Okay. This number has been calling me for six years now, no joke. They say they're looking for some guy named Aidan who's in debt. I've told them a few times that I'm not Aidan but they still call. They call less frequently now, but sometimes I get calls from other numbers also looking for that guy named Aidan.

Portfolio Recovery Services calls my cell phone several times a week over a debt (That if it is legit) is well over 20 years old...STATUTE OF LIMITATIONS??????????????? I Know the Statute of Limitations is certainly not 22 years here in Florida. Here is the kicker....they call you from a Phone Number where they know you have friends,family or business associates who live in that area code...in this case Atlanta (After the calling from 407 Orlando failed) tomorrow caller ID will be from Upstate New York Area Code....I Guarantee it! I Save the Phone Number as Telemarketers Scumbags so next time they call from 407 I'll know it's these JERKS! Also they call you by your first name and try and hook you in like it is your friend and then they call you Mr or Mrs by your last name after you say "Hello".

Portfolio called me from this number trying to get me to pay off a credit card that has been paid off and canceled for 5 years. I explained it was paid off and canceled, they gave me an email address to write to saying so and said that would allow them to remove it. I did so and the email given was NOT a valid email address. SCAM - SCAM - SCAM!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

General Information about what to do:
FCC is in charge of how the company reaches out to touch you? Phone company violations, and Bank behavior. FTC oversees company violations (anything not FCC).
FCC TCPA (Telephone Consumer Protection Act) The first page tells you what they oversee.
http://www.fcc.gov/document/telephone-consumer-protection-act-1991
Every other kind of complaint goes to the FTC. However, the agencies are combining their efforts through sharing of information (Thank you President Obama!)
FDCPA (Fair Debt Collection Practices Act)

To obtain a free Annual Credit Report to get the addresses and names of the ?debt collectors? from Equifax, Experian and, TransUnion:
https://www.annualcreditreport.com/cra/index.jsp
State Statutes of Limitations for old debts:
http://www.bankrate.com/finance/credit-cards/ ... ld-debts-1.aspx
Get the credit report, and the .PDF on the FDCPA site, and learn about statutes of limitations on your states. Learn your rights and obligations.
You may contest a claim verbally. But, if you don?t owe, or, don?t want to pay the debt, or just want them to stop contacting you, the FDCPA gives you the right to inform the ?debt collector? by mail to stop contacting you. They may then only contact you by mail, and then only to tell you that they are litigating.
Note: Threats are illegal! After you send the letter, If they are litigating they cannot lie to you and must supply that information through the mail.
The letter is a legal order to stop calling you. Get a return receipt for proof they received it. If they do not stop calling, file a complaint to FTC, you will have the legal advantage, and you give the FTC & FCC power to take action. If you don't want litigation, find the statute of limitations for your state regarding the debt. Then, write the letter after the debt becomes "Time-barred". Then, if they litigate, an attorney will inform the court the debt is past the statute, and "time-barred", the judge will most likely dismiss the case. At this point in time, I know of no exceptions.
Read FDCPA § 805 15 USC 1692c a.k.a § 805©

Actually, this falls under a different category... see my message above... Report this to the FTC, and possibly the FCC if they are Abandoning the call.
| Cyberchipz 2013-07-03 22:41:40 Unknown |
This type of violation goes to the FCC; it is a Robocall sub heading Abandoned Call and is a violation, report it to the FCC.gov / File a complaint. Who to report to was so confusing to consumers that we didn't know whether to report it to FTC or FCC. The FTC oversees the company and it's violations. The FCC oversees the method of violation (Phone calls) or (Bank Actions), and this is where the changes mentioned are taking place. To be forewarned is to be forearmed. Arm yourself with your rights.

You can do something too. By learning the law and your rights, then filing a complaint with the FTC; you give the FTC the fodder needed to go after them. Too many people have this problem and don't know their rights, or incorrectly report violations that are not "really" (according to the law) violations. However, the 'debt collector' violates enough of the real laws that by your knowing them, you can file legitimate complaints and allow our lawmakers and enforcers to go after them.
This site has become more than a site about who the number belongs to; It is an opportunity to educate.
Live, Learn, retaliate... legally.

I need to correct you on this; they can not reset the date of the bill they are trying to collect just from talking to you. In order to do this, you must admit that the bill is yours, make arrangements, and make a payment. Admitting you are the person they are looking for doesn't count.
To quote one of many articles on the subject: Zombie debt collectors and debt scavengers often use illegal or questionable tactics to get consumers to pay old debts. Often, the goal is to trick the consumer into making a payment on a debt for which the statute of limitations has run. By making a payment -- no matter how small -- the consumer resets the statute of limitations. Another term for this is 'Ringing the bell', which BTW is also what a lot of debt companies do, when a collection agent is successful in getting someone to pay, even a small amount of a debt that the scavenger says they owe, because, they have successfully caused the statue of limitations to reset, and the debt is now valid. However, on a debt you do not owe, even if you pay a small payment, you are not required to pay any more and can contest the debt. Do not fall for this trick. Simply, discover the statue of limitations on that type of debt for your state. http://www.bankrate.com/finance/credit-cards/ ... ld-debts-1.aspx, acknowledge who your are, and tell them without admitting you owe the debt that the debt has gone beyond the statue of limitations. This will not stop them from calling you. To get that, you must write and send them a letter stating "you don't want them to communicate with you on this matter". Search for FDCPA § 805 15 USC 1692c http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf

Funny that. The law is written in such a way to require them to remove your number.... IF they believe you're not lying. So, if they call again, that's why they're calling again. THEN, the only way to get them to stop is to write them a letter telling them you do not wish to be contacted by them. And, then if they call, they can be fined or sued. Ironically, Port Folio is the only 'debt collector' that even remotely tries to follow the guidelines. So, I expect if they have reason to believe, or should I say no reason to disbelieve there is no one at that number they need, they will stop calling.
Here's what the FDCPA says: http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf
§ 804. Acquisition of location information
Any debt collector communicating with any person other
than the consumer for the purpose of acquiring location information
about the consumer shall?
(1) identify himself, state that he is confirming or correcting
location information concerning the consumer, and,
only if expressly requested, identify his employer;
(2) not state that such consumer owes any debt;
(3) not communicate with any such person more than once
unless requested to do so by such person or unless
the debt collector reasonably believes that the earlier
response of such person is erroneous or incomplete and
that such person now has correct or complete location
information;
and a couple of others...
However, case in point, they called me the other day and refused to identify their employer. I filed a complaint.

I believe you can file for bankruptcy and just don't put the storage space down for your debts. They only cancel what you put down, that is why they warn you to put all your debts down.

Portfolio Recovery has been calling regularly for the last year & a half. I never answer a call unless I know the number or person phoning. If they would leave a message stating who they are looking for but they expect me to phone them back - on the rare occasion they leave a message. Ha ha good luck.

Based on the last date, it looks like this number is being used again. Thank Goodness for Google Voice. They just hang up when I send it to voice mail. Too bad they didn't leave a voice mail, and I have blocked this number so I guess I will never get to scream at an actual human associated with these scum bags.
