I have a loan with the company they say they are calling from; however, I have confirmed with the company that my payments are current and they asked that I call their fraud investigator because these scammers are using this company's name illegally.

I have received mulitple calls to my office and on my cell phone from this number and other numbers. All of the callers state there is legal matter due to a loan, they all have an accent (India), and all have provided American sounding names but the calls are the same. This is a scam as I have not taken out any loans.  They have given me different amounts each call, can not provide any verfication of any documents and insist that settlement can only be done with a credit card or debit card. They are persistent and have personal information. Do not give out any information to these people

I have received the same call from a David Cooper, and a Tony Brown, and also Jacob Matthews.  I was also told to call back to discuss a legal matter 321-285-4290.  I called the number back once and the man I spoke to, who was from India maybe, asked for my name and SS #.  I gave him my name and phone number only, he said he had no record of me in his system.  He said he would follow up and get back to me.  I didn't here from him for alomst 2 months and then today I got another message to call so I figured I would go online to see who PCS was and I came across this site.  I can't believe there are people out her like this!  I wish I could make the calls stop or maybe just change my phone number will help.

This guy frm this number has called me over 15 times today saying he is from FBIC and that I owe a payday loan to Advance America, Which I never heard of. So now I am trying to find out if this a scam or if someone has stolen my information. I have argued this man over and over telling him I do not owe them any money, he told me I was going to go to jail and they were charging me with three felonies--He used cuss words when he talked to my husband & does not speak english very well. If anyone else heard of this please contact me and let me know omcourtemanche at aol dot com.
Thanks

I'm guessing this is one of the individuals from the same company that is placing the calls. What transpires is this:

You apply for a payday loan

The site you apply for a loan distributes your information to multiple sites that "handle" payday loans

One of these sites holds your information for a period of time, then begins to call you and states that you owe them money. Most of the individuals have Indian accents. As a note, they will have some of your personal information as you provided it during the payday "application" process, so don't be fooled into thinking that because they have information, they're legitimate.

If you try and argue, they just get aggressive. Your best bet is to contact your local Attorney General as well as the FBI. They are calling in an attempt to commit Fraud, since this call is across state lines, this is a federal offense... Don't let them scare you in to giving them any more information than they already have.

Legit collectors per section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for it, the FDCPA requires it), treat the collector like you would any SCAMMER. Scammers are using bought/hacked loan application data to extort payments for fictitious debts from victims and victims' families and friends.
The FBI warns about payday loan extortion scams here http://www.fbi.gov/news/pressrel/press-releases/paydayloanscam_120710
The BBB has issued several alerts on this scam, just google "bbb.org alert phony debt collector"
Report to the Internet Crime Complaint Center http://www.ic3.gov/complaint/default.aspx , the Federal Communications Commission http://esupport.fcc.gov/complaints.htm , the Federal Trade Commission https://www.ftccomplaintassistant.gov/ and your state AG, as appropriate.

At best it would be small claims court.  And I would welcome a court date.  It would be better than just giving my money away.  Also something else I find quite strange.  Any other law firm etc supplies their address and phone # on their web site.  So strange that I cannot seem to locate anything on these people

Always check your bank records also.  If you had taken out a payday loan there would be a deposit there.  And if you paid off the loan that also shows up on your bank records.  Fortunately even if you had thrown away your bank statements, your bank has a record of this.

cb, check yourself. A person doesn't have to prove identity theft unless that company can prove the debt exists first.  If that company can't send some type of documentation to establish a paper trail (which could then be used in court!), then it is not valid.
Folks, make a company prove who they are before you just give anyone money and do not provide information over the phone unless you are CERTAIN about who you're talking to on the other end.

...and one more thing - sure PCS is an actual collection company.  Problem is that anyone can spoof PCS's information and make it appear they are a representative of the company.  I sure hope you, adams, at least got verification of the debt from the company who gave you the loan to begin with if you paid PCS any money.  If someone called me and threatened a lawsuit, I'd tell them to send the subpoena right to my front door.  The fact is, just because anyone says that you owe them money does not make it a fact.
Heck, while we're at it adams, you owe about $542.00 and if you don't send it right away, you'll have a lawsuit.  Let me know when you're ready to send it and I'll get your bank information so I can get the money you owe.
Now, wouldn't you think someone would ask for proof?  Evidently you don't, so I say you owe it and therefore it must be a fact.  Watch out for the lawsuit if you don't give me your bank information so that debt can be paid.

they are required by law to tell you who the orginal debtors are so you can at least get verification of the debt.  If they are not scammers, why will they not provide the information?  Oh wait...why won't YOU provide the information for the original debtor (I'm sure you're one of the scum since you're taking their side when it's obviously a scam)...and who exactly did you talk to at the FBI so I can verify YOUR information?  First/Last Name, phone, etc please.

they are a payday loan collection company trying to collect on a bad internet payday loan.  If they are calling you, you owe the money.  Unless you can prove you are victim of identity theft.

I work for a company and take all incoming calls.  The same foreign sounding guy keeps calling, almost on a daily basis, asking for one of our employees.  I've never verified that the person they're asking for works here or anything.  They've left this number and said they were calling from the legal department of PCS, a company out of Florida and the employee has a legal matter that needs to be discussed with them.  He sounds like a person from India, but gave the name Ben Matthews.  It sounded like a scam immediately.  I contacted the employee after the call and they verified that they had received similar calls to their cell phone and couldn't get them to stop.
