Ignore him. He's a scammer! Don't give him the time of day!
CWG40 2014-04-22 05:08:41 Unknown
No they cannot. In some cases you can be held in contempt for failure to appear. It is quite rare in civil debt cases but it does happen. For example child support actions. If you are ordered to appear and you do not, yes, you can be held in contempt--but ONLY A JUDGE CAN ISSUE A WARRANT AND IT IS ONLY USABLE BY POLICE OR SHERIFFS, not some damn two bit--kitchen-table debt scammer. DEBT COLLECTORS DO NOT REPRESENT THE STATE.

He lied to you. He's one of the scammers.

This person is going by the name Alan Maloney. He has my husbands birth date but says he still needs his social security number to give to a lawyer to help with a lawsuit. He says he is a mediator and wants to help my husband from getting sued.

Buffalo, Bullies, Debt Collectors, Call Centers, and Networks. It is impossible when dealing with debt collector tactics to see the difference between scamming professionals and professional scammers. Buffalo, start with http://www.bbb.org/greater-maryland/business- ... son-md-90164172 then to http://www.bbb.org/upstate-new-york/business- ... ga-ny-235963171# that leads to http://www.bbb.org/upstate-new-york/business- ... lo-ny-235968792
CWG40 2014-04-16 20:29:09 Unknown
There are no warrants. Debt collectors do not represent the state and CAN NOT ISSUE WARRANTS FOR ANYONE"S ARREST!
Ignore 'em. Total scam.
Sir Bedevere 2014-04-16 20:28:11 Unknown
They'd use an Internet phone for the same reason they'd send information via email rather than hard copy: So that the police can't track them down and arrest them!
CWG40 2014-04-16 20:27:54 Unknown
No. Debt collectors can not put you in prison. An order of a judge is necessary. Period.
And you have to be given notice and a hearing must be accomplished.
Yes, you can be held in contempt in civil proceedings and yes, if you don't show up for a hearing to determine your ability to pay a judgment you can be held in contempt and a warrant can be issued. And yes, for certain civil matters like child support you can be held in contempt and arrest warrants may be issued.
But only by a judge.
In the US, Debt collectors do not represent the state and do NOT HAVE POWERS OF ARREST!
Being in debt is not a crime. We don't have debtors prisons in the US.
Period.
Resident47 2014-04-16 20:18:11 Unknown
No, a court system "can put you in prison" for failure to appear at hearings regarding *alleged unproven* debt, hearings which certain dirty collectors have gone out of their way to conceal from defendants in those "jailed for debt" stories. Debt collectors in North America have no police powers and are required *by federal law* to give people chances to dispute pre-suit and defend themselves once sued. Corporate abuse and manipulation of legal process to rig the game against consumers is what those search-hit articles are discussing, not your mythical power to take a person's freedom.
Resident47 2014-04-16 20:04:26 Unknown
We might "beware of consumer info given" by shills. Your fright story could be more plausible if you graduated to a full keyboard from a mobile device and composed in English rather than Gibberish. Actually filing suit would cost these extortionist clowns exposure and shame for their flimsy claims they could never afford.
anon 2014-04-16 19:20:03 Unknown
We don't believe lying shills who come to this site trying to scare people into paying scammers.

?Section 3-104(2)(b) of the UCC, defines a check as ?a draft drawn on a bank and payable on demand.? A postdated check, since it is not payable on demand, does not satisfy this demand. Consequently, it has generally been held by most states that the giving of a post-dated check does not constitute a present fraud nor is it within the scope of the bad check laws. ?
In a nutshell:
In order for one to be found guilty of passing a bad check, it has to be proven that the check writer intended to write a check that is not good AND the check receiver did not know that fact.
However, as a pay day loan lender, YOU KNOW the check being handed to you is technically not good, therefor a "Hot Check Law" is null in all cases of pay day loan transactions. The check is considered collateral and not a payable on demand item.

Google the word "shill". Debt is civil, not criminal - NO JAIL or arrest - in the United States. BULL on your post - the same, exact post of "Dick Swartz" a few days ago.

Ah! Here we go again. Don't you love how criminals, trying to extort money on fake loans, love to rehash that one. Of course the idea is for the criminal to take it, & twist it out of context to scare you. Debt is civil, not criminal. Thanks for coming. Hope you enjoy your parting gifts. don't let the door hit you on the butt on the way out.
