I just received two calls in a row from this number.  I don't answer calls from numbers I don't recognize and I always google them to see where they come from.  I got four calls yesterday from someone that the ID only would come up 79 and I assume it was probably them.  I also have someone dealing with a similar situation like this but an attorney was contacted to find out what to do.  If you decide to talk to these people and they claim to be from a law firm or are going to sue you.  Ask for them to provide proof of the debt, that is required by the FDCPA, they are not allowed to discuss anything regarding what they are calling about with anyone besides you, including your family, they are only allowed to tell them they are calling regarding a personal matter.  Ask them if they work for or are an attorney, what their bar number is and what states they are filed to work in.  This will let them know you mean business.  If they give you some kind of number you can go to the bar in that state and see if their number is legit or file complaints if the number shows up, they could have stolen someone elses as well so be prepared.  Also, file complaints with the FTC, Attorney General in your state and in the state the phone call comes from(if it can be traced to a particular location), also if they will not stop calling you, file a harrassment complaint with your phone company(landline or cell) and your local police department.  Keep all records of when they call and how many times each day.  IF they are ever to be tracked down, this only helps the case against them.  Most of the time they are foreign and never are caught and continue to change their numbers but once in a great while you can get lucky.  Lastly, the attorney said to have some fun with them if you want.  Like someone posted above, answer the phone like you are a local police department or attorney generals office.  They might stop calling.  Good luck, I know there are hundreds of these scum out there and they are not going away but maybe if we keep going after them, they might, just might get the hint.

This is what happened to me this afternoon,

They left a message on my mothers cellphone, here's what I heard:

fuzzy noise in the background , kinda making me think they are calling from out of the country
a guy who introduced himself as troy, but couldnt possibly be american, maybe indian..
he couldnt make correct sentences in english
told my mother she was used as a reference and my brother owes money or theres a lawsuit
lastly said call back do not ignore this call or whatever in the worst english he could

my mother was FURIOUS! SHE THOUGHT IT WAS REAL AND WE CALLED BACK

first she asked what was going on, when she asked why he owes money or be more specific he hung up the phone and didnt answer when we called again. We called from out house phone and they picked up. The guy was nice at first then got all rude when my mother started asking questions.

I then googled all of this and see its a scam.

My mothers advice to you all and my brother....

Call your local police, give them the number and tell them whats going on.
Do not give out your personal information even if they have your social security.
They wont answer any of your questions about the debt you owe, which isnt allowed and you dont have to listen to them..

Man i wanna kick some a** right now...callin my family like that.

I keep receiving the same calls from these people. I did have a payday loan but I have paid all of them back last year so I know this has to be a scam. They also called my refrence as well which really upsets me because they are telling my refresnce I commited a fealony which is totally wrong and it is terrible of these people to actaully call other people you know to get money too. And yes they did know all of my information. I which I knew how they got my information because those people need to be takwen down as well. PLEASE EVERYONE FILE A REPORT ON THEM http://www.ic3.gov/ that is the govts website for online scams. If others know other places to report them to please let us know!

They not only continue calling me but now have called and threatened my 89 yr old grandmother that was a reference on my application. I know payday loans are a bad thing but needed them to get xmas gifts for my kids as a single mom and now they are putting me through misery and my family.. I just want it to stop and need to know how to do it. They threaten me, my grandmother and refuse to provide any proof only want our credit card numbers and phone numbers.

Just got a call from 408-355-9338, no message that I could tell, could barely hear or understand the guy, there was a lot of static & noise in the background and it sounded like he was talking to someone else.  The number came up two more times on my caller ID, right in a row, the second time he left another message and I could hear someone else leaving that same scam, "wish you good luck" message in the background, while he was sitting there talking, either to himself or to someone else.  Then the message cuts out.  I don't think he realizes that he is talking to an answering machine...

In certain states your wages cannot be garnished for certain liabilities. For instance, if you owe taxes, they will garnish your wages, if you owe child support and have been a deadbeat parent, they will garner your wages, however, there are some jurisdictions that will not garnish your wages for certain unsecured debt.

More input from FAQ Farmers:

Florida but only if you are head of household.

South Carolina, too!

Pennsylvania, South Carolina, North Carolina and Texas do not allow wage garnishment for creditor debt. Florida does not have specific laws prohibiting the action, but does have laws that make it very difficult for wage garnishment against the "head of household."

Kansas - Special "purchased paper" law. Basically, if an account is sold to another company *BEFORE* judgment, a wage garnishment is not allowed. If an account is sold to another company *AFTER* judgment, then a wage garnishment is allowed

Prank Call
Don't worry Kim, these guys are frauds.  The received your information from an application that you filled out for a pay-day loan.  There is no action that they are going to take on you, because of several reasons.  1) They are scam artists 2) They are operating outside the US and do not represent any US company 3) They break 3 federal laws just in their introduction " Hello this is (insert some fictious "American sounding name") calling from the Federal Law Office of the American Legal System".

Collectors are not allowed to falsely represent themselves, especially imply that they have some sort of ties to the government.  Also, if you ask these imposters to produce evidence of the debt, they will not.  This also is not allowed by law, nor would it make any sense for you to listen any further to their conversation.

What their scam is, they hope that when they recite your social security number (yes, that DO have that information) that you will be scared enough to pay whatever amount they ask you to pay.  They then ask for you to fax them a letter with your credit card information that authorizes them to make the charge.  Once they have that, they have their scam in place.

My suggestion is, do not apply for payday loans online.  And with the pranksters that already have your information, either don't answer, hang up, or play the game right back to them.  My personal favorite is to answer the phone with "Attoney General's Office"...
