Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. Some ratchet indian guy claiming to be named Mark Thomas called my house saying my dad was having federal charges, I searched up the number he was calling from on google, I found out he was fake and I told him that, I could tell he was angry but he still tried to convince me he wasn't fake by saying I will get in real trouble for talking back to him then he requested to hang up because he knew he got caught.

The caller sounds foreign and cannot even say my first name correctly.  He then says he is a police officer and that there is a lawsuit against me and my social security number.  He then gives me a second number to call back trying to get my social security number and address so he can proceed with the charges against me.  He refuses to give me any information by saying he cannot tell me what the lawsuit is about.  This guy can barely speak English.

Calls asking if I know somebody that I haven't actually spoken to in years...says there is an affidavit regarding this person in a legal matter. Claims to be a Law Enforcement officer but can't even speak english. Sounds like a Hindu Indian. I lost it on this dude and I hope he cried.

I got the call - although he changed his name to Stave Brown.  Thick accent, he told me my friend was under investigation for fraud and he needed his phone number.  I told him I didn't have it on me.  He identified himself as working for the Fraud unit in Maryland and said if I didn't get that phone number to him, I could be in trouble too.

He also made some bizarre claims that my friend got a hold of my social security number.  If he calls again, he can talk to my vm.

I talked to a Marv Thomas today. April 14, 2010 Same number as above and ext 1033. He said he was trying to contact an old friend of mine who rote my name as a ref. on  a pay loan.  This guy would not let me talk to his supervisor and would not give me any co. info and also told me if I didn't help him he would open a file on me that ties me into this loan. Something is not right with this situation and I am going to have my lawer look into this. Good luck!

I got a phone call with the guy named Mark Thomas saying I owe money to some payday loan, he couldn't give me no infomation about what I owe, and the number he called me from was an 845 area code, so i called it back and an anwering machine came on and it was a personally cell phone, so I called that 410 number back and ask to speak to mark, then the guy claim his name is Paul, WTF is going on, I'm about to contact the FBI on the matter,

On Monday, April 6,2010 I recieved a phone call from a man claiming to be Officer Mark Thomas from the State Invesivation Office in Baltimore, Md. He said he was calling because my social security number and name was under investivation for fraud and that if I wanted to settle this out of court that I had to send him a total of 1071.00- for a 400.00 loan that I was suppose to have gotten off the internet. If I did not agree to do what he ask, I would have federal charges brought against me and I would be arrested and taken to federal court. He had all my information-social, address, and bank info.He also had my daughters and sister-in-laws name, phone number and address. He has also threatened them with charging them with interfering with a federal investiation. I have called my states attorneys office and reported it to the police. I have also recieved calls from an so called officer Steve brown. They call from 301-723-7282- a Maryland number, they are actually calling from a land line from Pa. The call back number is 410-949-1094, ext.1033.

My daughter's cell has received the same threatening phone calls from the same Indian who you cannot understand.  I reported them this morning to the Ohio Attorney General's office and the FTC.

This same person, "Mark Thomas" has called me three times at work today and twice last month. He threatned me saying that he was going to take legal action against me. When I demanded an explanation he got real nasty and told me to provide to him my attorney's name and phone number, and if I didn't do that that i would be in serious legal trouble. I demanded for him to tell me what it was that I have done to be in trouble and he hung up. I called him back and another guy got on the phone,  "David Daniels", I asked him for more information and he hung up on me also. I called back and left them a message on their extension "1040" to stop harrassing me or I will press charges agaisnt them.  Hopefully they won't call back.

Consumer Alert: Attorney General warns Kansans of debt collection scam

January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers.   Consumers are warned to not submit payments to these fraudulent debt collectors.

When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid.  Consumers state they have never obtained such a loan or paid off the loan years ago.  The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names.  It appears the phone numbers used by the scammers are ?spoofed? numbers, so that the number appearing on a consumer?s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.

When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent.  These scammers have been able to provide consumers with identifying information, such as the consumer?s social security number, home address, e-mail address, names of family members and the consumer?s computer IP address.  Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.

If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court.  Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union.  The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as ?We?re filing an affidavit against you? or by stating a lawsuit has been or is in the process of being filed against the consumer.

A hallmark of each scam has been calling consumers repeatedly at their place of employment.  This scam hit home when an employee of the Kansas Attorney General?s Office was repeatedly called both on her cell phone and at work.  Despite the employee?s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an ?officer?.

?I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ?If that?s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming?,? stated the employee.

?It is important for consumers to know their rights under the law,? Attorney General Six said. ?If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.?

Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact.  The notification should contain  information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer?s arrest, or using the threat of violence.

guy with heavy accent called my phone trying to get in touch with a friend of mine saying that she used my identity and kept asking for her #. i told him that i did not have it and to give my his info. he told me is name was Officer Danny Jackson calling from states investigating department and that if she did not call back they would take legal action against me.

I received several phone calls today from 410-494-1094 from Officer Mark Thomas. He is also calling my friends to get in touch with me. He wants me to pay some debt that I never took out. He wants me to pay with a prepaid debit card. He said if I don't pay, he can not be responsible for what happens to me. He speaks with a very thick Indian accent. I asked to speak with someone that speaks English and he hung up on me.

Today, I received a call from 322-0004, with no area code, from "Officer Mark Thomas", explaining to me that there was a warrant out for my arrest if I weren't willing to settle a debt for $585.00.  He gave me a "case number", and phone number 410-949-1094, ext. 1033.  When I asked for information to do my own research, no specific information was given. When I asked whether I could pay in a money order, I was flatly refused.  I was told to put it on a pre-paid debit card.  I refused.  I then called the creditor that was claimed to be the owner of the debt.  I was told by them that everything checked out.  When I tried to call back the "officer", at 322-0004, it rang with no answer.  When I called back 410-949-1094, from my cell-phone, an unidentified voice-mail prompt directed my call to ext. 1033, for "Officer Mark Thomas".  While I was leaving a message on 410-949-1094 ext. 1033, my land-line phone rang from 322-0004.  I've contacted my bank and the creditor with this information.  LOOK OUT!!!

he called me at my work saying i owe money from a loan that i never got . he had my personal information read me my rights, couldnt understand a word he said... claims to be officer mark thomas with the investigation department. its not that i didnt pay my loan he said it was for money laundry... i then looked up the number and i gives me a daycare service how strange is that... that a daycare service is charging me for a loan weird right... if anyone can give me information on another way to report him please send me a email at Mdahumada@aol.com..

this dude told me i was under federal investigation gave me a case number but i was like whats this about he gave me the run around then he say we can settle this if i pay what you owe thats crazy cuz he told my peoples somebody stole my identity so i would call them then he played with my life for 10 minutes and when i said i was gone fight the case he hung up some indian dude said his name was Sergeant Dustin Wright i tell u that was crazy
