They call me once a day for the last month. They don't leave a regular message, but I would get voice messages because they forgot to hang up the phone. Whatever company that is calling, sounds really ghetto and unprofessional. I heard swearing in the background and just ghetto-ness. I wish they would leave a regular message so I can know why they are constantly calling!!

A guy called from 614-569-4620 mumbling really quickly & immediately wanted me to confirm the last 4 digits of my ss #. Of course I told him that's not something I'm going to just give you on the phone & asked him to restate the name of the business & the purpose of his call. He proceeded to mumble FMS again & said they had something that would help me, but he couldn't tell me with what until I confirmed the last 4 of my ss# which he read off to me. I told him no thank you & hung up. I don't trust this at all.

These people called my office and told me and gave me our HP Managers name and said that she had ask them to call me. They ask if I was (my first & last name) I said yes, then ask if the last 4 numbers of my SS# was ****, when I said no, they ask a few more questions when I ask who this was and what company it is they would not tell me. When I called the number back this guy Josh answered the phone and said that this company "SMS" has never called my number.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Wife answered phone. While handing the phone to me I heard a distinctively "Black Brother"  talking in the background with his best ebonic ghetto lingo about some incoherent blah blah while I was listening in until he was started to yell my name into the phone. I replied in my best ebonic plantation accent " yo n****h you got da wrooong numba" Then I hung up.  Lol probably an employee at ACORN.

Contact the actual loan holder and find out! If someone else calls you it may be bogus and you don't want to be paying someone who is pocketing it instead of it going to the actual student loan. Be safe, not sorry!

This phone number repeatedly called my mother to "discuss my past education".  They called at all hours of the night and threatened her that she will potentially lose her assets if I don't contact them immediately and she was very frightened.  It was after 9pm, I called back and learned that they were attempting to get payment from me, and the matter had absolutely nothing to do with my mother.  They kept saying, "They want to help me" and "They can't help me if I have an attitude."  I did not have an attitude, I just asked them to identify their company affiliation and told them that it was after 9pm EST and that it was an inconvenient time.  They passed me on to a Supervisor who told me that I called them.  I asked them to please stop calling my mother and confirmed my contact information.  I am blessed to now be working and able to pay my debts, and am handling my business matters directly with the lender-- but had a bit of a problem after college and these collection agencies are Fiends.  I believe that companies who prey on vulnerable people and who threaten senior citizens are unreputable and people should exercise their rights to stop the harassment.

This is probably not your debt if you have never had a student loan. It is probably a family memebers loan that put you down as a contact number. These are legitimate call and should be responded to. Since the government has purchased all student loans, except private loans obtained through a traditional bank, you will recieve calls from collection agencies when you dont repay that debt. PAY your student loans and the calls will stop, if it is not your loan then inform them that it is not your debt/loan and that you would no longer want calls from them. If they continue to call tell them you are contacting the FCC, trust me the calls will stop then. Finally, again I want to reiterate how important it is to clear up your debt. Even if you didnt finish college or get a job using you degree, it is vwery important to repay. Otherwise, the government/collection agency does have the right to garnish you wages, and gladly will because they own your debt and it belongs to the federal government. Additionally, your fellow Americans are saddled with your debt and that is the majority of our economic problems is people borrowing with no ability/intention to repay that debt. Come on people is it worth it for you to show people how much your college education "paid-off" when you don't repay your debt, really wise decision, SMH.

stop harrasing people. you are the loser that cant do things leaglly. try being polite to the people you call, as 90% are not even the people who owe a debt. Have a real number to call back, not one that says it is disconnected. Know that you are not getting squat from anyone that reads this message board. Know that we all know our rights. Know that the FTC will allow us to file a lawsuit and gang up on you and get us all your money. And know that even if we sue you and each only get 1% of your companies net worth, that when 100 of us file a suit against you that equals 100% of your companies net worht being paid out. Can your company afford to have nothing to pay you with.

We all know that the loans owed are 5 to 20 years old, the government is not going to garnish anything for them, you bought a worthless debt that will never be repaid no matter how loud you yell at us or how many threats you make, that we will and do record your calls and will be more than happy to take the recordings in front of a judge, that by continuing to harras us in any way (phone or even on this website) that you are in violation of Federal Law (you seem to say we will have th long arm of the government crashing down on us, it is you that will have it slapping you in the face)

So wake up and review your practices, lest we all stand up and say enough is enough and sue the pants off you.

I really dont think a judge will side with you no matter what you say, after he gets a glimps of what you have said to people on here.

it is not the government, it is a private company. the government student loan people do not act in the manner of these people. the government is done with your loan or these people would not be calling. it is not the irs or a traffic fine, it is basicly nobody, just people that cant get legit work and figure they can make a buck by being rude and demanding. do let them bully you.

same # called me at work. i didt talk to them, they were rude to my co-worker. they called my friends house that i used to live at and were rude to her. she got the # from her caller id  1-630-613-1151 I just called it back to find out what they want. got a messag that said "this number is disconnected or no longer in service.

So if they cant even use a real number to call from, dont ever give them any info. and no the "long arm of the government" is not going to cash down on anyone for not paying a studen loan, in fact the worst that happens is 1. you cant get a federal job, 2. you have a non paid debt on your credit report. 3. you get some bozo calling you every few years to try and get money.

If a debt is over 3 yrs old with nonpayment, the student loan company writes it off as a dead debt, they basicly throw it out, and some dillwad buys the bebt and trys to get you to pay it to them.

If you do have an old student loan and you got a job in the field you went to school for then you should call the actual student loan company and make arrangements to pay. if you went to a schiesty school that promised you the world and you have no chance to get a job in the field of your training, then call the actual student loan company and make arrangements to get it deffered or sometimes they even will send you paperwork to get it removed.

and never, never, never give anyone that says they are a bill collector your social security number. If they have it already they can make you pay by garnishment. If they dont have it they can do nothing to you. Legit companies will ask you for the last 4 of your social, and that is all, because they already have it.
