Statute of Limitations  for Debt **** please read***

Statute of Limitations - The Get Out of Jail Free Card!

The Statute of Limitations is a legal way to be absolved of a debt. Debt can be an over whelming burden when you don?t know how to handle it. Educate yourself on your options by spending time on the site and check out the Debt Recovery FlowChart.
Changes were made to the statute of limitations in Ontario. These changes came into effect January 1st of 2004. Meaning that debt incurred after this time, come under the new Ontario limitations act 2002.
Therefore, after January of 2004 a creditor has two years in which to bring proceedings against a debtor. However, this two-year period is reinstated if at any time the debtor acknowledges the debt after that time or makes a partial payment toward the debt.
Now debts incurred before January of 2004 are under the old statute of limitations law. A six year limit for debt collection was the law before 2004.
There are many ways to work with overwhelming debt. The first step is to consult a professional to determine exactly what is best in your situation.
The first thing you will want to consider is that if the statute of limitations is still looming over you it is best to get your debt under control by whatever means is necessary.
1. Budget Counseling
This is a good way to look at where your finances are going and where you can cut back to strengthen your cash flow to help reduce your debt
2. Debt management
This is a plan designed to work out a manageable repayment plan with your creditors.
3. Debt consolidation
Sometime you can arrange a bank loan to consolidate all your debts into one manageable payment.
4. Mortgage Refinancing
This can also make it possible to consolidate your debts and everything to a manageable one-payment solution.
5. Bankruptcy Protection
Bankruptcy is not something that you should enter lightly. Unless you are in a dire situation, it is best to look at all the options that are available first.
Entering bankruptcy can have dire consequences. Bankruptcy often meaning the loss of most everything, Real state, Cars, and anything that is in your name. This can even include your salary.
The Statute of limitations of a debt can mean court proceeding will be brought against you, unless you are prepared to work out your problems before the situation becomes too big to stop.
If you are wondering if a collection agency, can sue you for a debt? The answer is yes they can. Thus, it is best to speak with a credit councilor and derive a repayment plan before it comes to that.
Creditors like to see that you want to repay your debt and will sometime be willing to reduce or at times even stop and further interest working with you and your credit counselor to rectify the situation at hand.
The statute of limitations is two years now. That does not mean that you won?t be caught up in reactivating that period. So don?t shovel that debt to the bottom of the pile hoping it will disappear.
Start now and consider what your best course of action is. A budget plan is a great place to start. It will make your spending clear and show you way to cut back.
Next, talk to a professional. You are not alone and there is no embarrassment in asking for help. Take the time to discuss your situation with a credit specialist; they can help you put your best course of action in play.
So don?t spend another sleepless night wondering what to do - we can get you on the right track to debt free living.
We'll guide you through the process of the statute of limitations and how we may be able to help you pay off your debts 10-15 years sooner.

Debt Collector
Just got a call from this number. Said his client wanted him to speak with me personally about an ongoing business matter. Gave me another phone number to call back. Couldn't hear it correctly but, it was something like 1-866-468-6201.

This is apparently a collection company trying to get you to pay a debt. I get multiples calls a day from different people. I think it's the same company that has been calling me but, with different numbers. They don't leave a company name. It usually the same message left on my voicemail.

Getting calls at my work, which is a call centre, numbers are not registered.  I don't answer as they go into the cue and get a voicemail, but no message and no info has been provided. I just had a lower call level this evening and noticed this number on Missed calls - Oh well they will eventually lose the number as it bears no help to them a business line, or they will wake up and smell the "coffee" that this number is wrong!  I am glad I don't get harassing comments from them!

I've been a victim of their verbal harassment and calling relatives and friends about me and trying to scam them.  I lost my job in advertising and fell behind on some payments. They started threatening me and calling abusive names, despite me trying to be polite and come to some sort of agreement. They haven't been professional in the least and have been acting increasingly insane in their language and actions.  So I called the police about them, and gave them detailed accounts of their phone conversations, threats and criminal behavior. I received a call back two days later from the officer informing me that Collect Corp is currently under official investigation. It turns out this company's actions have become a serious matter from what he explained about the countless reports filed. That's all he would disclose, but asked that I save all the evidence and phone records. I suggest others do the same and report them to your local police department as well. Not surprisingly, Collect Corp are complete scam artists!

Got the call at 6:43 PM, Pacific time from Toronto, Ontario.  Woman asked for my neighbor, an elderly woman.  I received a call for the elderly woman two hours earlier from 877-706-1878, woman said her name was Roxanna and she could not reveal her name.  I told her that I knew she was using a reverse phone book and to never call here again and I would give my neighbor her message.  I decided not to give my neighbor the message, then I got this call.  No concidence, I am sure.  I told this caller my neighbor died and she started to quiz me about how long and I hung up.  I have heard that there are organizations in Canada that prey on the elderly.  Try to get them into investment schemes, etc.

The whole world needs to know exactly how to stop Collection Agencies (such as CollectCorp) from calling you.  It is a simple 1 page letter called:  The Do Not Call letter or you can really get them by sending a Debt Validation letter.  You put it in writing for them to stop calling you, send it Certified Mail, Return Receipt Requested.  That is it!  If they call even 1 time after they receive your letter (you now have proof that they received it by your Cert green card with their signature and date).   With 25 years of experience in the Credit Consulting industry, I have helped thousands of people get educated in credit, debt and finances.  Be proactive, learn a few simple things to help yourself or can "pay it forward" to others who are victims of debt harassment from scum collection agencies or collection attornies.  Because of the current economy being what it is, so many people have credit card debt!  GET EDUCATED - Learn more:  888-303-7722  simple solutions credit consulting or research the internet or books from any reputable book store.

Call came in at 8.43pm, didn't pick up since I don't answer calls from "UNKNOWN NAME".  No message left, I  have my call answer to set up to go to my fax machine after a certain number of rings.  That usually stops them calling.

Keep getting calls from these people asking to speak with one of my relatives.  When I say that person doesn't live here (which I think they know already) they hound me for a phone number and to take a message.  I tell them "no" I will not give them a number or take a message and that it is none of my business and not to call me again.  Works for about two weeks and then they phone again.

I cannot stand these people any more.  Calls at all hours of the day, today was at 6:30am, when 'Wendy' called and almost immediately hung up.  So I did a search on the number and I found this list!  I tried what other before me did by dialing *8 and trying different extensions..
2222 - got a person, transferred me to a 'compliance officer' voicemail
2233 - got a persons voicemail.
2246 - WOOOHOOO I might have actually lucked out, got a 'Jason Brunette' or something like that... informs me he is a VP of some kind and that he is able to look into it and make it stop.  Seemed very helpful.
Irregardless, SPAM their numbers into oblivion!! All of them!

This is, indeed, CollectCorp. They've been calling me for years, trying all kinds of stupid stuff. Initially, I spoke to them and tried to speak some common sense to them, but that didn't work.

They are contracted to collect for a lot of different companies, including several banks and credit cards, as well as student loans.

I eventually installed an Asterix server (a type of souped up phone system), gave it a list of their numbers that I had collected over time, and programmed the server to pick up the phone and play back a recording just for them (it's the same recording you get when you dial a number that is out of service, which I recorded by dialing such a number).

The calls have been tapering off. Maybe I'm on to something *grin*.
