Debt Collector
Started to receive calls from Angela Simms (Sims) from Check Systems phone number (585) 351-6120 stating that her office had been retained and she had two pending complaints against my name and social security and that due to the statue that she only had a few days for me to claim my right to settle the issue outside of my local jurisdiction. First of all she called in my maiden name of which has not been my name for a VERY long time. So first clue that this was a SCAM!!! Not only that she had been calling and harrassing family members making them think I'm in legal trouble. Received another phone call the following day stating that pending complaint and fraud investigation and once again due to the statue she only had a few days to resolve the issue. Trying to make me think someone has frauded my name and SSN and I needed to contact her immediately if I wanted to take legal action in regard to the fraud. Contacted a collections lawyer to find out what legal advice they could provide me about this woman and her false allegations and her consistent harrasement to family members. Was told by the lawyer, it was a scam, especially since she's using my maiden name and trying to collect on a debt outside of the statue of limitations. Also, that she wasn't handling herself in the appropriate manner under the law, especially with threatening family members and disclosing private debt collection information to anyone else other than myself. Lawyer advised I could file lawsuit against her and her company and that I could receive damages at a minimum of $1,000 if not more. In the state in which I live, the statue of limitations is four years from the last date that you made a payment on the account, considering the fact I've been married way more then four years she's definitley outside of the statue of limitations to even try to take legal action against me. And she's been threatening my family members for over a month now saying she's going to show up at their doors with citations, etc. Received another call from her again, stating that I defrauded a banking institution and I had a certain number of days to call her back and she had an affidavit in my name and that it will be filed in my local jurisdiction in a few days. Had my lawyer call her phone number (585) 351-6120. What a surprise she didn't answer her phone, nor has she called the attorney;s back. Next step is to file a formal complaint with the New York Attorney General's office. The New York Attorney Generals Office has already made this company pay $175,000 settlement for their illegal debt collection practices and defrauding and threatening consumers. See this website:
http://www.insidearm.com/daily/collection-law ... another-175000/
So if you are being harrassed by this company you need to file a formal complaint with the New York Attorney Generals office, or seek a lawyer like I did who will be more than happy to sue them for their illegal debt collection practices.

Yes!  See Marietta's post, above.  She called the REAL ChexSystems and they confirmed it was a fraudulent call.  See also, this post from an Internet blogger who received the same call -

UPDATE:  Check-Systems is the company associated with this telephone number, NOT ChexSystems - a different company that is the one I actually contacted. Pretty slippery.

Called ChexSystems' customer service # at 800-513-7125 after receiving a vm supposedly from ChexSystems - the caller said they were Angela Simms. The phone # to call back was the above # - 585-351-6120. Not a threatening or abusive call, clear English, almost fell for it until I contacted ChexSystems' customer service # above. It's a scam. ChexSystems said there's no such phone # or person in their company and that many consumers are getting these calls and not to give them any info and report it to the FTC and Attorney General's office.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
