Hippa has nothing to do with your not Identifying yourself. In fact the FDCPA say's you have to identify yourself.

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

Actually, when you sign those initial documents in the hospital or doctors. You are giving them the right to come after you for any outstanding balance. You also give them the right to release your info to a collections agency. Secondly HIPPA does not dictate FDCPA laws, only privacy laws. That is why we cannot say who we are or what we are calling about until we know we are speaking with the correct person. Same goes for voice mails. Until we have permission to leave one, we cannot. Secondly, FDCPA laws allow us to call you twice a week, once  a day unless we get busy signal or permission to do other wise. If we call you more than once a day, that's because we had something important enough to take the risk, such as Your insurance ID is incorrect and the F/L is tomorrow. This is seriously the s*** we deal with. We work closely with our client and again, you should answer the call and find out what the bill is about. If it is invalid we will do everything in our power to resolve the account, and sometimes we need you assistance. We have s*** clients and you know what happens when we find a client who trying to pull illegal b***s***. We drop them. I myself have personally found illegal actions taken by the client and put a stop to it. People hear collections and they flip out. We aren't other collections agencies we take pride in up holding standards and laws. Everyone is not always nice, but everyone is not always a dick. I personally don't collect that way and most of my intake comes from billing people insurance, yes we also do that and a hell of a lot of it. There are a lot of mis conceptions on how medical insurance, doctors and hospitals work. We speak with insurance companies to resolve issues, we discover issues and let people know how to fix it. We instruct people how to do financial aid. You'd be shocked at how many attorneys I've had to call out for f****ng up someone no fault or workers comp. You'd be surprised at how many Attorneys don't actually know HIPPA or FDCPA laws. I have to fight people just to get an insurance I so I can bill it out and not have to deal with them. Also people who have insurance through there employer. YOUR EMPLOYER CAN CHANGE YOU POLICY WITH OUT CHANGING THE INSURANCE. It happens all the time and i don;t need to be cursed out because you weren't aware you now have a deductible, and no its not the job of the doctors office to tell you that, they don't know that. and yes they will let you see the doctor without paying your co-pay. KEEP YOU RECEIPTS, PLEASE! Open any mail form your insurance PLEASE! If they send you a check, its not for you, its for the damn doctor, don't spend it. All in all were not a***oles, take the call. Figure it out, it you owe it we will work with you, if not we will work to resolve it. If you don't give a f***, tell us not to call and we will stop, but if it credit reports don't call us two years later ready to curse us out. People act like were all bad but some people are real nasty, disgusting, f****ng, scumbag, a***oles. I have bill too, I struggle, I pay what I can and the ones I can't, I avoid too. But some of the things that have been said to me just for saying hi...we have bills to pay too. Its a two way street.

So, by the word HIPPY you mean HIPAA... if a patient doesn't give the provider the right to call them why would you have the right to harass people?  This is a law for a reason!

For you info, we can validate all of our debts of our debts. Ny state law only require an invoice we can in most cases provide an actual bill. If you can dispute the validity of the debt do that but avoiding it can case it to be put in on your credit. Also hippy prevent us from stating what call is about, this includes companies exact bname. Now we can only leave message if given permission. If you don't owe anything why avoid it?

Debt collectors do purchase old debt for pennies on the dollar. DO NOT take the call! Every state has statue of limitations on debt, know yours. If you take the call you (in most states) start the clock all over again. If they leave a message write down the number and look it up on your computer "Google it"

Remedy:
Be smart - Contact each of the three credit score agencies by letter and challenge any debt put on your account. 99% of the time debt collectors are unable to validate debts they purchase. By law debt collectors have 30 days to validate any debt. If they can't validate the debt you have the right to have debt collectors removed from your credit score immediately after the 30 days are up.

Received a call from this number today, 1-24-2012. They did not leave a message. We have absolutely no debt so it's either a mistake or a problem with identity theft. Caller ID showed "INTERNATIONAL R". I assume it was the debt collection company mentioned by others.

I received a call from this number early this morning- but no message was left.  The info says it's from Smithtown, NY on route 25 when you look it up online- but no address and no other information.  I've never received a call from this # before- hopefully it won't become a daily thing.

631-382-8700 called, but did leave a message, I picked up and spoke to them. This is a number for "International Recovery Associates" or something, a collections agency. Unlike typical collection agents (a-holes?) you hear about, this was a very professional woman. I was annoyed about the topic than by her - a "bill" claim from a Doctor office that had been taken care of my car accident insurance 4 YEARS ago.

So, if you get this call, check your accounts. If you are not avoiding any debtors, I'd say, take the call and find out as it could be some stupid or old or stupid old BS that can cause damage to your history.  

Just my 2 cents worth.
