CALLERID4U: Faces Class Action Over Automatic Telephone Dialers

Kelly Holleran, writing for The Madison St. Clair Record, reports that ten days after an alleged violation of the Illinois Automatic Telephone Dialers Act, an Edwardsville law firm has filed a putative class action suit claiming a telemarketer thwarted a caller ID system by concealing its true identity.

The Law Office of Shari L. Murphy claims it received one or more prerecorded phone calls from defendant CallerID4U on Oct. 21. However, when the defendant called the law office, it failed to reveal its true identity on the caller ID screen, according to the complaint filed Oct. 31 in Madison County Circuit Court.

Peter J. Maag and Thomas G. Maag of Maag Law Firm in Wood River represents the plaintiff.

The action is in violation of a state statute which requires that all autodialers correctly identify themselves on caller IDs, the complaint says.

'As a direct and proximate result of Defendant's action, Plaintiff sustained damages, including but not limited to lost productivity time and wages paid to financially compensated employees who were diverted from being gainfully employed, and instead dealing with robotic telephone calls,' the suit states.

In its complaint, the law office seeks a judgment of more than $50,000, plus treble damages, costs and other relief the court deems just.

A pre-recorded POLITICAL message was left, summarized as follows:  A person from the City of Irvine, California, USA Police Association wanted to express their support for a candidate in an election for the city list above.

The number showing up on your caller ID is not the number they are calling from.  Programs can be downloaded from the internet that can make it appear that the call is coming from any number the caller wishes to use.  Therefore, it is of no use to report it as a violation of the Do Not Call list.  The call is untraceable and the caller knows it.  He/she is not going to abide by the Do Not Call list.  They are not going to be caught.

Any caller who does not abide by the Do Not Call list should be considered a probable scam artist, "phisher" or looking for "live ones" - suckers who will answer their phones.  If you do not recognize the caller on your caller ID, DON"T ANSWER!!!  If it is a legitimate call or really important, they will leave a message.  If you answer, you are a "live one".  I quit answering these calls several months ago, and the number I've been getting has started to drop off very markedly.  I do check the numbers that come up on caller ID by Googling them, just to be sure.

On my cell phone, when I get one of these calls, I assign it a name - DO NOT ANSWER - and a silent ringtone.  When my cell phone shows that Do Not Answer is calling me, I don't!

Even though they're using a Delaware phone number, this spam message was sent from the Association of Orange County Deputy Sheriffs in California.

The clown who called left the following message that was also transcribed by my voice mail. As the message notes, this spam concerns something in Yorba Linda (in Orange County) - I don't live anywhere near there! Here's the message:

The Yorba Linda City Council is holding a meeting next week Tuesday, April 24 at 6:00 PM to decide who should police Yorba Linda. Unfortunately, certain Yorba Linda city council members, along with a small anti-sheriff department faction, has spent the last several months bad mouthing the sheriff's department. We've had enough. The sheriff's department bid provides the most comprehensive services at the most affordable price. We need you to attend this very important meeting and support the sheriff's department's proposal. We will not stand idly by and let politicians malign the fine work our men and women do for our communities. We need you to attend April 24th Yorba Linda City Council meeting at 6:00PM at the Yorba Linda community Center and show your support for our great department. As someone here suggested I am now going to report every one of these to the Do Not Call registry. If we flood the system with complaints maybe they will do more to stop some of these abuses. If we only complain to one another then nothing will change.

I received a call from IMPORTANT 302-327-9010 AT 4:24 P.M. today.
Just got home and dialed their number. Answered right away and said if I wanted to
be removed from their list to press 1. I did, and she said I would be removed in 72 hrs.
We'll see.

I keep getting these calls also. I finally got one of the operators to talk to me rather than hang up. I recorded the call successfully. I have to subpeana verizon for their records and add them to my lawsuit just to get this company. After all is said and done I will be out a lot of time but my hopes are after I get judgment in my local court I will get a certificate of judgment that the clerk sends to their bank. All their accounts are frozen temporarily until they pay what the judge orders. Min $500.00 for first offense, reasonable compensation for my time and my legal expenses. After all this I will continue as it will be easier to show their pattern of violations. They will end up with multiple $200,000.00 fines and legal expenses.
