Attorney General Darrell McGraw took the extraordinary step today of warning the public about a band of scam artists making threats to consumers who allegedly obtained Internet payday loans in West Virginia and across the nation. The consumers they threaten never obtained a loan at all or paid it off years ago.

Internet payday loans are short-term loans or cash advances, usually for 14 days, made over the Internet via interactive web sites and secured by an agreement authorizing debits of the loan and all fees owed from the consumer?s checking account. These loans typically charge interest rates ranging from 600-800 APR and are unlawful in West Virginia.

The scam artists, who speak English with a foreign accent, call themselves ?U.S. National Bank,? ?Federal Investigation Bureau,? ?United Legal Processing? and numerous other phony names. They refuse to disclose real names and addresses and are believed to be operating ?off the grid? from homes, automobiles, or from off shore locations or foreign countries, including India. Since the scammers have kept themselves purposely well hidden, thus far no law enforcement agencies have succeeded in locating or shutting them down.

The scammers typically pose as law enforcement officers, investigators, lawyers, and bankers and threaten consumers that they will be arrested for ?bank fraud? or other fictitious crimes unless money is wired immediately. They simultaneously scare and confuse consumers by using meaningless legalese gobbledygook phrases such as, ?We are downloading warrants against you? or ?We are filing an affidavit against you.? Consumers who don?t immediately fall for the scam are warned, ?Only God can help you now.?

The scammers almost always call consumers at work several times a day, and tell their supervisors, ?Your employee has committed fraud and is about to be arrested.? Such threats have proven unsettling even to the most savvy consumers and employers who suspect the calls are fraudulent.

Attorney General McGraw stated, ?Ordinarily my office protects consumers from fraudulent activities by seeking injunctions in court. But legal action cannot be taken until the scam artists can be located. Even then, it is unlikely that the persons behind the fraudulent calls and extortionist threats would obey a court order. In this case, the consumer?s best defense is to be armed with the knowledge of the scam so that all demands for money can be resisted, despite the false but scarey threats of arrest.?

McGraw added, ?Because the fraudsters make a special point of calling consumers repeatedly at work, employers must understand that the consumers are innocent victims of a criminal enterprise and cannot stop the calls from coming. I also wish to assure the citizens of West Virginia that my office will continue to do everything possible to locate and shut down the outlaw debt collectors.?

It's a debt collection scam. And all their threats are false and illegal.
This is a very active group of scammers, many of whom are calling from India (and probably other countries) and are in cahoots with a group of American pay day loan scammers. They attempt to extort money from consumers with a myriad of false and illegal threats, and alternately pose as debt collectors, federal and state law enforcement officers, lawyers and bankers. Their trademark is to use meaningless legalese gobblygook phrases like "We are downloading warrants against you" or "We are filing an affidavit against you." Another trademark phrase is to threaten the consumer with something like this ridiculous phrase: "If you don't pay then only God can help you."
Typical of many financial scams of this variety, they usually demand payment via Western Union or MoneyGram or credit card. They use any number of phony names such as US National Bank, Federal Investigation Bureau, US Legal Investigation Bureau, Hopkins Law Office, United Legal Processing, Morgan Associates, United Pay Services, National Processing, White Collar Crime Unit and many more.  These criminals also use many phone numbers from many area codes; they're probably using caller-id spoofing software and/or VoIP to disguise their real location.
The main thing to remember is that anytime someone calls you demanding money to prevent your arrest, or demanding your lawyer's name so they can sue you, it is ALWAYS a scam. No debt collector (let alone criminals posing as debt collectors) has the authority to have anyone arrested for anything. (And it's illegal to them to threaten such a thing.) And since these foreign dirtbags routinely impersonate law enforcement, it's also important to remember that American law enforcement officers aren't in the business of debt collection.  (Debt is a civil, not a criminal, matter.)
The bottom line is, these are criminals trying to steal your money.
A consumer posting a complaint about these same scammers at http://800notes.com/Phone.aspx/1-718-831-7157 notes that 718-831-7157 is associated with an India-based "outsourcing" telephone bank.  Though a reverse search on WhitePages.com shows that 718-831-7157 is an unlisted land line in New York City, information on Debtbuyers.Com shows that that number is used by India-based Intellisourze. This is another piece of the puzzle that fits in perfectly with other information about this scam. There are some reports on 800Notes that have suggested that the crooks behind this offshore scam are also the crooks behind the notorious Bass/Ellis Crosby & Assoc./States Predisposition scams in Florida and Georgia. The interesting thing is that the number of complaints on here about the US National Bank/US Legal Investigation/Federal Investigation scam skyrocketed *after* April 7, 2008 when Florida obtained a $1.3 million judgment against Ted Ellis Crosby, shutdown his operations and barred him from ever conducting debt collections in Florida (Read http://myfloridalegal.com/newsrel.nsf/newsrel ... 5257424005858A6 ) There's certainly a good chance that the crooks placing these calls from India are doing so on behalf of the American crooks behind the Crosby/Bass/States Predisposition scams.

