently, the person calling became irrate and hung up on me- I pay my bills yet I'm being harrassed because someone used my phone number, very frustrating.

Ranger, the FDCPA caps statutory awards at $1K per action, not per violation. TCPA can stack up multiple fines, but it's harder to drag collection calls under that umbrella. As a Texas resident, you enjoy very strong state collection laws to help you further.
You also neglected to tell the nice people what to send in that CMRR envelope.
If Pinnacle thinks you owe something, be sure to respond on real paper to its federally required dunning letter with a dispute and validation request, adding that you either restrict or revoke consent to call again. Given the average agency's need to break laws to get at your assets, you should dispute even if you agree slightly with its claim.
If the account is not legally collectable, or it's simply not you they want, you're free to send a full cease-comm, cutting off all contact. Send all notices via USPS Certified with return card as advised. The FTC and many consumer watchdogs explain how to draft them.
Learn how to exercise your FDCPA rights as an alleged debtor at FTC-dot-gov.

Another example of why disputing a debt and setting contact restrictions is much preferable to hurriedly making any "deal" or "arrangement" with lawbreaking collectors. They will do and say anything to wriggle away from whatever agreement and continue blaming the consumer.
The FDCPA forbids harassing and annoying call patterns but doesn't define or benchmark them. In your place I would stop paying and start documenting calls, noting anything abusive or deceptive, then work up a lawsuit. At worst you'll force them to play fair, and at best see your whole debt go "poof" in statutory and actual damages paid to you.

Okay. I checked this out and it is Pinnacle Financial Group, Inc. at 7825 Washington Ave. S, in Minneapolis, Minn. 55439. Now here is the plan. Service them notice by Certified Mail at the home office listed above with a return receipt. When you get the return receipt, start sending them a bill for $1,000.00 for each call for Telephone harassment. Now I am no attorney, far from it but, if you actually do owe a debt you will probably be able to go to a low court instead of having to take the violation to Federal Court as they are actually violating the Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. Section 1692-1692p. If you can find a small claims court to take your case for Telephone harassment most courts will allow you to sue for up to $10,000.00. Just don't mention it is a Federal Crime, which the Feds aren't really doing anything about and ditto for the phone company. So saddle up folks and let's turn this around. I actual had an attorney say that any company that hires or sells the debt to a debt collector, they can only get one. I have had over three (3) so far calling. Other numbers they have used, and I am keeping a log on them are 239-247-5334 and 512-936-7003 here in Texas. Who knows, it just might work in our favor since the Feds done really give a d**m I don't think. Hi Ho Silver! Go get um.

Pinnacle Financial Group calls me daily from different numbers. I'm paying them what we had agreed to every month and still even after receiving my payment they call me every day. Is this harassment I believe it is and tell them so, they say it isn't and have the right to call to collect a debt.
