Got the same call on yesterday from Leah Paige.  She left a claim number saying that it was very important that her call was returned or else she would file a claim with some county that I have never been in.  I'll wait to see if she calls back.

Thank you a thousand times!!!!! Someone who calls himself "Investigator North" has been constantly calling me and harassing me. He would only leave some cryptic file number. First of all, I don't know who this guy is, and second, he never identifies the supposed creditor! He wants to give the impression that he is with a law enforcement agency, but fact that he doesn't state that raises red flags. But the fact that he starts the conversation off by saying that he is "Investigator." This is designed to raise "fear" and anxiety in a person. If you listen closely, you can hear a lot of background conversational noises. That raised all sorts of red flags, but it did cause me a couple of sleepless nights. They even called asking for my ex-daughter in law! When I told them that they had the wrong number and that she was someone one of my sons knew from years back, they tried to keep me on the phone to get additional info. In the process, they even said out loud, one of my other son's girlfriends names. I said "Who...?" I hung up on them. But again "Alfalfa" kudos to you!

Do you know now what I should do. I sent out a certified letter last week, and the compnay still is calling my work telling me that they are going to have a lawsuit against me. They said they sent me something in the mail to validate, but that it came back to them in the mail.I told them they are violating my rights and I have no idea who they are. Ms. Hariett (so she calls herself) then puts her supervisor on the phone and continued to harras me after me telling them they have called about ten times when I had asked them not to. I have yet to receive the return receipt in the mail yet saying they signed for my letter. He also told me I don't know my rights or I would now that I have to pay this bill before they persue a lawsuit against me.

Thank you so much for your help. I am at work today and they called again demanding I pay over the phone with a credit card. I told "Invesigator Harriet, so she calls herself" I told you not to call my place of employment and she said well this is ms daniels. I said you have the same voice and who in there right mind would pay over the phone with a credit card when I have no idea who you are. I finally had to hang up cause she kept yelling at me.

Today I will be sending a certified letter demanding that they validate the debt they say I owe.

Look under http://800notes.com/Phone.aspx/1-404-524-0848, and you will see further evidence which disputes their claim that they are in "full compliance with FDCPA laws".

As for you, J, they have violated Sections 805, 807 and 809 of the FDCPA by:

1) Refusing to comply with your request for debt validation (809),
2) Refusing to cease communication (805), and:
3) Threatening to take actions that are not intended to be taken or cannot
  legally be taken (807).

I suggest that you do the following:

1) Send them a letter via certified mail (with return receipt requested),
demanding that they validate the debt they are calling about.

2) Pull your credit reports from all three bureaus (Experian, Transamerica
  and Equifax).

If you find that they have placed any derogoratory remarks on your credit reports and continue harassing you without first validating that you owe this alledged debt after you have proof they received your letter, it's a slam dunk. You can sue the %$&#! out of them:

Who         Why              Precedent/Law              Fine
Creditors if they report your credit history inaccurately  Defamation, financial injury (US Court of Appeals, Ninth Circuit, No. 00-15946, Nelson vs. Chase Manhattan). Extent of damages incurred by the wronged party as deemed by the courts.

Creditors, if you dispute a debt, and they fail to report it as disputed to the credit bureaus Protection under the FCRA (FCRA Section 623. $1,000).

Creditors if they pull your credit file without permissible purpose. Injury to your credit report and credit score (FCRA Section 604 (A)(3)). $1,000.

If you dispute a debt, the collection agency fails to report it disputed to the credit bureaus Protection under the FDCPA (FDCPA Section 807(8)). $1,000.

Collection agencies if they do not validate your debt yet continue to pursue collection activity (file for judgments, call or write you).  Consumer protection afforded by the FDCPA. (FDCPA Section 809 (b), FTC opinion letter Cass from LeFevre). $1,000.

Collection agencies if they have not validated your debt and they still continue to report to the credit bureaus. Consumer protection afforded by the FDCPA  FDCPA Section 809 (b),(FTC opinion letter Cass from LeFevre).
$1,000.

Calls you at your place of employment if the debt collector knows or has reason to know that your employer prohibits the consumer from receiving such communication. Consumer protection afforded by the FDCPA. (FDCPA Section 805.(a)(3)). $1,000.

I called the mumber back she gave me, too see how they answer the phone and she answers the phone as investigatons. No one is allowed to issue a warrent except for fbi and police. Don't believe them. She claim the company is called Delanoir and Kemper Assoc, she is simply a bill collector...I will be reporting them & her, cause I know my rights. I told her not to call my work and she has done so three times since I have told her not to.
