UPDATE: I took the call from them at 8 a.m. this morning and played into their game to get as much info as possible. They are reading from scripts, and if you ask them anything that goes off-script, they transfer you. I spoke to 3 people this morning: Louis Wilson, Heather Lawson and Ben Foster. In looking up Heather Lawson, I see complaints about this scam dating back to 2006!! Why can't we stop this?! This personal information should not be released when people apply for a payday loan.

When I asked for an address, they gave me 42 Broadway 5th Floor NY, NY 10004, and said they are the DCA Law Firm - Department of Corporate Affairs. In actuality, there IS a DCA at this address, but it is the NYC Department of Consumer Affairs.

When "Ben Foster" no longer felt like making up stories to answer my questions (such as "If this was in collections, why haven't I received a written notice within 5 days of initial contact, as per the law under the Fair Debt Collection Practices Act (FDCPA)?"), he said they would go ahead and process my file and we could deal with it at the courthouse on Monday. I sweetly answered "Oh yes, let's go ahead and do that." He was a bit surprised and then asked for my attorney's info, so I said "Yes, he definitely wants to talk to you" and gave him the info. Then I told him that we were aware this is a scam, that I have already reported him to the FTC and FBI, and that all calls were being recorded. I told him to never ever call here again or he would be the one showing up at the courthouse. I hung up. No callback yet. I am sick to my stomach with what these people are doing to scared, financially-strapped people.

My mom got calls from these jerks today. They terrified her. Luckily (and yet unfortunately) she is currently working with a lawyer and looking at bankruptcy, so she called him before she sent these scammers her first payment. She had a PayDay loan some months ago, and as far as she knew all of the payments had gone through. These unconscionable cretins told her that one of the payments was put through only one time months ago and did not clear, and that they had sent an email and since she didn't respond she is now looking at $5,000, and a felony arrest tomorrow. She has enough financial troubles going on that she thought it possible this might have happened, and so she was scared. At first they had her speaking with a Louis Wilson, and when she asked to be transferred to a supervisor a Ben Foster got on the phone. (We lived in the Philippines for a few years and she is pretty certain that these particular men were Filipino, not Indian). They had the gaulle to tell her that not only did she need to fax them a letter authorizing them to deduct $500 from her account, but that she needed to ADD IN AN APOLOGY TO THEM. How dare they?! I am livid!!!

After her attorney told her not to talk to them, they called and left a message on her machine. This time Ben Foster called himself an ATTORNEY from DZA or DCA Law Firm, and said that if they didn't receive a fax with her letter authorizing them to deduct $500 by 5p.m., they would take legal action. Their number comes up as Unlisted, but the fax number that they gave is 315-849-3117, and "Ben" gave his "personal" callback number as 646-543-0291. After I heard the message, it reminded me of a news show I had seen some time ago that showed situations very similar to this, so I got online and started searching. Thank you to everyone who takes the time to post their stories!!!

I am reporting them to our state's Attorney General, and the FBI's and FTC's Internet Crime Complaint Center (IC3). I am repeating this story on every complaint site that came up when I searched for this fax number (the phone number must be new because it didn't come up). I am doing this so that whenever anyone else searches for these numbers, many of these sites will pop up and relieve their fears. Please do the same. Keep listing all of the new numbers that these subhumans keep changing, and let's keep protecting each other and raising enough noise until these dirt bags are shut down permanently! They are taking advantage of scared and vulnerable people who are already in difficult financial spots.

Also, I am going to call Mr. "Ben Foster" now that it is 2:30a.m. New York time (if that's where he actually is) to see if we can have a nice lonnnnnng conversation about him threatening my mom. Good morning "Mr. Foster"...

An employee of mine received a call today from 646-351-1238 and caller identified himself as being from the LLC Law Office.  He threatened that legal action would be taken at 11:00 AM tomorrow (Friday) on charges for fraud and money-laundering in 2008 unless a specific amount of money was paid to stop the action.  He had specific personal info, i.e. soc sec #, dates, amts. I called this nuymber back and a man with a heavy foreign accent answered: "LLC Law Office, Charles Green speaking."  I then googled LLC Law firm and found numreous references to similar scam calls involving other numbers.  This particular number is a NYC area code.

I got a call today or should I saw lots of calls from 320-055-172. The person said they were with LL Law firm and there will be legal matters taken care of tomorrow. He ask if # **** was the last of my ss# and I told him I wasn't telling him anything. He got upset when I would tell him. He then gave me to his boss. I ended up hanging up on them because they would not tell me anything. They then called back about 5 times. Is there any truth to this?