Though scam calls from these crooks have been going on long before May 8, the frequency of complaints about these calls increased considerably after Crosby was shut down in early April.
This is conjecture, but appearances suggest that Crosby and company were originally running a two-pronged payday loan scam operation -- with some calls being made from Jacksonville, Florida and other calls being made from a phone bank in India (and possibly other countries); then, after the Florida Attorney General shut down the Crosby scams in Florida, the Crosby crooks transferred most of their scam efforts to the India phone bank.
If you are targeted by these criminals, be sure to report them to all the following federal and state law enforcement agencies (most of which you can do online or over the phone):
1.    The U.S. Secret Service is responsible for protecting the country's financial infrastructure and payment systems from international and domestic threats. Call or write your local Secret Service field office to alert them to the details of this attempted extortion. The addresses and phone numbers for the local Secret Service field offices are listed at http://www.secretservice.gov/field_offices.shtml or in your phone book.
2.    Alert the FBI at https://tips.fbi.gov Be sure to tell the FBI that you are being targeted by extortionists over the phone. And if the crooks claim to be law enforcement or lawyers, officers of the court or bankers, be sure to include that information in your report.
3.    File a complaint with your local police. Most police departments will take a report over the phone.  Be sure to tell them that you're being targeted by an extortionist and give them all the details.
4.    File a complaint your state's attorney general, the contact information for whom is at www.wvago.gov
5.    File a complaint online with The Federal Trade Commission at https://www.ftccomplaintassistant.gov/FTC_Wizard.aspx?Lang=en
If these crooks call back, promise them nothing, pay them nothing and tell them nothing other than that you know they're a scam and that you've reported them to law enforcement. (And be sure to report them to all the agencies above each time they call you.)

Scam alert: Bogus debt collectors

This scam isn't technically about credit cards, but it is scary enough to post a warning. The Better Business Bureau issued an alert today saying consumers across the country are getting phone calls from bogus debt collectors claiming default on a payday loan. Of course, the consumer needs to pay a large fee to avoid arrest -- as much as $1,000.
The caller poses as a lawyer, and may threaten extradition to face trial if the consumer doesn't pay up immediately.
What makes these calls alarming -- and perhaps convincing -- is that the perpetrators reference the consumer's personal information, such as the person's Social Security number, driver's license number, previous bank account numbers, home address -- even personal references.
"The amount of information they have is really troubling," says BBB spokeswoman Alison Southwick. She adds that the amount of data points to a possible security breach.
Spread the word to your friends and family: Don't give out personal or financial information to an unknown caller. Scammers can spoof Caller ID to display different numbers, so trust your instincts over technology.
The BBB offers these tips:
?    Ask the debt collector to provide official documentation which substantiates the debt.
?    Do not provide or confirm any bank account, credit card or other personal information over the phone until you have confirmed the legitimacy of the call.
?    File a complaint with the Federal Trade Commission online if the caller is abusive, uses threats or otherwise violates federal telemarketing laws or the Fair Debt Collection Practices Act.

