I just got a new number less than a week ago - whoever had my number must not have paid their bills - this number as well as others are calling non-stop.
Whats frustrating is I use the landline for a fax machine - yet they still keep calling it

Neither phone, fax or email is legal. They have to send it via the US mail per the FDCPA law (see my post above for the laws)

This number kept calling so i finally called it back they said i owe a bill that may be but i have to request the bill by email than they will email me back. seems weird so i will not unless they send me bill. is that right you think.

Most of these calls are illegal operations, they accuse and abuse, but are in truth all bark and no bite! Extortion scams are plentiful!

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

Just spoke with a real a$$hole who was rude, told him i would not deal with him b/c he was rude and he said "no you will deal with me"....he asked if I wanted to have the chance to repay some debt, i told him of course but not dealing with him and he said "well you just lost your chance"!!!!  I laughed at him on the phone and hung up.  What idiots...what are they gonna do, sue me?  go ahead, i will still be broke and unable to pay anything so waste your time buddy, feel free

THIS NUMBER IS NOW CALLING ME AND HAS BEEN CALLING - RECEIVED A CALL FROM A RACHEL WILSON.WANTED ME TO PROVIDE MY SOCIAL SECURITY AND DATE OF BIRTH SO THAT SHE COULD DISCUSS A DEBT THAT SHE SAYS I OWED. They called today looking for co-worker.  This NCA guy in now MATT.  I asked if it was personal, he said yes.  i asked if was a debt collection call. He said yes. Cha Ching!!!  The FDCPA clearly states that in the state of California you may not collect or attempt to collect on a debt older than 4 yrs old, some states longer, some shorter.  This must have been real old since she bought a home and a car.
Also, the FDCPA, covered under the FTC, a collector can NOT tell anyone other than the person they are calling, a spouse or their attorney what it is about.  He screwed himself. Cause he told me. I collected along time for AT&T and BellSouth. Also, if you do owe, it can stay up to 10 yrs on your credit but is uncollectable after 4.  These guys buy old deb, especially from Capital One, for $.25 each so if someone send s any $$ they win.
As for threatening.  I would just change my tone, pretend to be concerned, acted like your are goingto pay to get his name, streeet address, phone, tell them you want to overnight it FedEx or UPS and turn around and cll the FTC in your state.  
And if they threaten to sue, they better hve the papers ready because you can not threaten to sue if you have no intention of it

I received a call from a number displaying 000000000 and would show a facbook contact on my caller id.  I answered and no response it happened a few more times I answered and then stayed on the line for several seconds then a lady came on the line I asked who is this and why are you hacking my phone! she claimed they do not do that and they only call directly (don't know where I got that outlandish story or why) she then said they were calling on behalf of a loan I said wrong number not kowing if it was a scam then hung up.  Next week they withdrew 125 out of my bank account UNAUTHORIZED! I immediately called an attorney and then the next week they tried it again I didn't fight the firt transaction because the collection agency I'm working with on the debt said I could apply it to them they alo said that they don't even show these scumbags as listed to even collect the debt! I recorded this call then called the original creditor and asked if they gave them my account numbers they said under no circumstances would they do that and I recorded this call too I then filed a complaint with ag of Kansas and the FTC if you get calls from them document everything in fact don't even talk to them they are scum!  The law office I assigned said they have sued them several times. I am not saying not to pay your debts but heres the thing creditors have the legal right to sell your debt to tons of third party collectors however just imagine if they all had your bank account numbers and they all started crawling into your account taking your money!

Scammers. Do not verify information, do not give in to them on any of their threats. Do not give them any money. they run multiple scams including

Claiming to be law firms
Claiming to be debt collectors
Claiming to be a loan lender
Claiming you are receiving a grant
Claiming they are Tech support and you have viruses on your computer
Claiming you are being sued for fraudulent activities and that they are government officials or police.

This numer 620-665-7178 called me today at my work. And it isnt the first time either. First 3 times i told them , "this is a place of business and the matter cannot be delt with at the moment". They hung up on me. The other 2 times they called i stated the same thing. The guy on the other end started yelling at me. I was busy with a line, as i work at a gas station. So i just hung up again.
Today they call the guy speaks to my boss, she told him it was a place of business and he yelled at her. He stated, "if she didnt pass the phone so he can speak to me was going to press chages and file a lawsuit on her and the business." So she gave me the phone. I repeated myself once more about the place of business and to stop calling. He said, " well if you would answer your cell phone and and stop the messages of our number being blocked we would stop calling your work." I repeated myself once more and to stop calling. He insisted that i call at 6 pm my time or the case with be sent to a lawyers offices. I told him i would her at work and no way for me to call. He states, " cant you take a break and resolve this."
So i took his number down and all of course a 1-800 number such as 1-800-542-1084 ext: 1127. Then i looked at the number 620-665-7178 on the id and it states internatinal homes. Then i google the number and found here. These ppl do just about anything to get what they want. The also call from 620-665 0850.

Don't identify who's calling and took funds out of my bank account without my authorization. Reported to bank for fraud and bank deposited funds back into my account. I have never had any contact with this number.

The problem with these people is you can report them all you want and nothing gets done. They know this so just keep calling. Unfortunatly not everyone knows there rights so they cave and give these people money in the hopes they will go away. Its sad but true. Your best bet is to just not answer the phone.

I got hosed... I got a hand-me-down cell phone at my job, and the guy who used it before had it as a personal phone.  For almost a year now I have received debt collector calls. I beg, plead, and lie to get them to stop, but they just keep coming.  Has anyone SUCCESSFULLY stopped these calls?

I got a call from a woman who said her name was Theresia Bauer. she was trying to collect an outragous debt that was hundreds of dollars more than I owed. She Threatened me, and my husband. I told her to never call me or my husband again, and she said she was going to continue to call. she said that if I dont want her to call anymore, then she was just going to report to my credit. she was very rude and used fowl, innapropriate language, I recorded the conversation, and am intendng on taking further legal action.

If the calls do not stop, I have found that threatening with Bud Hibbs is a good practice, and by the way the website is www.budhibbs.com not what was postede earlier. Also let them know you will contact the police, FTC, and your local branch. If the calls do not stop, you need to follow through! Begin by contacting your local police department. If that does not work, then proceed with the next step. Also, from what I have read, it is very illegal for them to NOT disclose who they are.
