This is ridiculous.  This is the second time i have received a call like this.  They left two back to back messages.  The first time was from another Indian accent male from phone number 951-468-0381. He said everything that the others said.  They even contacted me at my place of employment.

Phantom Debt Collectors From India Harass Americans, Demand Money

By BRIAN ROSS (@brianross) , CINDY GALLI and MATTHEW MOSK (@mattmosk)
June 7, 2012

Hundreds of thousands of cash-strapped Americans have been targeted by abusive debt collectors operating out of overseas call centers suspected of links to organized crime in India, law enforcement officials told ABC News.

The calls are part of a massive scam, one that appears to target struggling Americans -- especially those who have gone online to apply for payday loans. Armed with personal information from those pilfered applications, the threatening callers, who claim to be debt collectors poised to initiate legal action, have managed to pry loose millions of dollars from their victims -- even when the victims never owed money in the first place.

"This is what we call a phantom debt collection scam," said Jon Leibowitz, the chairman of the Federal Trade Commission. "It's a very pernicious and innovative new fraud."

Working through call centers in India, the commission estimates that the criminals have dialed at least 2.5 million calls, persuading already cash-strapped victims to send them more than $5 million. Some have reported receiving dozens of calls per hour. They are victims like Cindy Gervais, of New Orleans, who went online for a quick loan when her husband's car was hit by a driver who didn't have insurance.

Even though she paid the loan off, the so-called "phantom" debt collectors with Indian accents began calling to say she still owed money.

He more or less told me that if I didn't pay, they were going to have someone on my doorstep to arrest me," she told ABC News. "And that they were going to contact my place of business, and tell them what kind of person I am."

At first, she said she resisted. Then the calls became more frequent, and started to ring on her cell phone, and at the grocery distribution company where she had worked for 27 years.

"I was more or less was in panic mode because he told me there would be someone before noon at my place of business to arrest me and take me to jail," she said tearfully. "So I agreed to pay him."

After receiving scores of complaints, investigators with the FTC said they began tracking the calls, and following the payments. They alleged the payments led them to a California company run by an Indian-American named Kirit Patel, and that such scams would not be possible without American front men.

"I would say that all roads of this scam, or many of the roads of this scam, lead back to Mr. Patel," said the FTC's Leibowitz.

ABC News tracked Patel for weeks, from the suburbs of San Francisco to Austin, Texas.

Patel refused to talk. But his lawyer, Mark Ellis, said he believes it is far too early to pass judgment on his client. Ellis, a Sacramento-based attorney, told ABC News that Patel was hired for a nominal fee to set up an American shell company, and had no idea what the call centers in India were doing.

"I can tell you, he was as snookered by the people in India as anybody," Ellis said. "He's a 69-year-old man who is nearing his retirement who thought all he had to do was set up some corporations and everything was on the up and up. He's completely dismayed that he has become the lightning rod of this entire problem."

A close friend of Patel's also defended him in a brief interview at his home, saying Patel was not trying to defraud anyone -- he was just an unwitting, bit player in a larger scheme.

"If Mr. Patel was just a cog in the wheel he seems to have been a pretty big cog," Leibowitz said. "It is clear that Patel was integrally involved with this scam."

Leibowitz points to thousands of pages of financial and phone records gathered by the FTC and filed as part of a civil case brought against him in the U.S. District Court in Sacramento last month. When FTC lawyers sought to freeze his assets and prevent his business from continuing to operate, Patel responded by invoking his rights against self-incrimination. His lawyer told ABC News he has had to be careful in how he responds to the allegations in civil court "because there is a potential criminal action," but that Patel maintains the allegations against him are false.

Federal investigators said the phantom debt collection operation that allegedly benefitted from Patel's assistance was one of several that all trace back to the same small town in Western India called Ahmedabad. Callers use technology to make it appear that the calls originate inside the U.S. Victims provided ABC News with recordings of dozens of the calls, and many of the thickly accented callers appear to be reading off a script.

"Subpoenas have been readied, and Monday morning you're going to be picked up from your home," one caller says on a victim's voicemail. "And you have children. Don't worry about your children. We have a childcare department to take care of the children."

"You will be behind bars for six months," said another caller. "And once you go behind bars, you will lose your job. Once you are behind the bars, you won't get a single drop of water."

William Peerce Howard, a Tampa attorney who represents victims of harassment from debt collectors, said it takes an especially twisted criminal to use threats and coercion to pry money from someone who is already struggling financially

"These guys really are the most visible villains in America today," he said. "They make a living scaring people."

Mark Merola, of Florida, said he just panicked when the caller told him he might be arrested at the deli where he works in a Florida retirement community.

"I was nervous. I didn't want to embarrass myself, my family," he said. He used his debit card to pay the collector $576.

Afterwards, he says he realized "how stupid I was."

"It just happened so fast," he said. "I got scared."

Leibowitz said he hopes with more attention, future potential targets of the scam will recognize red flags before they turn over any money.

If callers say they are from the police, consumers should know that law enforcement officers do not collect debt for private parties. If the caller is speaking with a thick Indian accent, but calls themselves by a names such as Officer Mike Johnson, that should be a tip off. And if they're calling 40 times in two hours, that's another red flag. "Legitimate debt collectors, legitimate pay day lenders don't do those sorts of things," he said.

Merola said he would like to see anyone involved in the scam prosecuted aggressively.

"There's no place in society for these people," he said.

