They can call my answering machine & hang up all they want, it doesn't change my finances.

Besides the ringer & volume are always off on the machine (real calls go to my cell), so they are just wasting their own time.

I admit though that sometimes I call THEM on their toll-free number and hang up.  Over & over & over again.

They must consider that acceptable behavior since they are doing the very same thing to me & many others, right?

I get calls from this number all the time and I always ignore and the voicemail they leave is 5-7seconds long and I can hear keyboard clicking in the background but noones ever said a word

I got many calls lately and just ignored it and no msgs were left. Ive been getting lots of calls from scammers. My call blocking is a bother and has a limit so i go to the setup online only occasionalky. Anyway, i answered and just asked company name, supervisor name, call back number and on that the american womam stopped answering my questions. I never confirmed who i was firstly and importantly, did find them to be a creditor, no i dont owe any money, and yelled if she wasnt goung to answer all my questions i waasnt going to answer any of her questions and told her to stop calling.

Now i will go block them along with the new one whos company detects that i have computer probs. Seriously, dont talk to anyone.

Read this and you will see why these collection agencies have no incentive to "work" with anyone who is in debt with student loans. I just thank my lucky stars every day that I was able to get my home refinanced and pay off my student loan a quarter of a century ago:

This number has started calling my work phone 3x daily.  I'm not picking it up, because I know that I'll get angry and cuss them out, and that would be embarrassing in the office.  I guess I can just cuss them out on my cell phone later, except that they only call while I'm at work.  YES, I have student loan debt.  YES, it's in default.  NO, your harassment will not increase my income (especially harassing me while I'm doing my job).  NO, I cannot pay you a lump sum right now of thousands of dollars to "settle my account."
I feel that there is absolutely no point in talking to these a-holes, because you simply cannot get anywhere.  If I tell them "I can afford 50 bucks a month right now and that's it," they basically laugh and say "Well that's not enough."  Okay, well, you're getting 50 bucks or you're getting zero, which do you want?   I just feel bad for people who are too nice or naïve or whatever and fall for answering the phone and being treated like s***.  Don't let them make you feel bad!!!!

They first contacted me a few months earlier, and left a message for someone I don't know on my mobile #, and identified themselves as a debt collector. I figured that they must have realized they had the wrong number, as in my voicemail I state my name, and they are looking for a male (I am female). However, I've received another call from the number, this time no voicemessage was left.

I do not have any outstanding debts and I pay everything ahead of time. Maybe I'll answer next time to make them stop calling.

I recently entered into a payment plan for my student loans, which removed them from default status. I have been getting calls from conserve 5+ times a day. They say my loans are in default and require immediate payment, when I told the man that I recently took care of it he laughed and told me that I had not or he would have that info on file. I can't stand scammers, he thought that just because he knew my maiden name, birth year and schools attended, I would believe he was legit.... ANYONE can access that info! I informed him that I knew he was a con artist and that I was reporting it, he told me I was making a "grave" mistake and that they could garnish my wages and/or take my professional license.... "So you're going to take away my diaper changing license??" he didn't like that lol

these yoyos keep calling me after i asked to stop - we are ill here - just had bypass surgery and stroke - do not need any stress - STOP CALLING - you have been reported numerous times - get your act together - constant harassment at any level is wrong!!! - we are also on do not call list but i guess you are exempt from that - 4-6 calls a day is ridiculous! - and as early as 730 am - get a life!

Answering that question is like trying to diagnose a stalled vehicle by telegram, but the question is too good to pass up. The FDCPA allows a debt collection agency (DCA) to call any place it likes to obtain "location information" on an alleged debtor. This provision is commonly abused in various ways to create needless anxiety and coerce payment of unverified debt.

The message described did not volunteer a business name and did not discuss a person's debt. In that sense, the DCA rep was being compliant by not breaching your privacy. If challenged in court, ConServe would likely argue that very point.

FDCPA § 1692b says the DCA rep making a skip trace call "shall", not "may" and not "should", "identify himself", meaning by personal name or alias, and then make it known that a certain person's "location information" is sought. The ConServe rep said neither of those things, and apparently opened the message as though you were listening while screening calls ... a stretch of imagination for starters. Right there are two violations.

While nobody said "Missy owes us money", the DCA was not calling relatives to discuss baseball scores. Cracking wise about the nature of a person's home conjures an image of some stalker calling from a parked car outside, like something from a cheap Lifetime movie script. It also could suggest that the assets of a person are being examined and under possible threat of seizure. (Also implicit is an arrogant opinion that you have money for nice possessions but not for your unpaid bills.) 1692d prohibits oppression and abuse of any person, which would include your relatives. A 1692e "misleading representation" claim might also apply.

It's not clear that the DCA knew the in-laws were called instead of you, and the message is just ambiguous enough that the average risk-averse consumer lawyer would shy from resting a whole FDCPA suit on the one call. What I would do is find more violations in other calls and letters from ConServe, just to make it clear to bank-friendly judges that the bad behavior was not unintentional.

This people are harassing me every morning with a phone call before I even wake up!  Even if it is a student loans collections agency, I don't have any student loans, and the last time they left a VM it was for some other guy.

They contacted my in laws home phone with this messege for me..."xxxxxxx? Hello? Your home must be bigger on the inside than it looks on the outside. Cozy,cozy,cozy" they did not state who they were or the purpose of the call. That messege is in violation of the Fair Debt Collection Practices Act correct?
