No, it's not. They have to follow the same rules as other third party debt collectors:

In US law, a payday lender can use only the same industry standard collection practices used to collect other debts, specifically standards listed under the Fair Debt Collection Practices Act. The FDCPA prohibits debt collectors from using abusive, unfair, and deceptive practices to collect from debtors. Such practices include calling before 8 o?clock in the morning or after 9 o?clock at night, or calling debtors at work.[16]

In many cases, borrowers write a post-dated check (check with a future date) to the lender; if the borrowers don't have enough money in their account, their check will bounce.

Payday lenders will attempt to collect on the consumer?s obligation first by simply requesting payment. If internal collection fails, some payday lenders may outsource the debt collection, or sell the debt to a third party.

A small percentage of payday lenders have, in the past, threatened delinquent borrowers with criminal prosecution for check fraud.[17] This practice is illegal in many jurisdictions and has been denounced by the CFSA, the industry's trade association.

No No, you see the laws in Mumbai, India are not the same as the USA & Canada. I notice that you (or as you put it 'u') do not mention that millions of Americans are being called by 3rd world criminals, trying to extort money on fake loans. It's always the same quasi-legal, out of context threatening statements from you guys. By the way, did you know that 90% of all people from India do not finish school? Reading what you wrote. . .never mind.

Its not a scam if u owe a payday loan . The collection laws for payday loans are very different. They can be more aggressive. It can be considered depository fraud if you take a loan out and are suppose to repay it with ypur checking account.  So if you owe u owe. Simple as that. I have worked with many types of collection agencies and I do know that payday loan collection practices are very different in what a collector can and can not do.

I received two calls this week from Mr. Jackson @ Lezama Lester & Associates, LLC which is based out of Greensboro, NC about an unpaid payday loan thru the internet. and that he had received a complaint in his office relating to "internet and bank fraud" due to this unpaid payday loan.  He said that if I did not return his call that he would let the authorities (naming the county I lived in) handle the matter criminally.  This did stress me a bit, but I know that as an unpaid debt, the company cannot do anything criminally against me, you or anyone else.  Its an unpaid debt.  They can put the debt against your credit or if they want to file a civil judgment in your residential county - THAT'S IT !!!!!!!!!!!
So glad to see these other complaints on here as well.  It definately helps !

A Mr. Jackson has called my home. He has identified himself as law enforcement to me. To co-workers he states that he is an attorney. He doesn't allow me to ask any questions. He just yells & tells me that I am going to be arrested. He has called my job & told several co-workers & supervisors that I have committed fraud. He has left messages on their voicemails & has even given co-workers detailed information about me including my social security #. When my son answered the phone at home, he told him that he was going to have his mother arrested. I know of nothing & tried to ask him to mail me documentation, but he can't even hear me because he is yelling so much. He is relentless & he is going to cause me to lose my job. Can anything be done?

Mr. Jackson is making extortionist threats which are illegal under the FDCPA--and you need to get a consumer law attorney and go after him and his employer. Period.

The way he acted last night, he must be stopped.  My husband just got out of the hospital and didn't deserve to be treated this way.  It really upset him.  Mr. Jackson said he didn't care about his medical condition that he would have him picked up this morning.

No, you shouldn't--and you have enough evidence recorded from this defenseless bully to have him and his company prosecuted for multiple FDCPA violations.

Mr. Jackson called me several times last night and would not let me speak.  I recorded the whole conversation.  He tried to belittle me and my husband.  He stated that we didn't have a good marriage and all sorts of stuff. I tried to ask him facts but he just danced around.  Some info that he gave me was incorrect.  He said that my husband would be arrested in the morning.  He wouldn't let me talk and was very rude.  I will file a complaint.  I shouldn't have to tolerate this type of behavior from such an a!!hole!

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I have reported Mr. Jackson and Lezama Lester and Assoc. to the FBI, FTC, and the Attorney General's Office.  I suggest each of you do the same.  This company also operated under another name in Atlanta and was shut down by the FTC, and reopened under this other name in North Carolina.  I was told by the AG's office that Mr. Jackson committed several criminal offenses, including extortion, impersonating a law enforcement officer, impersonating an officer of the court (atty), harrassment, stalking, and terroristic threats.  The problem is....we don't get the real name of these people.  They may all be one in the same, using aliases.  I have an atty and this is being aggressively handled both in civil and criminal court.  I have enough to get a warrant sworn for Mr. Jackson, so we are working now on his real identity.  We'll see who eats his words....once he is the one arrested at his job as he threatened would happen to me.  We have him recorded calling me a criminal and many other disturbing verbal tirades as he enjoys hearing himself talk, yet allows no one else to speak.  This guy is slick.  Send a cease and desist to 336 217-7992, which is the real fax number, not what is shown on the website, which is false.  Also send one certified mail to the address listed on their site.  You will not get anywhere trying to get this man to send you anything in the mail to validate your debt, and even if the debt is valid, the practices he is using are not legal.  Good Luck.

