WOW. melinda has the right to a letter OBVIOUSLY. but most of the times they are just AVOIDING PAYING. 99.9% of debt out there IS valid. just because they CHOOSE to be dirtbags and not pay is not my problem. Im not going to just pay anyone either. but debts usually go through about 3-4 debt collection companies. so they ARE aware of the money they STOLE. You shouldnt take what people say at face value either. melinda probably has MULTIPLE debts owed but just cant afford to pay because she is a broke woman that takes out loans and doesnt pay them. If expired, don't pay."  WOWWW DIRTBAG. does it matter? you should have paid it prior. The FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf treats the INITIAL CONTACT between collector and debtor (first call, first letter, first whatever) as a special event. Legit collectors per section 809 of the FDCPA *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Note that 3,4,5 must be done *IN WRITING* so you will need to ask an address from your collector. If s/he refuses to give you one for any reason, treat the collector like a SCAMMER.
The collector can threaten court action at initial contact but the FDCPA requires that the collector actually take you to court if the collector threatens it. Threatening court and not going through with it (coercion) is illegal.
If they say the FDCPA does not apply to them because they own your debt, the debt-owner exemption only applies to the original owner. A 3rd party who buys the debt for the purpose of collecting debt is treated as a debt collector and not an owner and must obey the FDCPA as explained in this FTC Staff Opinion letter here http://www.ftc.gov/os/statutes/fdcpa/letters/arbuckle.htm

You can tape, then sue collectors (google "fdcpa attorney") for violations described in sections 805, 806, and 807, per section 813 of the FDCPA.

Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint with your state AG.

Shill alert!  Asking for written validation of debt is the legal thing to do -- any potential debtors have the legal right to demand a debt-validation letter, you idiot.  Why should anyone pay for something that they do not believe they owe?  Maybe these debt collectors should call you, since you apparently will just pay anyone over the phone that calls you saying you owe them money.  And how do you know Melinda actually owes any debt, let alone debt to this particular company -- especially when previous posters have said they did not owe anyone anything.  You also should consider learning how to spell:  "Ludacris" is a rapper.

melinda..... you had no problem spending the cash they gave you though right? did they give you the loan in payments?!? what gives you the right to STEAL money then PER CONTRACT default on the loan when its time to pay it back and then to say it has to be on your terms is LUDACRIS! you should be ASHAMED of yourself!! LOOK BACK ON YOUR BANK RECORDS to verify information also. you know you took the loan out just trying to stall!!! STALL TACTICS. get a job and stop taking out loans you cant pay back!

I received a call from a James lord, He stated that I was going to be served some kind of level papers from them for some loan. If I owe them money fine I will pay it, But I have asked repeatedly for them to send me all the information in the mail. I am not just going to send money to someone that calls me and says I owe them money. So if RJA CAPITAL WANTS ANY MONEY FROM ME, THEY NEED TO MAIL ME SOME PAPERWORK AND I WILL THEN PAY THEM PAYMENTS THAT I CAN AFFORD. I HAVE THE RIGHT TO SEE PAPERWORK BEFORE I JUST START THROWING MONEY THAT I DON'T HAVE ANYWAY, TO A STRANGER THAT SAYS I OWE THEM MONEY.

RECEIVED A CALL FROM A JAMES LORD FROM RJA CAPITAL SAYING THAT CHECK DIVISION HAD RECEIVED A COMPLAINT FROM ONONDAGA COUNTY AND HE WAS TO TAKE A STATEMENT.  IF HE DIDN'T HEAR FROM ME WITHIN 48 HOURS IT WOULD BE TURNWED OVER TO AUTHORITIES.

NEVER RECEIVED ANYTHING ON A BAD CHECK.  NOTHING HAS BEEN MAILED TO MY HOME, JUST TODAY STARTED RECEIVING THESE PHONE CALLS.

HAS ANYONE ELSE EXPERIENCED THIS.  PLEASE LET ME KNOW.
