Well, it appears that I lit the fuse a little too close to the firecracker. This is how a highly educated,super successful 48 year old "stock seller" who earns over $500,000 per MONTH communicates???? By the way; it would be possible to trace the IP address of Ron and IF the last three posts were made from a terminal owned or used in the course of business by a collection agency, according to Federal Law, I would be entitled to a little compensation. I could actually collect from the agency AND from Ron--how about that boys and girls???

No Ron, I don't believe you sell stocks. You didn't mention that the number had called you in your original post, you only offered "advice" to Kate (very stupid advice). You stated, "I sell stocks and probably make more in a month than you do all year". No where in any posts were comments concerning income--However, this is a typical response from a cornered,delusional,childish moron who typically works in the collection industry. I really don't need a "preper" on collection laws-new OR old as this is what I do for a living. As a stock seller(broker????) you should probably concentrate more on that business(it sure got on some shakey ground) instead of one so far out of your league. As far as the "judgements handed down on a daily basis" AHHHH  NO I do not believe you because you are absolutely incorrect(again). A Default Judgement??? Yes there are a lot of those because you intimadate people and they are afraid. People that show up for court usually win.(and you know that)
The collection industry is in the toilet(new collection laws you understand) lots of closures,bankruptcys and other struggles.(you know this also) The thing about being arrested for a bad debt is a typical intimidation tool for SOME(not all) collection agencys. I did not "pull it out of my hat". It is actually used to intimidate people--I see it every day, on a daily basis. Ron, this is my business and I've been doing it as long as you have been alive. Don't worry, the economy will come back around and you will indeed make some money. As for me, I am very,very comfortable and very,very happy. Good luck to you.

yoyo, I am not in the collection business. I sell stocks, and probably make more in a month than you do all year. I searched this number because I kept getting calls from it. Turned out they were calling the wrong #. I was trying to provide insight to someone who seemed like they may need it. I am 48 years old and have been around the block a few times. I know the laws, you sir however seem like you are just pulling things out of your hat. Nobody said anything about being arrested for a bad debt. Please research the new collection laws and understand that with the downturn of the economy, creditors are being awarded judgements on a daily basis. Don't believe me? Do some research.

Well, this does not surprise me. I will not resort to childish insults about family members-however I will say that my mother is most definately over your head since she is in Heaven. If you want to banter back and forth about how collection people work, I'm your man. If you want to discuss Federal and State laws concerning collection practices, again I'm your man--but no insults to family members.
What I am referring to is that the collection industry is "loaded" with young impressionable ,usually poorly educated intercity gangster want to be's who think their "boss" and "company" are truely the Light and the Way. It's okay,you'll learn(hopefully).    The truth is:
You have no more authority than the kid that flips burgers at Micky D's. You can't have anybody arrested. You can't send a sherriff out to get anyone. You can't "make a decision" on anyone's behalf. You can't "download a warrant"--basically, you can't do s*** except call people on the telephone and to that I would advise anyone who is being harrassed to RECORD THE CONVERSATION. Even if you are in a two party state -do it anyway. It might not be used in court but the Judge wants to hear it !!!! I know>

Kate, if you can find out the company name and address of where the calls originate, you can send them a "cease communications letter". They don't want you to do this. That's why it is difficult to find out the name of the company(the real name).

If you don't owe a past due --don't worry. These idiots never update their call lists. I was getting a lot, and I mean a LOT of calls shortly after I got a new phone number. Calls were for Angela, Veronica, Willie and Danny. I didn't know any of them. Look at www.publicrecordsnow.com and do a phone number search on your own number and it will show you all the people who had your number before you--9 out of 10 one of them is the person they are looking for.
DO NOT CALL them back. If you do, they will call more often plus they then have a record of you calling them--thus admitting(well kinda) that you have business with them.

The process is:
They file their claim with the court. The court issues an order for you to be served papers explaining what the problem is and a date for you to appear in court. This is usually done by the county sherriff department or sometimes a special process server. If they can not find you, and after several other attempts and a long time, the judge will DISMISS the case without prejudice(meaning they can refile again at a later date) NO way a judge will issue a default judgement UNLESS it is proven that you were served notice and ignored it.DO NOT IGNORE A SUMMONS TO APPEAR IN COURT!!!!!! If a judge were ever to issue a default judgement without proof that your were served, it could easily be overturned. This is America. There are no debtor prisons. It is not against the law to owe money.

If they cannot get  a hold of you they will most likely obtain judgement. Judgements are good for 20 years in most states. This means that even if you have no assets now, chances are within 20 years you will. Depending on the balance, they can take everything you own.