I got a call from the same number and the person asked for someone named Tiffany Ackerman, for some reason I keep getting calls from random numbers asking for that same person...anyways I told them you have the wrong number. He got angry and said "you don't talk to me like that, you don't know me" I said "look I keep getting calls from people asking for Tiffany but there is no Tiffany here", he said "You ain't saying nothing, you understand me?" so I said again "you have the WRONG number" and he said again "You ain't saying nothing"...I got tired of listening to the jack*** so I just said "have a good day" and hung up.

Yeah I can understand all of your concernsamim different though, this is the second time this has happened to me.he had everything from my social #,address,checking number....I made a police report and even the police called and talked to this guy, this is all a hoex!! Now I'm getting a phone call from a woman who claims her name is rachael,that's a lie she can't even speak english!! She's a joke and so is all of this stuff they tell you. I tracked this number to a landline in cali. Where then it gets transferred over seas. This is my second time dealing with these idiots, for everyone who they are trying to scam, blow it off and don't give them any info. They need to get a real job and work hard for once in there life instead of trying to take our money.. So don't worry and forget about them.

Yes, the same thing happened to me...interesting how close together these dates are...I called back just tell him how much he just messed up because I'm military...and we don't play those stupid games. But the line was busy. I'm not going to waste my breath worrying over this, but someone let me know if he ever quit calling, because its annoying, he woke me up and I was thinking it was my deployed boyfriend....that's a big let down. So you have a tired pissed-off military chick with more rights than civilians give us credit for....you're screwed. But again....I'd like to know if he ever stopped calling....even though its only within a 3-4 day range...

I got a similar call on May 23,2009 around 1pm or so. At first, I didn't pick up cause it was an UNKNOWN number but they left a message that sounded serious. I too had to play the message at least 4 times in order to make out what the man was saying. So I called back cause I was curious about what was going on. I spoke to a guy named David? I couldn't quite understand him. He told me that I had applied to some online loan called Fast Cash International and that I never paid back. I was very confused because I had never applied to these online loans. He kept cutting me off and telling me to listen to him. He had all my information, which was scary. He continued to say that the company Fast Cash International hired his firm to file a lawsuit against me and that I should get a lawyer or power of attorney. I asked him how much the company is suing me for and he said he could disclose that information, so then I asked for a number to this company so I could personally talk to them to work something out. He said that Fast Cash International has over 150 affiliated companies and that to determine which affiliate I had taken a loan from would be impossible. I insisted on the number and he refused, saying I was being difficult and not taking this situation seriously. I started to get upset because he started accusing me of being irresponsible etc. He said that if I didn't take care of this that I would be going to jail and its a serious offense. He said he's sent my work documents about garnishing wages from my paycheck. I told him well if this company is suing me than I would like the court order and lawsuit papers and to send them to my address, so I can look at them and present them to my attorney.He said NO, that he will only send them directly to my attorney. Then I started to get suspicious that it maybe a scam. Im young but definitely not stupid. I told him that its illegal to withhold information such as legal documents especially if it obtains a court order. He told me he will only send it to my attorney and that I should be in court by Wednesday in LA. I told him theres no way, I dont have time and its such short notice. So I argued with him more and again asked me how much they are suing me for and he said $900+. I told him until I see the paper, I am not going to go to LA. He kept threatening me saying that I would be going to jail. I told him what he's doing is illegal and that as soon as I get this stuff straightened out that I would make sure to come after him and make sure his license would be taken away. He told me to F*** OFF and hung up on me. I call back, he picks up again and I once again ask for his name and the firm he's calling from. He told me not to call back unless it's my attorney and hung up again. So I call back for the third time and he said that if I called back again that he will file harassment against me and hung up.

