Not so.  If they get a court order they CAN GARNISH you. Unless your only income is SSDI or SS Retirement.  If you work for the Post Office there are some challenges, if you are Military some challenges as well.  Just negotiate with them a fair pay off and do what you intended to do when you established the debt.  You didn't go into the credit agreement thinking you were going to cheat anyone did you? Of course not, that would be FRAUD.  So do the right thing, answer their calls and let them know your circumstance.  If

I got a call from this number and claimed it was Chris.  I asked who they are and they refused to disclose their information.  I found out that they have a bunches of offices and lowlife unprofessional work there.  BAR should ban them and put them out of office.  They are bad people.  They are SCUMBAG because the way they call sound like from black market.  Do not answer their call if you dont know the number nor try to find out who.

Yeah, I've been fending off calls from this jerk and his joke of a "law firm" for the last couple of months. Look, I lost my job, got way behind on my bills and am now just trying to make it paycheck to paycheck - sorry if your "law firm" doesn't come before paying my mortgage or putting food on the table. They called wanting to make a "settlement", which was like a 5% reduction. When advised we couldn't pay that, but would be willing to work out another plan - we were told "Nope, he won't accept that. If you can't pay the entire sum we are just going to have to recommend legal action against you". So now they call me at least twice a day - from different numbers too, in different states! And for all you idiots standing up for these people - I don't even know what to say except karma's a BI***! I'm so tired of dealing with these people. I don't leech off the government, I do my best to pay what I can towards my debt, I work full time and go to school full time, what more can I do? ANYONE WHO THESE JERKS THREATEN - DO YOUR RESEARCH, FIND OUT WHAT YOUR RIGHTS ARE AND FIGHT BACK!

What a totally unprofessional message from a bottom feeder of the legal profession. Yes, people are liable for the payment of their debts and collection attorneys are an accepted part of the system. However, lawyers are held to higher standards of conduct than the general public and such a insulting message from a member of the Bar and an officer of the court reflects poorly on the entire legal profession. There are rules of profesional ethics in every state that govern attorney conduct, which includes communications. Anybody interested enough in this clown should just report his message to the AZ Bar Disciplinary Board or it's equivalent. It will not be ignored and the hostile, immature Mr. Pezzuto might even get sanctioned over it.

I bet this guy relies almost exclusively on obtaining default judgments (when people do not answer the complaint or appear to defend themselves) just to keep the office open and meet payroll for the entourage of people who are so desparate or pitiful that they need to work at such a firm.  Even if you owe the money, there are various ways to defend the suit based upon rules of due process, evidence and procedure, which these mass collection firms almost invariably violate.

It's true that a debt collection agency cannot garnish your wages. Ultimately, all a collection agency can do is turn your account over to a law firm or attorney to file a lawsuit to collect the debt. If the creditor wins the lawsuit they will get a judgment for a specific amount. Once that judgment is filed of record, then the judgment holder can execute on it to have it satisfied out of the seizure and sale of your property or the garnishment of your wages. Most jurisdictions (states) do permit garnishment of wages, usually within statutorily defined limits, in order to satisfy (pay-off) a judgment that has been obtained against you.

I have been getting calls from this number for someone I do not know. I know it was def a collection agency. Now I pay all my bills so I know they are not calling for me. After reading all these comments I bet most of you are getting calls for yourself.... And coming to complain about a company just trying to do their job? Why? Just get off the Internet and call and work something out. No wonder the economy is in a crises... People borrowing money they do not have and refuse to pay it back smh. FYI if your getting a call and do not owe money then do what I did. I called and told them they had the wrong number and they have not called back since.

I just went around with this a***ole.  violated the law big time.  Am sending the following response back to him:

Dear Mr. Pezzuto,

I do not have the money your representative  pressured me into agreeing to.  Additionally, your representative, broke the law. TITLE VIII - DEBT COLLECTION PRACTICES  [Fair Debt Collection Practices Act] was violated multiple times.

Therefore, be advised that the debt is cancelled based upon  to the following provision of the above law.

(b) Any person who violates this section shall be liable to the same extent and in the same manner as a debt collector is liable
under section 813 for failure to comply with a provision of this title.

Research of your organization shows that this to be a habitual practice of Joe Prozzuto.  Your organization has a C BBB rating.  There are numerous filed reports of The Law Offices of Joe Prozzuto breaking this law, violating the rights of numerous other creditors.

Do not call me again. DO NOT ACCESS MY CREDIT REPORTS AGAIN. Should you persist in contacting me, contact my attorney:

HOW DO WE GET A CLASS ACTION SUIT GOING IMMEDIATELY.  Together we can nail this creep.  Morally and ethically, we must to prevent him from harming others.

This is not a discussion as to whether or not we should "Pay our bills".

This is about our consumer protection rights when it comes to the collection of debts.

The way to halt a lawbreaking debt collector is to learn and enforce your rights, and not to throw all your trust at a legal paper mill like Krohn & Moss, which owns the "WeStopDebtCollectors" domain among others. K&M feels that spamming discussion sites like this is a fine way to attract new business. They have promoted the use of poorly composed dispute letters which are likely to get people sued for debt faster. Their soundalike civil complaints are sloppy, riddled with errors, and tend to be cut from the same pattern.

Free consultation and taking "your case for free" is nothing special. The FDCPA provides legal fee shifting to the losers. K&M primarily wants an easy case it can work from a desk instead of the courtroom, and then feed on settlement payouts split heavily in their favor. Most of the problems people have with collection agencies don't need a lawyer to solve anyway, hence my initial statement about becoming educated. Below is a link to FTC resources to get you all started.

Most of the people at this agency are arrogant f$#^%'s.  I have spoken to one person that didn't treat me like I was the worst person in the world and the debt isn't even mine, I'm just working with them to get it paid.  They are bullies, but face to face they wouldn't talk to you that way or it would get ugly.  There's phone lines between me and them that why they get away with it.  You may run a good company, but they certainly do not.

You "successfully came to an agreement" with a debt collector which violated your MIL's rights straight from its first phone call? You don't see anything wrong with this picture? If that was my family member, the only "arrangement" I would make is the setting of a court date.

Your MIL comfortably has the rest of the year to file FDCPA claims. You might want to follow the link I provided a mere three comments behind yours.

I tried to make an arrangement for my mother in law, she is seriously delinquent on a credit card.  He first contact was from a mr lopez who she claimed was very rude and called her names.
So volenteered to try to intervene.
I sucessfully came to an agreement for approximatly 50% down then a monthly payment.  I asked what th e interest rate would be, I was told 0%.  Great I said, please send me that agreement in writting so we can proceed.  NO WAY, they refused to put anything in writing.  Why would anyone refuse to put an agreement in writting? After all, all they were going to get was access to her bank account.

How many people here would offer their banking info on someones word?
