You are correct.  They can sue,  but the debt is legally uncollectable as long as the defendant shows up and disputes their claim under the states SOL law,  and the plaintiff can not validate that is otherwise legally collectable.

Kay,  I don't believe that is quite true.   A debtor can in fact sue on any debt regardless of age. Its not illegal.   And as long as the defendant shows up in court,  the claim will be dismissed.  We see these stupid suits in our local paper all the time and over half are dismissed due to SOL.

I did a little research and found that even if you were sued, all you need to do is show up in court and show how old the debt is.  If it's past the SOL, the case will be automatically dismissed.  Not only that, you can countersue the creditor under the Fair Debt Collections Practice Act because Federal courts have found that it's illegal for a creditor to sue a person over debt that has passed the SOL.

Received a VM from a blocked number telling me I was going to be served a summons at either my home (he stated my address) or my work (I don't work).  Knew it was BS because, one, I don't work, and two, he said the summons would be served to me on Thursay.  That's freaking Thanksgiving!!  

These people are idiots.  I don't have any bad or charged off debts prior to 2002.  That's 5 years past the statute of limitations.  

Do not call these people back.  Doing so can cause your dead debt issue to restart.  Look up the term "ghost debt".  After the statute of limitations has run out, you have NO legal obligation to pay the debt.

I kinda doubt you will see it back. However, I would encourage you to file reports on this. Most of these bozo's doing extortion move around a lot and are hard to pin down, some are in foreign country's then it becomes a issue of our governments having to work together to shut them down.  It does happen.. its just slow getting there..

Please do file reports with the FBI, your state attorney general and Department Of Justice,FTC & FCC..

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. Can a Collection Agent Call My Cell Phone?

Be aware....that these debt collectors are very unprofessional to say the least or the most!  I have received threatening phone calls, that I would be served papers of a lien against my property, if......................I did not respond within 24hrs to their or his.....demand, for full payment for a previous debt alleged to be owed by me.  The company is Platinum Partners and Associates, in co-partnership with:  Davis & Associates, a law firm, both in Southern California, with "faint addresses", used as deception and close to being...."fraudulent" as well.  They are supposedly....located in La Habra, and or Irvine, Calif.  Also shows that California is "poor for regulating these so called collection buzzards/agencies.

There was a vm left on my boyfriends cell phone for me.  Asking for me and leaving a message that they were going to serve me with a civil complaint at my place of business and to return the call.  I did so.  The Company was Davis & Assoc.  I spoke to a woman and I don't remember her name beacuse she really rattle me...but I did give her the case # and told her I was returning a call that I did not understand and sounded like a threat...that set her off.  She has so much information about me and she kept - insulting me with I knew I owed this debt and named off other debts I had and so on. This debt was opened 7/2003 but she indicated that I made a pmt in 11/2009...which gave them legal statue to come after me.  I was simply trying to get more information and ask her about the Settlment process..I googled information and found out these companies have software programs that track you so they know what you are doing and where you work.  I honestly don't remember the debt.  I do recall receiving a call like this several years ago and I sent in writing asking for proof and never heard from them.  I am not sure if it was the same Company or not..but they knew I was not working then and now I am...so they are harassing me,  If this was my debt...then I would accept responsibility...but she was screaming and saying you don't want to settle...see you in court you wait to see what is going to happen...I tried to call back but only to get a vm...I am unsure what to do.  I see all these posts and think this is a scam...but how does it stop?  I do not want to be embarassed at work, but on the other hand I don't want to pay something that is not mine...or to place that will keep coming after me.  She said I could only pay with a debit card..No cashier's ck or wire...it has to be from a bank acct.  Help if anyone knows what to do.  I am suppose to be served on Monday.  I am so upset.

This company is a scam they pulled our credit yesterday how they got our number and ss number we have noIideal but the lady was very rude didnt let us find out what the heck she was talking about she dont know what she was talking about. Made threats which was silly a** hell. I received a phone call from Davis & Associates this morning letting me know a complaint was on its way to be served.

I've worked in the legal field 20 years now and started laughing at the guy.

I asked him what venue the complaint was filed and if they had a ticked AZ attorney on staff or was somebody going to PHV in to proceed.

Of course he had NO idea what I was talking about.. So I further let him know I had done my research on his company and he (pardon my French) did not file a f****ng complaint and needs to get a life.

