i received a call early this morning from this rude woman. She asked my name, and wanted me to verify my home address. i asked her what this is in reference to and shesaid "personal business matter." I continued to ask questions, but she cut me off and tried to verify my birthday which was incorrect. I told her I wasnt confirming anything until she gave me more info, but she cut me off again and mentioned my 7 yr old daughters name so I hung up on her. I'm glad I found this forum. I'm going to block this number before they start harrassing me for whatever info they claim they need.

This number calls my cell at least every day. This collection company needs to take lessons on how to do their jobs. No messages, no speaking, and rude when they do. I have an old card bill that needs to be paid but seriously, how much is the card company paying them to collect 400 bucks...ive simply blocked them.

Keep getting calls from this number. The latest was at 9:00am in the morning. They don't leave voice mail. I have no outstanding bills. I don't pick up numbers that I'm unfamiliar with, guess they will just have to keep listening to my answering machine (or leave a message). Also, when I try dialing the number to see what company it is, I get a error message.

THEY call me all the time. I have no debt of any kind . they asked for me by name I said thats not me.they then told me my address I again said not me. Then they said the last 4 of my ss #. Not cool. If they happened to call the wrong person they would have all my info. I'm contacting every agency I can to correct this ridiculous company or driving the hour to the office and wrecking havoc. They never say why they are calling or who they are etc. But its going to end. My lawyer is writing a cease and assist letter for them now.

They called for my boyfriend and would not tell me the company name either. If they want to get a hold of someone and get past me they have to tell me their name and company or I block them. Very harassing.

Sent collection notice to my 83 yr old father, on a bill from a company he has never used.  I am wondering if they are committing fraud, trying to take advantage of the elderly who might think they owe something they do not? i know my fathers accounts, i am his bookkeeper.

I've received a couple of calls from this number. I didn't answer the call because I didn't recognize the number on the caller ID and they didn't leave a message. It must be a hospital bill collection call since that is the only bill I'm behind on.

This woman just called my cell phone and asked for me by first name. She then stated my address and asked if this is where I live. I asked whose calling. She was very rude and stated my address again. Asking if this is where I live. I asked who is this? She said I will call you later. Almost eery to hear this woman's hateful voice and would not tell me who she was. Bad business! Scary!

North Carolina Fair Debt Collection Practices Act § 58 70 100. Harassment.
No collection agency shall use any conduct, the natural consequence of which is to oppress, harass, or abuse any person in connection with the attempt to collect any debt. Such conduct includes, but is not limited to, the following:

(1) Using profane or obscene language, or language that would ordinarily abuse the typical hearer or reader;

(2) Placing collect telephone calls or sending collect telegrams unless the caller fully identifies himself and the company he represents;  THIS COMPANY DOES NOT DO THAT AND REFUSES TO TELL YOU WHO THEY ARE UNLESS YOU GIVE THEM PERSONAL INFORMATION LIKE YOUR FULL NAME AND ADDRESS

(3) Causing a telephone to ring or engaging any person in telephone conversation with such frequency as to be unreasonable or to constitute a harassment to the person under the circumstances or at times known to be times other than normal waking hours of the person;

(4) Placing telephone calls or attempting to communicate with any person, contrary to his instructions, at his place of employment, unless the collection agency does not have a telephone number where the consumer can be reached during the consumer's nonworking hours. (1979, c. 835.)

No collection agency shall collect or attempt to collect a debt or obtain information concerning a consumer by any fraudulent, deceptive or misleading representation. Such representations include, but are not limited to, the following:

(1) Communicating with the consumer other than in the name of the person making the communication, the collection agency and the person or business on whose behalf the collection agency is acting or to whom the debt is owed;

(2) Failing to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector; provided, however, that this subdivision does not apply to a formal pleading made in connection with legal action;  THIS COMPANY DOES NOT TELL YOU WHY THEY ARE CALLING - THEY WANT YOU TO VERIFY ALL YOUR INFORMATION AND WILL ONLY SAY PERSONAL BUSINESS BUT WILL NOT TELL YOU WHAT TYPE OF BUSINESS OR THAT THEY ARE DEBT COLLECTORS

(3) Falsely representing that the collection agency has in its possession information or something of value for the consumer;  THEY TOLD ME THAT I HAD SPOKEN TO SEVERAL PEOPLE IN THAT OFFICE BEFORE WHEN I HAVE NO CLUE WHO THEY EVEN ARE!  LIES LIES AND MORE LIES!

(4) Falsely representing the character, extent, or amount of a debt against a consumer or of its status in any legal proceeding; falsely representing that the collection agency is in any way connected with any agency of the federal, State or local government; or falsely representing the creditor's rights or intentions;

(5) Using or distributing or selling any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by a court, an official, or any other legally constituted or authorized authority, or which creates a false impression about its source;

(6) Falsely representing that an existing obligation of the consumer may be increased by the addition of attorney's fees, investigation fees, service fees, or any other fees or charges;

(7) Falsely representing the status or true nature of the services rendered by the collection agency or its business. (1979, c. 835; 2001 269, s. 1.4.)

They just called me identifying themselves as Data Max and asking for me by my first name, which I do not go by.  Then asked me to verify my home address.  I told the lady I don't give out any personal information over the phone to anyone I don't know.  She argued with me saying I had spoken to several people in that office before.  I told her unless she told me who she was and why she was calling I wasn't telling her anything as I have never talked to anyone at Data Max.  She refused to tell me why she was calling and would only say "personal business".

I did collections for years on both auto and medical debts.  It is illegal for anyone to call you and refuse to tell you who they are when they are trying to collect a debt.  If these are debt collectors then I have no clue who they are or what they are collecting on because as far as I know, I don't have any debts that I am not paying.

Caller asked for someone who doesn't work here. Informed caller there was no one here by that name. They apologized and ended the call. They were well spoken and polite.

Apparently this is not the case with all of their representatives.

Collection agencies must tell you that the call is an attempt to collect a debt. If they don't inform you, then they're breaking the law.

They use the "we have to verify your identity' excuse to get around telling you who they are. Pretty clever to evade the law by pretending to follow it.

The FDCPA must be really tough for collectors because very few agencies even attempt to obey the law anymore.

A lady just called my phone from that number and asked me for my info. but I wouldn't tell her. I asked her for her name and the companies name and she gave the info. to me at a pace where I couldn't understand it. Then I asked her what her company does and she wouldn't tell me. She wasn't rude but they have got to be insane if they think people are just going to give them personal info. and they don't even know who they are. Really

This number called my phone about 8:30 am and asked for me. When asked who they were and offered if they wanted to leave a message, they completely ignored the question and RUDELY DEMANDED to know what time to call back, and if this was the only number for me. Needless to say, I have enough problems- I will not be disrespected and deal with crap I don't have to deal with. Times are hard for everyone, I am fortunate that most companies I owe, have been very sensitive to the issues of today and Common Sense should tell these people that although we (people that's being called) may owe them money or may not-  "YOU GET MORE BEES WITH HONEY THAN ***T"!!!!   TREAT OTHERS THE WAY YOU WANT TO BE TREATED!    UNDERSTAND THAT WHILE "WE" ARE DECIDING WHO WILL BE PAID AND HOW WE ARE GOING TO FEED OUR FAMILIES OR PAY FOR THE ROOFS OVER OUR HEADS, or MEDICATIONS/TREATMENTS/ HEALTH ISSUES, AND WHATEVER THE SITUATION MAY BE THAT AFFECTED OUR ABILITY TO PAY------------- THESE PEOPLE CALLING SHOULD AT THE VERY LEAST BE PROFESSIONAL"!
