Debt Collector
Yet another call from these sleezy asshats, looking for the former owners of my landline number.  Got the number assigned to me last September by Comcast and within a week I started getting collection calls for the deadbeats that had my number before me. Most of the collection agencies were reasonable and willingly stopped calling me when I explained that I didn't know the people they were trying to collect from.  That is except for Asset Acceptance & one  other debt buying company. I've told them the same as I did the other companies and they refuse to believe that I'm one of the debtors (going by the names I'm guessing a husband & wife).  I've told them to stop calling me & show me proof that I owe them anything (I don't). They haven't done the former, and I don't know if they actually tried sending proof of deb to the latter since the deadbeats have never lived at my address.

You have it right. Call blockers are available on eBay, Amazon, Sears, and others. For about $50 you will find you can easily block up to 1500 numbers. And, as mentioned above you can just block area codes. Or, "Out of Area" or "Private Caller" etc. I just moved to a new home in November, from out of state,  and that really starts up the telemarketers. My Call Blocker is easy to set up and easy to use. If I get stumped with an issue customer service is excellent. And, domestic as well.

Good luck, Tom

Got two calls from these jokers at Asset Acceptance, and both times they were asking for the deadbeats that had the phone number before me.  According to Google this company is a debt buyer company.  Well, they can get in line with the previous 7 companies that are also trying to get money from deadbeats.

Have a feeling they'll call again today and if they do I'm not going to be as nice and polite to them as I was the first two times.

This actually works if it is past the statute of limitations. In Michigan it is 7 years.  AFNI tried to collect a debt of over 15 years ago. I sent them a Cease And Desist letter. (which you can copy from a search engine) They called 3 times a day from different numbers. Send it certified mail needing a signature that it was accepted. They are to stop calling after receiving it. A rep called me not long after. I went berserk on her. She said she had the letter right next to her on her desk. "And you still called me"? I hung up and found a lawyer online that sued debt collectors. I received a check for $1000. Lawyer claimed he got attorney fees only. RIGHT!

In 2012, Asset Acceptance has to pay a $2.5 million fine for fraudulent practices.

The FTC?s nine-count complaint charged Asset Acceptance with:

misrepresenting that consumers owed a debt when it could not substantiate its representations;
failing to disclose that debts are too old to be legally enforceable or that a partial payment would extend the time a debt could be legally enforceable;

providing information to credit reporting agencies, while knowing or having reasonable cause to believe that the information was inaccurate;

failing to notify consumers in writing that it provided negative information to a credit reporting agency;

failing to conduct a reasonable investigation when it received a notice of dispute from a credit reporting agency;
repeatedly calling third parties who do not owe a debt;
informing third parties about a debt;

using illegal debt-collection practices, including misrepresenting the character, amount, or legal status of a debt; providing inaccurate information to credit reporting agencies; and making false representations to collect a debt; and
failing to provide verification of the debt and continuing to attempt to collect a debt when it is disputed by the consumer.

This number just started calling..doesn't leave a message but like lots of people I don't answer numbers I don't know. I liked someone's idea about sending the calls to a dead-end extension. I would like to know how to do that...........my blocked numbers list is always full so I can't add it.

I don't know these or owe these people anything. I've told them several times. I actually had a 10 minute conversation with one of their operators to try and figure out what they are wanting.
I have gotten better results from talking to my dog.

am so tired of this number calling me, finally called this number back, the guy said his name is Mario White but claimed that many different people use this number to call homes, he asked for my name in which I refused to give it and he asked for someone's name who I have never heard of so he said then we have nothing further to discuss and he hung up on me. This is so aggravating!

Well, I stayed on the line and listened to their schpiel and then I let them know that I was onto them.  I told them we KNOW how they operate, and the debt she claimed we owed was paid ten years ago, and it keeps getting sold in some old list and they keep rehashing it from one company to another.  Well, ma'am, you don't have to get huffy with me, she said.  Well, if you stopped calling to cash in on a debt that doesn't exist, and doing it at all hours of day and night and breathing into the phone.  Oh, that's our automated system.  No, it isn't because I can hear then the same background noise I hear behind you now. And, guess what her name was?????  Coretta Scott...KING!  I laughed at her and told her, yeah, like when Selena Gomez called with a middle eastern accent.  Ten millions times we've asked for documentation, and no one provides it, and they'd better stop calling...she hung up on me...

How about something like this:

Write them a letter

Dear XXXXXXX
Re: Account #000001 (your account number for them)

As of this date, I have opened 5 pieces of mail, 4 emails and have answered 10 phone calls.
Please find below my invoice to your company for providing this service
Please note:  Payment is due upon receipt.  Failure to pay within the required time period (don't tell them what it is) will result in
a)  26% interest being added every month until
b)  5 months of non-payment at which time your account will be sent for collections

5 pieces of mail @ 100$ per = 500
4 emails @ 75$ per = 300
10 phone calls @ 50$ per = 500
Total Due upon receipt 1300$

How do these people get one's info?  I got a message from my bank saying my account had been compromised at Target, and now this starts happening...weird...

