This guy names Mr. Carter called saying had to go to court over a bill I never paid.  If I do not go I will be arrested and lose my job & house.  I will admit we are behind on some bills but with a new job (changed due to economy) we are getting back on our feet but nobody has sent us papers over not paying.  They are calling my cell all the time (on the no call list) and now they are calling my job. When they called my job they were telling them everything about what was going to happen. He didnt care it wasnt me he told the lady who answered all the same information he told me. Is this right.

Fake debt scammers rely on the fear and lack of knowledge about debt collection laws within the population. They also figure that a certain percentage of their calls will be received by individuals who may be carrying debt on credit cards anyway and may be susceptible to intimidation. When collectors use misleading statements and fail to provide identification, they are breaking the law. Never pay money to a possible thief. Keep cool when you hear from collectors to avoid this collection abuse.

I had a guy (who sounded Somalian...(not middle eastern, I think??) Whatever he was, a guy with a really thick accent calling me ALL DAY today!! He told me his name was Fred and that he was from FAA, and I owed $5000 for a loan I took out in CA (BTW, I've never been there) and if I did not pay it I would be arrested tomorrow morning. When I asked the dumb a** what county my warrant was in, he told me it was in my state. So, I asked him again and he hung up on me. He called me back like 10 mins later and was continuing reading this BS affidavit and when I asked him what bank the loan was taken out through, he also did not have an answer for me. Not to mention, much like "Annoyed" said he would yell back at me when I yelled at him. And, if you call that number back like 3 or 4 times, it will ring through and you can talk to someone. By the end of the day, I was annoyed, but I was a serious smart a**, because it seems to me that the information you asked for they did not have an answer, so I was just getting a little entertainment out of making this guy mad. He finally just said F@$% You and hung up the phone. hahaha But, what I read about this scam, is to change your bank acct number immediately, and contact your states Attorney General as well as California's Attorney General, contact the FTC, your local police department, and FBI and Secret Service (because it is international telephone extortion) <~~that is what my local police department said. But, it is also severe harassment, I have received 70 calls today. Just do not give any info!!!

Some guy with an Indian or Middle Eastern accent called me from 310-598-1786 stating that he was Ryan from CyberCrime and said that I have a court date about an unpaid bill. If I did not show up, then the police would be at my door to arrest me. They have my S.S.N, address and the name of two of my friends, so it sounded legitimate at first, but he was very unprofessional, when I yelled at him, then he started yelling back and kept hanging the phone up on me and then he would keep calling back. After he got tired of arguing with me, he hung up again. I tried to call the above number back and when I did the voicemail came on and I couldn't even leave a message. If this was a real debt collection co., then I would have been able to speak to someone or leave a message.

Fake Debt Collectors and Collection Tactics

If consumers did not have enough to worry about having to deal with rising credit card interest rates, late fees and over-limit fees, zombie debt, and fervent bill collectors, now we have to worry about collectors calling about fake debt.

While many legitimate collection agencies follow the FDCPA, there are some collectors out there that are only running a scam operation and will be quick to use threats and scare tactics to get you to pay up quick. Their scams turn up in mailboxes, on the internet and through the telephone every day. Some collectors pose as national banks, government agencies (FBI, CIA), or even popular celebrity stars to gain personal information. These phony collectors may threaten to repossess your house, issue a warrant for your arrest, or even garnish your pay check, all of which are against the FDCPA rules. Some of which are even laughable (for example, there is no debtor?s prison in the United States).

Many times, people who took out payday loans online in the past are most susceptible. If you took a payday loan, be aware scammers may have access to your Social Security number and other personal information, and keep your guard up against such tactics.

Ironically, real "deadbeats" probably wouldn't fall for these scammers, since they have no intention of repaying their creditors anyway. But upright citizens may doubt themselves, thinking they've forgotten to pay a bill. Many times, the sums involved tend to be fairly small, so some people may be tempted to just pay the "bill" and "get it over with."

Ways to Protect Yourself Against Debt Collection Scams

Review your credit report frequently to find inaccuracies.
Be aware of your current creditors and how much you owe.
Ask creditors for identification before you provide any information over the telephone.
Reporting Fake Debt Collectors

If you ever receive a call from anyone identifying himself as a debt collector, the law requires that the debt collector provide you with identification, and that the debt collector refrain from making misleading and threatening statements.

You can report any problems you have to your state Attorney General?s office www.naag.org and the Federal Trade Commission www.ftc.gov. Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.
