These b*****ds called me under the name of Detective Andrew Cohen and told me they were calling from William Scott and Associates and notified me of check fraud and that I had a balance to pay off from ACE CHECK CASHING of 309 dollars and they told me I have to pay 1700 bucks and I questioned how it became 1700 dollars and he said that interest is ridiculous on them. He said that if i did not satisfy this payment in full he would have to submit my paperwork for court and have be detained until my court day. I freaked out at first and was quick to agree to the terms of paying off the balance owed. I was so nervous because I didn't want to be arrested over something stupid. So i left work to put the money together, as i put the money together i called back and Andrew Cohen told me I can make a payment through my debit card. Luckily I left my debit card in my car which my brother took and I couldn't pay them. During that down time, I decided to Google this firm and found them to be a bunch of SCAMMERS. These b*****ds damn near had me for 1700 dollars. I was angry as hell that I found out but glad I caught it before they took me for my money. STAY AWAY FROM [removed:lang]

The only time you'll need an attorney is if you're ever held accountable for the fraud and extortion that your scam collector "job" entails.

Action 9 investigates phantom debt collectors

KISSIMMEE, Fla. ?

A Kissimmee woman feared going to jail over a debt she didn't owe after a debt collector called, claiming she was going to be arrested unless she paid up.

The threat from the voice on the phone seemed all too real for Charlene Smith.

??You're going to jail,?? Smith said they told her. ??What are they talking about?? You know, you're heart races."

Smith said someone from William Scott and Associates reached her in Kissimmee and told her unless she paid the collection company $3,000 for a payday loan debt, she would be arrested that day.

"He was dropping government names just left and right. What else are you going to think? Someone is going to arrest me," said Smith.

Smith said she found a debt collector by the same name online. She said the company wouldn?t give her its address or send proof of the debt.

No one returned Action 9?s call to the company. There was a recording that suggested it really makes arrests.

?If you're an attorney representing respondents already detained?" the message reads.

They're called phantom debt collectors who use fake addresses and phony threats.

?It's a mob-like tactic," said consumer attorney Billy Howard.

Howard collected 500 complaints from people threatened by rogue collectors in six months, some captured on voicemail.

?I'm going ahead with a warrant for your arrest," one message said.

Howard?s latest client paid William Scott and Associates $900 after she was threatened with prison.

Howard said the operations are nearly impossible to find.

"No one holds them accountable and until that happens, they'll keep doing it," said Howard.

Smith didn't pay and wants others to be prepared.

?They only do this because people don't know their rights,? she said.

Action 9 contacted William Scott and Associates using a dozen numbers without success.

If a debt collector refuses to give you it's address, hang up. That's illegal."

Got phone call from William Scott & Assoc from Mr McDowell stating that they were processing charges against me for check fraud and theft by check and gave me a case number from the county in which I reside.  This was a voice message telling me to call back at 815-665-0039 x 115.  I attempted to call the number but got a recording that all lines were busy and to call back later.  Checked my phone and that was not the number that was listed on my phone.  Called that number 206-384-4524 x 115 and spoke to Mr McDowell and he proceeded to advise me that they were putting a case together from an old loan from Ace Cash Express from 2009.  He told me to stop the process I would need to pay the loan off (which more than doubled) and he needed a credit card number to stop all proceedings and implied that they had already turned in the case to my county seat and would get a docket number if I did not pay these funds and there would be jail time involved.  My husband was here and told me to have them send me paperwork on this and they said they did not have time to send it in mail before going to court.  He also said my husband was a "billy bad a**" and I hung up on them.  They also said that I had less than 2 days to come up with the money or jail

I do have a past due with Ace Cash Express- and am trying to set up a payment plan- , but I don't think this is the company that I want to pay any money to- what to do? - I think that they hacked in to my information which would be Identity Fraud, any info on this would be appreciated.

I too have been harassed by this company. They have violated almost every element of 15 U.S.C.A. § 1692e. When I requested they send me proof of the debt they claimed they do not have to mail anything. They then had someone named Brandon Leonard who claimed to work for the Dept. of Justice (DOJ) call me and leave me two separate voicemails that I was going to be arrested. There is no debtors prison and can only be arrested if found guilty by a court of law. Not to mention when I called the DOJ they have no record of this person being employed. On a funnier note when Brandon Leonard called, he thought he disconnected the line and you can hear him talking to the other debt collector (Chief Preston Scott) which shows they both work as debt collectors in the same office and violated Federal Law by presenting themselves to be associated with the Government. I have since filed complaints with the Federal Trade Commission, my Attorney General, and the Better Business Bureau.

Event Reminder
the only thing i have used a check cashing place for, was to cash a check. i have never taken out any "pay day loan" and only if i got paid on a friday or saturday after the bank had closed. i remember having to cash a few checks late 2001, but i never wrote any to myself or any of that, now, when this lady from d2 management called me, she said she was in the pre legal dept trying to help me in resolving this pay day loan matter before it was given to a legal dept.so i told her that i never took out a loan, ijust cashed a few checks given to me she said that since the check bounced it was considered a payday loan and was accrueing interest, i asked her to provide me with the paperwork on this she said, there wasnt enough time to provide me with any and i said if i did agree to pay this, can i send her a money order, she said they werent able to accept any mail in payments...

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

all i can say is it's funny to read these comments because i told the owners once before this kind of stuff would happen. the company is a real company, unfortunately the people that works there aren't the best of the field. the tactics used to collect on a debt by them for the most part violate the FDCPA rules and regulations. if you or anyone else has an issue with them or any other agency that's violating your rights, email me your name and contact number and i can show you how to turn their phone calls into a pay check for you!