I received a call from this guy and a message from Evelyn Hernandez, I have had these people call before and try this under other names.  When I told them I had been in contact with the police and with the attorney generals office he screamed go ahead call them again and hung up.  These people are relentless.  they threaten to arrest you which is not right and now they are getting smarter and giving themselves an attorney's office name except you can hear it is a call center the minute they answer!!

I received called from this number as well as 567-248-5100, 567-248-5301 and they man said his name was Calvin Smith with a heavy accent.  He said I own $900 or I was going to court.  He also called my work, I asked him not too, and he said he wouldn't call as long as I called him back.  They will scare you.  He told me to go to my local Walmart and get a prepaid visa so i could pay him.  He said the only way this would go away is for me to pay him.  I told him to call me back tomorrow.  I was at work, that is the only reason I didnt let him have a piece of my mind.  Good luck to everyone.  We really need to stop these Indians from trying to take over.

I called the law firm that they allegedly represent and they even said that it is a scam that they have tried this once before in the past. Don't get sucked in and do not give them any information no matter how bad they threaten you. They will say they have a copy of the complaint and the summons in front of them but yet they are not able to provide any information and I say this because by profession I am a process server and I know what goes into the summons and complaints and they were not able to answer any questions. Then I asked him what how do I make my payment to you give me an address so I can send it certified mail and then they get very defensive and they tell you know it has to be wired. So do not fall for their scam. If I misspelled anything I am sorry I am using a voice recognition software on Siri on the iPhone.

I received 14 calls from this number as well as 309.222.2515.  Claimed they were a lawfirm Harper & Smith, yet there is no law firm by that name in Ohio or Illinois.  They are obviously using a spoof service to spoof the calls...anything over 3 calls in one day is legally considered harassment, but they didn't care.  If it was a law firm, they would NEVER let anyone working for them do this because complaints with their bar association could curtail their ability to practice.  Cited the FDCPA as well, and they didn't care...

Same thing happened to me, please refer the FBI website for more information about this scam and to report it to the Internet Crime Complaint Center @ http://www.fbi.gov/scams-safety/e-scams/ , this scam is posted on their site in several different variations.  I was called from the number 567-248-5042, and honestly I found it comical that they thought I would fall for their scam, since I never applied for any loans, payday or otherwise. I have a free app on my smartphone called Mr. Number that blocks unknown/anonymous/restricted callers, so I just added this number the list of blocked.

These idiots from "Harper & Smith Law Firm" called my work number to say that I am going to jail and they need to speak with my attorney about an unpaid Payday Loan which I've never applied for!  He didn't know the amount of this loan in question but, could talk with the attorney at his office to find out the settlement amount to clear the ghost delinquent account. He couldn't give me an account number for this loan, tell me what his own company website was for me to verify that his company was legitimate and he had no email account!  I'd heard about this scam before but it's never happened to me.  He tried to hang up on me and I called him back and asked that he have his lawyer call me before they go to JAIL!!!  I think I'll call him back a few more times just to blow his line up since he's so been so kind as to disrupt my day with this nonsense!!!

I even called back and asked for their business license for the state of OH... NOTHING!  I spoke to the following people:  Amy Allen, Adam Jones and Jack Shepard... All fake names from what I gather!

I am really angry... I was sitting here starting work today and decided to check my cell phone messages.  There was a message on my smartphone from a Ms. Fernandez stating in a heavy accent that I needed to give her a call back and that this was a time sensitive matter.  She then said if you don't call back I wish you luck with what will happen to you.  I called back and a Mr. Adam Jones confirmed my name...I said who are you and what is it that you all want? He said they were Harper & Smith Law Associates in Ohio and that the police were coming to my house tomorrow to pick me up...I said what for?  He said you have a court date on Thursday.  I said if I had a court date on Thursday why in the world would I have not receive proper mailing for this to alert me of that date?  He said the police are coming to get you tomorrow to lock you up until your court date and when you are found guilty you will have to pay 8,000.00.  He then said I'm going to read you the affidavit and the only thing I ask is that you be quiet until I'm finished.  I said well, let me stop you before you get started..."I said who is your client that you are representing?"  He said American Pay Day Loan.  I said sir I've never applied for a pay day loan in my life.  I said where is the paper work?  He said we just need to confirm your suite number...he then said you need to get an attorney.  I hung up.  As intelligent as I am it still scared the crap out of me.  I think we all need to join forces and get one number to the police or FBI and report this.  From what I've read from all of you we each have telephone numbers and names.  I'm very angry right now.  The number they called me from was 567.248.5100.  Ms. Fernandez called my mother's phone for me as well.  Lets get together and do something about this evil!

I have received a number of calls from this # and they had the nerve to threaten me that I was being sued for a loan I never received from American Pay Day Loans. They in fact said I would be physically taken from my home and dragged to the courthouse where I would be tried.I am trying to push for Law Enforcement to get to the bottom of this and if all possible jail all that are involved.I suggest everyone else that receives calls from this # to do the same.I really think the FBI should get involved because this falls under the federal comm. law.

I just received a call (or should I say 4 calls) in a row until I finally answered it. Before she (also foreign accent) even began to speak I actually screamed (because prior to the last call, she left me a message, the same "rehearsed" message that I received a couple of months ago, and I knew what she was about to say) If you ever call me again, I will call the police, your scam is all over the internet.. Do you understand?  Then silence, I guess she got the message. This call came out of Attica, Ohio  Is this where the famous prison is located? I heard that the inmates there have jobs as telemarketers.  Something to think about!!!!!