Harassing Debt Collector.  A Mr. Smith claimed that I defrauded the FDIC by taking out a Payday Loan.  He was detailed with my bank information and he wanted to verify my social.  I did not confirm my social to the individual.  He was extremely rude and disrespectful and was using abusive language.  He needs to be stopped asap!!

I got a call from Mr. Jackson last Monday threatening me regarding federal article 805-11 under the federal fraud statute for a pay day loan, and advising the FDIC was involved.  He "danced around" threatening me with being picked up at my office (arrested?) right before Christmas, and he just couldn't stand to see that happen.  I adv him I work in a law office, as he should know because he called me here, and I said let me put a lawyer on the phone right now and he backed off a bit, stating uh, well if you want them to send me a letter stating they are representing you, otherwise I can't talk to them.  So I said okay, and just let them come arrest me then.  He says, well okay, I can't get a "stop action" on this "order" without a payment plan. The lawyers here checked everything out and it was all a total lie.  He even lied and said the bank I had used and had the account closed on was involved in this action against me.  Also a fib.  I did owe the money and arrange a payment plan I could live with, but don't fall for the lies.  Make a payment plan you can keep and don't get bullied by Mr. Jackson, because...he's really good at what he does.

I received my first call from Mr. Jackson today but it was from 404-781-3610.  Previously he had gotten in contact through a message to a family member stating they were listed in a complaint to commit Federal Fraud due to an unpaid balance on a payday loan.  I was taken in as quickly as my family member was.  I had spoken to him several times and waited on phone calls back from him which never came until today.  he tells me my number is phony and he is unable to reach me, however, he reached me through his cell phone that is from the Atlanta Georgia area.
When I got curious about the Federal code 805-11, I searched it and came across a posting on Who is this Number, with many complaints about Mr. Jackson with regard to payday loans.  I then called the payday loan company I had used and was informed their procedure on unpaid balances was to forward them to a collection agency, not seek federal fraud charges.
I had given the "nice" Mr. Jackson my credit card information and had to make a trip to the bank to make sure no transfers could be made with that card and then waited for him to call.  I had also talked with a FBI agent at our local facility in regards to Mr. Jackson's calls.  I was informed to file a complaint with the Federal government on internet crimes at www.IC3.gov.
If you have received these calls, do not give your information, make sure you report it.  It is very important so that we may stop SCAMS such as this one.

I just received an internet famous call from Mr. Jackson!!
You would think he would NOT be dumb enough to call again, after speaking with my Local Sheriffs Department, but nope, here he is calling again! Threatening again...Only this time he did his homework & actually knew the name of my County Court System~ LOL (thats a good thing to know when trying to scare money out of someone!)

Little does he know, my husband is an ex loan consolidation rep, who actually DID HELP people pay off loans...Haha, jokes on Mr Jackson.

PLEASE DO NOT GIVE THIS MAN YOUR INFO!!!!
Stand your ground, ask for HIS INFO, & PROOF OF DEBT IN WRITING!!!
You MUST state that~ "I want proof of MY debt, in writing, mailed to me. Only then will I respond to your request for payment, either admitting or denying my part of this debt."

That way when you are "being recorded" you neither admit, nor deny any obligation. If the debt is real, you will get verification, if you dont, No loss!
As far as verification, DO NOT accept an email!!! Mail only, & make SURE it is LEGAL documents that were signed with the original company that you obtained loan or service with, NOT COLLECTION CO LETTERHEAD~ that is NOT verification!!

If they refuse to send you verification, block the number, report it to FCC, & go file a report with the local Police Dept. This is VERY IMPORTANT to do, if you believe the debt is NOT YOURS, or you already paid it. Give them any info you have on Mr Jackson, including that fake name, the number he called from, the firm he claims to work for, & specific notes written using specific words that he used to threaten you.

For fun, you can inform Mr Jackson that your Local PD has his info & will be contacting him shortly! He likes that ;0)

Hope this helps!

YES ITS A SCAM!!! Dont respond to it, i just got the same call, and before this call ive recieved several phone calls from the number 000-000-0000, they leave a message saying they represent Alan shaw, who i found out is a major scammer, and they said to call a number 888-323-5921 and so i called and it was some rude guy telling me that my husband owes two debts a payday loan and for check fraud! Weve already paid off the payday loan, and we havent committed check fraud, so we told him we have the paperwork to prove it, he said some really rude things, and we told him to stop calling, about 3 times now, its always either him or some lady that answers and says we owe these debts that we dont owe, and this morning they called again and my husband told them to stop calling and now we're getting this call about a case complaint from Mr. Jackson, whoever the hell that is! So please dont bother with them, if they call again i would report them to the FBI, FTC, or local police, and leave it at that.