MORE INFO:  Caller id had the actual number of the incoming call as 320-055-172  (that's correct--not the normal number of digits).  The caller gave 646-351-1283 as the number to "call back" to LLC Law Office.  When I called the incoming 320-055-172 number, it gives a "this number has been disconnected" message.

I've also been getting these calls to my cell  for a couple of weeks and I've always ingnoredem. For being a law firm they were very aggressive and threatening.  

Today I got a call to my work office and finally got to talk to me.  I talked to  James and Nancy who both had an heavy accent and they sounded like they were calling from a subway with a lot of noice. I  absolutley had to write them a letter  authorizing them to deduct two payments of $750 from my account ( besides they had my last 4 of the SS#, the name of my bank and the peron who I put as a reference in on a payday loan that I had alreadyy paid off) and that I needed to do that in 15min, and if not they will  not work with me and  the lawsuit against me was going to go through  and it tould cost about $5000

At first I thought that thye might be  a real company and a misunderstanding for a loan that I have already paid off, but then some of the real information they had for me didnt match  some oher details so that I when I asked them  for their # to call them back and when I entered the #  on the web  I got this site.

So how do you stop these  jokers from keep calling? How do you report them? ( I have Nancy calling me on  my line on hold right now haha) Anyways, any  let  me know.

Actually the call back number I was given was different (315-532-6039), but everything else about the call was pretty much the same. the number showing up on my caller ID was 320-051-786, and the fax number I was given was 315-849-3117. Same thing with the thick accents and american sounding names, and every time I called them the line was really fuzzy and/or the guy was busy, and they insisted on calling me back or it got disconnected. The thing is, we (my husband and I) actually do have an outstanding payday loan that we are trying to make alternative payment arrangements for at the moment, and I have been so stressed about it that I honestly thought the thing was legit. I told them that since I lost my job we are struggling to keep from being evicted, and that I could not send anything today but might be able to send something friday (at our next paycheck). After acting genuinely surprised that I had not intended any fraud, and telling me they'd have to check with the restitution department, and much back and forth about how much could I pay and when (with me reminding them many times that I cannot afford groceries today, much less to send them 500 dollars) They said they could "set it on hold" until friday if I faxed them a letter today saying that I would authorize them to deduct $500 from my card on friday. They then said I could get a prepaid card and give them the number on friday. Well, being as frazzled and STUPID as I was, I faxed this letter, as well as the copy of my driver's license they told me to. It wasn't until after I did such a MIND-NUMBINGLY STUPID THING that it occurred to me that they had all this info in MY name and under my email address, and I realized the loan we've been trying to arrange payments for was in my husband's name and his email address. I had applied for a payday loan about a year ago with my own info but was declined because I didn't make enough money. As soon as it dawned on me I called them back and asked for who the loaning company was (they gave me a name), and asked for the dates of the original loan, loan number, and/or the date the loan had come due. The guy (same guy I had been talking to- he gave me the name Mark Redd) started yelling at me that he did not have that information and that if I had questions as to the validity of the company then "fine, don't send us any money and we'll see you in court!" and he finally hung up. Then, I got online and started looking up the company initials they gave me for the loaning entity (AACA- they said it was Advance America Cash Advance) together with the phrase "payday loan" and immediately came across sites warning about this scam. My question is WHAT CAN I DO NOW??? They have my driver's license info! not that they can do much with it since my credit is crap because of all the financial struggles we've been having. I know with your social security number you can put a fraud alert in with the credit reporting agencies, but can you put a fraud alert on your DL#?
If anyone knows what to do about this, please reply and tell me. I'm a little afraid that they can use the info to get me in trouble (although they probably already have my SS#, since they gave me the last 4 of it for "verification" when I first got on the phone with them.) And please no one remind me what a STUPID mistake this whole thing was on my part- I already know. help :-/

I have gotten the calls a couple last week and then another one today.
I talked to an attorney and she said to put a fraud alert on your credit report.
My next step is to do what some of y'all have already done and talk to my State's Attorney and Rep. in Congress.
My advice just ignore them.  Obviously some payday loan company sold r info and they are trying to scare us to give them money.
Let them have the police come arrest me.  I'll ask if they want to send my brother.

