I hope this info helps people to clear some questions. The majority of information on the web ( google, bing ) about car repo is been placed by repo companies.
Can a loan company report a vehicle stolen that is in repossession?
Answer
NO ABSOLUTELY NOT! This is a CIVIL issue not a CRIMINAL issue! The car company can repo it or get a court order to have the sherrif come repo it that is all.
My finance company called me when I first defaulted and said they were going to report the car stolen. I recorded it and had them charged with Breach of Peace.
Repo people are scum and will say anything to get information out of you. Don't talk to them, don't trust them, and be smart. Never for a second assume that they are stupid.
They know how to do their jobs for the most part.
With any situation, know what you CAN and CAN'T do and know what THEY CAN and CAN'T do.
If you arm yourself with information you stop a sleazy repo man dead in his tracks who is trying to tell you that your going to jail for GTA.
If the courts have determined that the vehicle is to be repossessed and the FORMER owner keeps the vehicle away from the agent of the lending institution, yes, it is a form of theft and the lender is certainly within their right to claim that their vehicle is stolen. Once the repo papers have been signed by the judge, you no longer have claim to the vehicle.

The lender can request an court order under the misappropriation of property or whichever state statute applies.
A lender cannot file a stolen vehicle (grand theft auto charge) report in the traditional sense.

it sounds like the only things you guys have in common is that you refuse to pay your bills and/or refuse to return the BANKS property. If someone says "officer" or "sargeant" and you misconstrue it as police then you are assuming the wrong identity. private investigators may use these terms and titles in their line of work and they are capable of investigating crimes against their clients.

Got a call on Friday from the same Guy and he try to tell me the same things and he also sent a letter to my sister house she called him and he told her he was trying to invetagate me and she ask for what and he hung up on her. I told her to save the letter I think we all should come together and sue him for harrasment

Received a very similar threatening phone call. Saved the voice mail where he stated his name was Detective Ryan, and filed a police report with my local station. They were very interested to hear what was being said. Save and record all correspondence with this man. He is in direct violation of the Fair Debt Collections Privacy Act, in addition to impersonating a police officer.

We had a repo guy show up at our house. My fiancé told him he would be back in 25 min with the car, although he never came back until later that evening. The next morning I got a voicemail from "detective" jones saying that my fiancé had tried to run the repo man over with the car and that they would be pressing charges. I advised the man that I had witnessed the confrontation between the repo guy and my fiancé and all they did was exchange a few words and that neither of them even got out of their vehicles. When I spoke with the man in "investigations", I told him what happened and he told me to go get a lawyer and said he had a signed statement from my neighbor which I know was not true. These guys will do and say whatever they can to scare you, but all in all you have a lot more rights than you think. Don't let this "detective jones" scare you, he is nothing more than the owner of the repo/tow agency, and isn't affiliated with the police.

Called identifying himself as an "officer" saying i needed to call back immediately, called back and answered saying "investigations" and immediately started with his whole reporting the car stolen and I was going to go to prison for atleast 5 years because i was in possession of bank property bullcrap. I asked him to ID himself with his name and badge number which he refused. I hung up and called the police and asked them if this is even legal which they said no, they dont get involved in civil matters and it is illegal what they are doing. I called back and told him what a fake he was and how what he does is illegal and that i filed a harrassment complaint against him, all he could say is "I hope you think I cant do it, I put people in jail. Feel free to look at ARS line yadda yadda" and hung up, I called back several times to which I got no answer.