So needless to say, this is definitely a hoax and people trying to get money out of me. But to be safe, I called my uncle who is our family attorney and told me that the next time they call don't give them information but try to get their information, and call the police.

Strangest call ever but I should have known, that law firms dont really work on Saturdays and don't usually make calls.

I got a call from a place by the number of  (240) 645-0736 a few days before May-23-2009.  I was not available and they left a voice mail for me to call them.  As far as I know this was the first time they ever called me.  I didn?t call at first because it sounded like a prank phone call to me.  The message sounded like someone trying to pretend to be cereus and at the end said god bless you.  I had to play the voice mail about 3 times to figure out what the number was that he told me to call back on because I could barley understand what he was saying (he was not American and I had trouble trying to figure out what he was saying) I called back on May-23-2009 to find out what was going on.  I spoke to a guy named Shawn, I think he is also the same one who left the message on my voice mail.  I talked to him and he explained that he was over a case against me over a loan I got from a check cashing & loan Company called Fast Cash International in California.  As he was talking to me about it he said that he was giving my employer, (Masco RCG) formally (Mills pride) information about what they are going to do and information for when I have to go to Court and that he would be faxing them the papers sometime Tuesday morning.  I asked him where I would be going to court and he said somewhere in Ohio that he was not for sure.  I then told him that If it was to far away I would not be able to go and he said if I didn?t go I could loose my drivers license and be suspended from my job.  He made out like I was a huge criminal and was in deep trouble and that who knows what they will do to me in court and that they are pressing 3 different kinds of charges on me and that it was all in gods hands now.  He made it sound so bad that I was in fear for my life.  I then asked him, what are they going to do murder me? And he said I don?t know.    I then asked to speak to someone who spoke better English a little better so I could understand what this was all about a little better.  He transferred my call to a man named Dan Cruise.  I spoke to him about this and he said the same thing but in more detail and tried to scare me even more.  He asked me how much money I made and I said I?m guessing around $1500 a month right now because orders are down real bad at work, but I also told him that I was just guessing on that amount and I was not for sure.  He also mentioned that he was trying to get this matter resolved and asked me if I cared about what was going to happen to me or my family.  And that I didn?t just owe $ 745.45, but it raised with other fee?s to $1,477.44.  And that if it goes to court and they win that I could get sued for 7 to 9 thousand dollars.  I asked him for the number of the Company that I borrowed the money from so I could call and talk to them and he did not tell me so I asked him who I could speak to and try and make payment arangments and he said that he was the first and the last person that I could speak to about it.  I then offered a $100 a week or so much in a monthly payment until the $1,477.45 was paid in full and he said no that it was not going to work and split the bill in two and asked me if I could pay it in two payment one payment today and the other half next Saturday and I said I did not have that much money to pay it in two payments.  He then said well then how are you going to pay for a lawyer and that a lawyer would cost me around three thousand dollars.  He also mentioned in the conversation about what was going to happen if I didn?t pay and said how would you like to be in a dark room and kept going on and on about how I need to pay the money I owe and I asked him what was going to happen and he said that words can?t describe what they will do to me in court.  I said that I can not pay this amount in two payments and he said well then have fun in a dark room and hung up.  I then started looking in the phone book for lawyers and wrote a bunch of numbers down of lawyers around my area.  I called back that evening around 8 p.m. May-23-2009 and spoke to Shawn again, I told him that I was going to get a lawyer, but I could not look for one until Tuesday because of the holidays and he said good.  I mentioned that I would need a lawyer to go to court with me to try and make some type of payment arangments and he said No, that If I go to court it will be to late for any payment arguments and that either I would win the case or loose the case and that if I loose the case then god help me and that I could possible work for my employer for free for a certain amount and that I would be responsible for the rest on my own.  I then said I was going to get a lawyer and hung up.
