this number keeps calling me and when I call back the number is not in service.

Sweep-eze chimney service. I have told them repeatedly I don't have a chimney. Agent with thick Boston accent started yelling at me!
When you try to call the number it is not in service.
I am on the do not call list.

calls me late at night and no one there when I answer

They call me every six months or so.... incuding today.  I'm on the do not call list and have told them every time that we don;t have a chimney AND take us off their call list.