Yes, I received a call on my phone at 7:00 a.m. PST.  I was sleeping and let the call roll over to Voice Mail. When I checked it later in the day I heard a man with a heavy Indian (from India) accent said the message was for Gary Mallory (pronounced Gawwy Malwarry) and since he was a co-borrower on the outstanding loan it was Gawwy's responsibility to notify Diana (pronounced Dina) of this lawsuit. And, according to their records Dina had plans to fight the lawsuit and Gawwy better tell Dina to call Karl Simmons at 646-351-1283 right away and he didn't want anyone to be damaged by the results of this lawsuit, so she better call.  I saved the message.  I called Diana and told her that it sounded like the same Bozo that she had told me about who called her at work.  It was definitely a scam, I could hear phones ringing and people in the background talking.  It sounded like a sweat shop where they have an auto dialer.  I hope these people are reading these complaints and know that we know it's a scam and the proper authories are being notified. They have no right calling people and harassing them!!

I received another call yesterday, at work, from a guy stating that his name was "Michael" from "LLC Law Firm" and that he was an attorney trying to collect a debt.  I informed the guy that I knew who he was and why he was calling b/c he had called me two other times in the past two months using different names, one of which was Alexander Davenport.  He then asked me if I had an attorney.  I told him that I did and that the last time he called I told him the samething and he hung up in my face.  This time he told me that my attorney needed to contact him and asked for her Bar number.  I informed him that if he wanted that information and he wanted to pursue this legal matter any further that he needed to call my attorney and not me.  He told me that it is not his job to call the attorney, but it was the attorney's job to call him.  I told him don't call me anymore and he preceeded to tell me that he was going to sue me and that I needed to be in court at 11:00 in Nevada today.  All I could do at this point was laugh at the man and tell him he wasn't going to do anything, especially while he was in India.  He then told me that someone would be at my job today to arrest me and "May God help me now".  Well today they are calling my fiance and telling him that they are going to arrest me and they hope that I have someone to bail me out of jail.  These people are a big joke!!!!!  They are not going to do anything.

Consumer Alert: Attorney General warns Kansans of debt collection scam

January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers.   Consumers are warned to not submit payments to these fraudulent debt collectors.

When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid.  Consumers state they have never obtained such a loan or paid off the loan years ago.  The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names.  It appears the phone numbers used by the scammers are ?spoofed? numbers, so that the number appearing on a consumer?s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.

When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent.  These scammers have been able to provide consumers with identifying information, such as the consumer?s social security number, home address, e-mail address, names of family members and the consumer?s computer IP address.  Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.

If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court.  Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union.  The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as ?We?re filing an affidavit against you? or by stating a lawsuit has been or is in the process of being filed against the consumer.

A hallmark of each scam has been calling consumers repeatedly at their place of employment.  This scam hit home when an employee of the Kansas Attorney General?s Office was repeatedly called both on her cell phone and at work.  Despite the employee?s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an ?officer?.

?I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ?If that?s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming?,? stated the employee.

?It is important for consumers to know their rights under the law,? Attorney General Six said. ?If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.?

Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact.  The notification should contain  information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer?s arrest, or using the threat of violence.

This person with the Heavy accent called me at work and upset me.  He wanted me to settle out of court for $3000.00.  I asked him if I could talk to someone I could understand.  He hung up.  Yesterday
this same person called my mother and threatned her also if she did not get ahold of me.    

This is the same person..for this LLC lawfirm.

He said that they have 3 charges against me and that I need to send them 895.00 today. I did call my state attorney and I hope they call me back. I am ready for that man!

after these phones calls and to my friends phone i am a bit uncomfortable with posting anything that might be traced back to me. i keep getting phone calls from +320055172 (on caller id) and a message is left telling me to call 646-351-1283 the second i get the message. he stated his name was brad smith and legal action will be taken against me if i don't return the call. at the end he says good luck. i didn't answer either call i let the machine pick it up. very heavy indian accent and hard to understand.

i got the same message about me taking out a loan in december of 2008. i have never taken out a loan in my life. they have been calling my friend and my sister in an attempt to get ahold of me..they said that they have sent numerous emails...LIE! and that it needs to be settled immediatly...when i called him and was like you need to explaing to me immediatly what this is about he said..." I will but you must understand you must not interrupt me at all" then started rambling off..i got this same call about 2 years ago and they called my friend teling her that she needed to get ahold of me immediately or that i would have a warrant for arrest out for me and the same for her. they called my sister today..looking for my friend!! and me and left a ridiculously long message explaining all this crap that you totally couldnt understand! so ridiculous! they also asked me about my attorney information..its getting so old! i dont understand how they have not been stopped yet.

