Glad the AG letter scared them away, but you've left money on the table. FNCB is indeed not a law firm, therefore its lawsuit threat was empty, which is a serious FDCPA violation for which you can recover a damage award. All your costs will be covered by the loser. I would guess you have only until Summer this year to file suit. You get one short year from the violation date.

Somehow I don't think the ex-collector is returning to reply. It's impossible to comment confidently on "a bill that was closed", since that could mean many things. Was it paid off, charged-off unpaid, discharged in bankruptcy, or something else?

The one thing we do know is that FNCB traffics in a lot of old junk debt. Probably it's in the hands of a debt buyer, one which will be hard put to prove you ever owed. It's a safe bet you got a dunning letter shortly after the phone calls began, one with federally required notices telling you how to raise a dispute and seek validation. That's done through a *paper notice*, not verbally. I really hope you did those things before your 30 days expired. It's harder to fight the debt claim if you miss that.

Federal and state laws give you plenty of other tools for defending your rights and protecting your assets from lawbreakers like FNCB. Here's some official-type material on federal:

Ugh ... and find mainly windy letter templates overstuffed with empty threats and obtuse language. A good "cease-communication" notice is a straightforward affair: "Here's what you've been doing, here are the phone numbers and/or addresses affected, please stop contacting me." If this takes more than half a page, the author may have written too much.

Sending a simple notice in a #10 envelope by USPS Registered Mail with no declared value and with a Return Receipt card (Form 3811) costs $15.14 as of USPS rate increases effective 26 Jan 2014. The same item with the same card runs $6.49 sent Certified, up from $6.11 prior to 2014. Why so many people habitually recommend "registered mail" when Certified does the same job for 2.5 times less cost I will never comprehend.

Anyway, Kathy never articulated her problem. Her complaint, like many on these sites, is fixated on nuisance calls with no concern for their purpose. We will never know almost three years later if she was considered a debtor or if FNCB was skip-tracing a stranger. If the former was the case, a full "cease-comm" could have been a poor choice of responses, potentially accelerating a creditor's decision to sue her. That's when demands for validation and limitations on contact are in order.

Maybe *your* former receptionist had no problem. I find that what passes for a "signature" on the mint green card varies wildly. Very few return with a clearly printed name *and* signature, which is how it should be done. Most will skip the name or the sig, or place unreadable squiggles. Some fail to indicate the receipt date. A few use a rubber stamp for the name and/or sig. I always load and screen-capture the online USPS report so I have some corroboration. However, I've yet to have a sloppy CMRR challenged when presented as a lawsuit exhibit, so the concern is minor.

These people are scammers! I just got off the phone with a guy named michael from there. He stated that an outstanding balance of 1123.56 was owed immediately for a car loan I took out in 2001. I calmly explained to him that was three. cars ago and the note was paid off in 2003. He began to start raising his voice to me threatening lawsuit. I then told him bring it on, I have documentation proving the vehicle was paid off in 2003, and that there was never a late payment on the car. He then said that I will be seeing a letter in the mail from their legal team. I once again said bring it on. And hung up.

They have called, when I picked up  a few months ago , they said I owed a bill to a credit card. I said I had no credit cards..They said they were a law office. The guy even gave me his name and said he was a lawyer and they were going to sue me. I filled out a form for our MN Attorney Generals Office. They gave it to the correct dept. I heard from them, they are a scam company, they told me not to answer the phone from these people. They are going after them. They called the number of the supposed attorneys office and they said no it is not an attorney. If you don't answer or talk to these guys they will eventually  give up and move on to someone else. But it is annoying to have them calling. Since I contacted the Attorney Generals office the phone calls have stopped.

Just called.  The caller ID said it was from Illinois.  Left no message.  No doubt it's a scam. Not my Debt . . . shame on you. You probably gave them information to scam your daughter further.

There are entirely too many of these type of scams going around and no, I don't believe the Do Not Call list means much.  Every now and then I see where someone was fined but it exempts so many things - political, charity, etc. that my phone is constantly ringing with people I do NOT want to talk to.  I pay for the danged phone so I can use it, not every Tom, Dick and Harry.  My number is even unpublished.  Doesn't matter.  And I got a new number, do not give it to ANYONE as I kept the old one too and I still get scam calls on the new number.

In Michigan, you can report them to the consumer protection division of the Attorney General's office (Michigan). Get as much information as you can. Try to get the name of the person calling, the times and dates, and any thing they say. When they call, be sure to state that you do not want them to call, or they have the wrong number and remove your number from their list or whatever the situation is.

When they call a third time in 2 weeks, you can fill out an online form. Yes, a real investigator contacts you. A collection agency did this to me and they said some things that were just...unmentionable for a collection agency. I received a letter of apology, they were fined and they stopped calling me

Bottom line - NEVER pay any caller who refuses to MAIL you proof that you owe this debt, and proof that they have the legal right to collect said debt.  Per the FDCPA, failure to provide this documentation means you owe them NOTHING.  Also, failure to give company name and mailing address is a sure sign of either a very shady debt collector, or a complete scammer.  Again - do NOT pay anyone who cannot prove you owe a debt to them.  

BTW, debt is civil, not criminal, so there will be no charges.  Report the caller to the FTC, the FBI, Dept of Justice and your state's Attorney General.  Advise the caller that she's been reported and that your own lawyer (even if you don't have one) is having you record all calls from them for multiple violations of the FDCPA.

Very unprofessional debt collection agency. I asked them over and over who is the original creditor of the debt they claim I owe. I let a lot of obligations fall thru the cracks between 97-2003. I was young and dumb. Then I realized that bad credit can hinder you in various aspects of your life. I paid everything on my 3 credit reports off and have had nothing outstanding since 2003.

To receive a call from a female claiming I owe her agency $3K was shocking. She would not tell me the name of the agency she works for. Nor would she tell me the name of the original creditor. To quote her "You know why I am calling. You need to pay this or we'll file charges"



Needless to say, I ended the call. I have no problem paying something that I owe, even if it is out of statue. I know I wasn't living right between 97-2003 so maybe I did forget a creditor.

If she could have followed FDCPA, maybe we could have worked something out. I have no time for a company that operates as if the law does not apply to them. If you are not compliant now, how do I know that you will be compliant once I give you my debit card?

They have called me and a recording says they have very important business pertaining to me.  Then they put me on hold for several minutes.  I think it is a scam to verify that the phone number belongs to me.  Now they can harass me.

its not illegal to call and ask for bob thomas for example unless they give out personal information other than we are a debt collector try to collect a debt and NO lawyer would not go for this because lots of lawyers are in on this for a piece of the pie

this number is from a debt collector or you can say a skip tracing company who buy bad dept and then try to find the person who owns the debt, its simple either ignore them or pick up the phone and tell them its not me and hang then they will try again and maybe find a relative with some link to your phone number for  example as an x repoman we used to buy your phone records and link your most called numbers to you and then use a program which we pay top dollars for to find out where these phone number go to ADDRESSES,  we run them and most of the time we find our car and YOU,  visiting family or friends and in this case they only call these numbers hoping to get someone to relay a message to you, there you have it they can find you but may not be sure its you play along and buy time you can also negotiate with them for pennies on the dollar dont be afraid offer them what you think you want to pay or let it go to court and then offer them a lot less i have myself done this and its rather fun

Of course it doesn't stop them from calling my 80 yr old parents though.....