I received a call from this number today. I missed it & called it back not knowing who it was. The lady that answered the phone spoke so fast I didn't catch the name of the business. When I asked her what the call was regarding, she got completely b*tchy and said that I had called her. I said I am returning the call that I had just missed from you people. Again I asked what the call was regarding. She told me that this call and all future calls were being recorded. She asked my name. I asked her what it was about. Then she asked if I were "so-n-so" again, but this time she used a different form of the name that is not my legal name. So I said that was not me. She got even b*itchier and said I called her and the phone # is listed under that name. I told her to drop her attitude because I was simply returning a missed call. She said, (again with a huge attitude) "Well you MUST be "so-n-so"...I interrupted her and said "Since you can't drop your attitude...GOODBYE." and I hung up.

Debt Collector
                               :28 MOST COMMON VIOLATIONS OF YOUR RIGHTS BY DEBT COLLECTORS:

ABUSIVE METHODS USED BY DEBT COLLECTORS.

1)  Repeatedly calling your telephone.

2)  Cursing, swearing or otherwise profaning at you during phone calls.

3)  Contacting and disclosing your debt to other people.

4)  Contacting you without disclosing their identity or the purpose of their call.

5)  Threatening to pursue criminal charges against you for failing to pay a bill.

6)  Threatening to take action they do not intend to take, such as:

7)  Garnishing your wages or taking your property when there is no judgment against you.

8)  Threatening to call your employer and disclose the debt.

9)  Threatening to turn your case over to an attorney when it is highly unlikely that any attorney would sue for a balance
as small as you might owe.

10)  Contacting you after they know you are represented by an attorney.

11)  Calling you at any unusual time (before 8 a.m. or after 9 p.m.).

12)  Calling you at work if they know that your employer prohibits it, or if it?s inconvenient for you.

13)  Contacting after sending them a Cease and Desist letter from all any further contact with you.

14)  Debt collectors may not make false, deceptive or misleading statements in connection with the collection of a debt, such as:

15)  Falsely representing to you that criminal action will be taken against you in connection with the debt.

16)  Leading you to believe he/she is an attorney or that a phone call or letter is from an attorney.

17)  Falsely implying affiliation with the United States or any state, including the use of any badge and/or uniform.

18)  Sending a collection letter or leaving a voice mail that fails to contain a statement that ?This is a communication from a debt collector.? This statement must be contained in every letter and phone call made by the debt collector.

19)  Communicating false credit information, including failure to communicate to credit bureaus that a debt is disputed.

20)  Debt collectors may not use unfair practices, such as:

21)  Attempting to collect an amount not authorized by contract or permitted by law (for example, a debt collection agency may not add ?collection fees?, "late fees", "interest fees" etc. to a debt if you never agreed "in writing" with the debt collector agency to any such charges).

22)  Depositing or threatening to deposit your post- dated check prior to its date.

23)  Accepting or soliciting your check postdated by more than 5 days without 3 business days written notice of intent to deposit.

24)  Causing any charges to be made to you, e.g., collect telephone calls, usage of cell phone minutes.

25) Communicating with you by postcard.

26)  Displaying any language or symbol on the envelope indicating the communication concerns debt collection.

27)  Suing you AFTER your states' Statute of Limitations (SOL) have expired.

28)  Serving the Summons & Complaint at your Post Office box or other (UPS, Fedex) mail drop box facilities, instead of
      at YOUR residence where YOU reside.

These are just some (NOT ALL) prime examples of how debt collectors violate the Fair Debt Collection Practices Act.

Here's an interesting tidbit, not sure if it's contained within the x number of pages, but..... Asset Acceptance got busted in 2012 for 2.5 million  And here's what they did to earn such a prestigous award

- misrepresenting that consumers owed a debt when it could not substantiate its representations;
- failing to disclose that debts are too old to be legally enforceable or that a partial payment would extend the time a debt could be legally enforceable;
- providing information to credit reporting agencies, while knowing or having reasonable cause to believe that the information was inaccurate;
- failing to notify consumers in writing that it provided negative information to a credit reporting agency;
- failing to conduct a reasonable investigation when it received a notice of dispute from a credit reporting agency;
- repeatedly calling third parties who do not owe a debt;
- informing third parties about a debt;
- using illegal debt-collection practices, including misrepresenting the character, amount, or legal status of a debt;
- providing inaccurate information to credit reporting agencies; and making false representations to
collect a debt;
- failing to provide verification of the debt and continuing to attempt to collect a debt when it is disputed by the consumer

If I were an American, that second one would be very useful to me, especially if i knew my debt was past the SOL in my state.

Bottom feeders. Wonder what they tell their families at family gatherings? Like the struggling actor telling his family, I'm in a commercial!? A hemorrhoid commercial or a wet wipe commercial. Funny. I'm sure these phone calls are about a family member who listed us as a reference, good deal gone bad.
If the debt is written off.....dah? This company is looking for free money. Bottom feeders.