I have yet to receive a follow up phone call. :)

Bottom line is stand your ground against these lowlife scum bags with nothing more than a high school education.

I've been called numerous times by 915.209.1563 & 714.519.6153 over and over they've been calling. After calling three times at6:30am I finally answered the phone and I was told by "carlee" that she was a process server and I was being sued. Of course I was shocked and began to ask a ton of questions which "carlee" have zero answers for.She gave the name of the attorneys allegedly trying to sue me. I call the number she gave me 714.519.6153 (davis and associates) and I came in contact with the rudest bi*ch I've ever had the displeasure of speaking with. She very rudely informed me that in 2001 I opened up a credit card with Bank of America (which is false) and now I'm being sued. I explained to Mary Lou or Mary Lloyd whatever her name is that I was 16 years old and still in highschool in 2001so it would have been impossible for me to open a credit card. She proceeded to call me a lier and began to yell at me at the top of her lungs  which of course I didn't take with a gain of salt. I began to yell back at her demand proof of the "debt" I owe she denied to provide me with the information I was asking for. She proceeded to continue to call me a liar and told me to save it for the judge and hung up on me. I immediately called Bank of America whom I bank with and explained the situation to them. They informed me that they had zero records of me having any debt with them at any point and that my four current accounts are all in good standing. I also checked my credit and NOTHING came up. Moral of the story this "Mary Lloyd/Mary Lou/ Davis& associates (is) are a SCAM !!!!! They think they can strong arm you into paying a non-existing debt if they scare you enough. Please don't be a victim of davis & associates!!!

I have received about 10 calls from numerous phone numbers originating in the Los Angeles area claiming to be some legal firm, Davis and Associates.  What is all this about serving papers?  They need to stop calling all known reference numbers because they are not getting anywhere with this blind attempt to collect a debt.  What am I, like 5 years old?  So this Davis and Associates is a scam!!!!  And to think I almost paid off a debt over the phone, of which I have no knowledge of.  I think they may also have a credit report, why else would they know so much.  So sick and tired of people playing these scams, get a life!!!

Got the exact same message from the same lady even the same amount if money owed. They told us what credit card company it was so I called my credit card company and let them no. It's a scam people don't let it upset you call your credit company's and let them no and don't give them any information. They found out enough.

Got this call yesterday from 714-485-6693 and a lady telling me that I was "out for service" and gave me a file number to call back with. I called back and a VERY RUDE lady, named Mary told me she needed 460.00 to settle an old credit card debt I had with Capital One, or I was going to be served on my job with papers for breach of contract. When I told her i did not have that amount of money today and could I make payments, she started yelling at me, threatening me, and just being UGLY. I asked where "davis and associates" was located and she refused to tell me. I questioned the statute of limitations on that old debt and she hung up on me. I tried calling back several times, but it went to a funky message and then said it had been disconnected. I was a little rattled by it all until I read all the posts associated with this same phone number. I feel a little relieved that it seems to be a big scam. I'm just glad I didn't break down and pay the 460.00, which I truly didnt have and would have had to borrow. ASK QUESTIONS and she backs down.........

I don't have any outstanding debts and have great credit, but they managed to get a hold of my SS# and did a hard pull on my credit report. It showed up as Platinum Partners but they also do business as Davis & Associated.

Thankfully, I have a credit monitoring service that alerted me to this inquiry, and they are deleting it from my credit report. I always thought these services were a waste of money until now! I also called my state Attorney General's office to report them. I don't know how these companies are in any way legal.

I got a message today from a private number advising me that I would be served legal papers Tuesday at my home and that I may want to have my attorney present. He said to call the Mary Loyd firm if needed to change venue with file number. When I called the #, 714-485-6693, the message said that this phone has not been set up to accept messages. What a way to go into a long holiday weekend!

received a call on my cell "private", a male asked for me, I confirmed who I was, and asked if someone would be at my residence between 2 and 5 tomorrow who was over 18 and could sign for legal documents that were being served against me.  I responded with no, he said call this number 562-231-6922 and a case # to reschedule or provide an alternate address where I could be served.  I as always google everything and came across all these post.  I work in collections for a a major Bank, so these are not above board collections activities.  I will be reporting to the Attorneys General Office. when I called All I got was this is Mary. I wouldn't say they are a valid debt collector.