Contact you state attorney generals office's consumer fraud line and report them. Thats what I did, they will give you the steps you need to take for them to stop harassing you fraudulently.

I recieved a call from LLC law firm yesterday. They said that I had taken out a payday loan in December 2008, but they did not know which company I used, or how much the loan amount was for. I checked my bank statement and there was no record of this at all, and it did not appear onmy credit report! Initially, i was scared and worried, however they could not provide me with any information regarding the account. As many people stated, they also asked if i had an attorney, and threatened me with court. They also told me I had until 11am to fax my payment and requested that I too use a Wal-Mart Pay Card. He stated his name was Nick Stevens and carried an extremely heavy middle eastern accent. He wanted me to pay $895 by lastnight, but then switched it today, stating that if a fax was not recieved by today, they would proceed with court and the fee would up to $5000! THIS IS A SCAM! I CONTACTED THE STATE ATTORNEY GENERALS CONSUMER FRAUD LINE, AND THEY CONFIRMED THAT THIS IS NOT SOUNDING LEGIT. IF THIS HAPPENS TO YOU CONTACT THE STATE ATTORNEY GENERALS OFFICE IN YOUR COUNTY!!!

Wow :0  I got the same message twice and they lift a message on my boyfriends? phone.   The first one they said that if i did not return the call that they will send out the cops to arrest me. Then they said if i pay 789.00 that this will clear up issue will not move forward.   They wanted me to fax over a letter auth them to charge 789.00 and need all my info (Credit card number and code, address, last four of the ss and to be reach number)  I was like if you was a collection agency you would have all my personal info and you would have sent me a letter regarding this matter.  Not to my email address. (WTH) I know how the process goes and no court is going to hear a case that has not been correctly process and I know that if I was summons to court I would have received a notice some time with in the past 3 years or less (since you claim that this was back in 2007) I?m I wrong on that ?  Today I got a call stated that I need to call back ASAP and if I did not call back that all they could do is wish me good luck and God Bless.  VERY FREAKY.   I just want all this to stop.   If any one has a way to stop this PLEASE let me know because this is just getting out of handing.  From Pulling up my credit report (all 3) and going on line to get info on this company (LLC Law Firm)

Two calls in two days, so far. Yesterday he called for John on my phone. He said his name was Michael. Call him at 646-351-1283. Yesterday it was time sensitive, DON'T disregard this message. If you delete the call and your attorney doesn't call all he can say is good luck, he is sorry and tough luck. Today he called for Jerry George ( A name I have never heard before). Same call back. Jerry is to tell John a law suit was filed and if Jerry does not tell John he is guilty of a felony. He doesn't want innocent people to be hampered in this law suit.

I am considering contacting him back today and informing him that under the FDCPA (Since he claims this is a debt) he owes me $3000, and see what he says.

I had the same call this morning, and it was actually the 2nd time I received such a call.  I received the first one back October of 2008, and though the gentlemen (John Green with a thick Indian accent) threatened to send someone to arrest myself and my dad (don't know why he was even brought into it), nothing EVER happened.  It is a complete scam.  It's rude, offensive, and if it actually works on someone it's truly unfortunate.

I did take a payday loan out a couple years ago for an emergency, but was never late in paying it back and it was paid back in full within a month.  I believe that is where they got the information.  Do not give them any of your information, and if you can just avoid answering the call at all.  Unfortunately for me they had my work number somehow, and it  was embarassing trying to explain to management that I was not in any sort of trouble.

I had a guy call me this morning at 6:17am and left me a message saying he was trying to get ahold of a friend of mine. Yet left me the entire message. His name was Karl Simmons. Funny how a "Carl Simmons" had sucha thick heavy Indian accent. He told me my frieend had a legal matterr that needed to be taken care of today and if it wasn't all he could say is"Good Luck". Being woke up from a dead sleep from this number I called back with an attitude. Asked to speak with a supervisor who also had a very American name with a very heavy indian accent. Said the firm name was Associate Law Office and he had a loan out with the company. I told him incase he wasn't aware Washington_ where I live, is 3 hours behind New York and they aren't suppose to call before 8am. Total scam cause I called my friend and he has no loan out anywhere. When they called me the first time the number that showed up was (320)055-172. Weird it didn't have a full amount of numbers. Ignore them.

Person named "Brad Smith" who has an HEAVY accent from India probably (what a joke). If it happens to you, file a report. and DON'T speak with them, ignore their calls, let them know it's a scam and be done with it.
It's not worth your time, and dont be scared.
