SO DO NOT GIVE NO BANK INFO. OR CREDIT CARD INFO TO THEM. THEY HAVE NO AUTHORITY OVER NOTHING. I HAD A CALL FROM A MARK DECKER, WHOEVER THAT IS, BUT THEY COULD NOT SEND OUT NO PAPER WORK OR TAKE MONEY ORDERS SO THEY GETS NOTHING FROM ME......... SO I ADVISE EVERYONE TO DO THE SAME REPORT THEM TO THE STATES ATTORNEY.

This number has called for almost a year for someone that doesn't live here. I have told them no one lives here with this name. All they want is my information and when I refuse they get upset. I hope someone stops them soon it is becoming very annoying.

The number I got the call from was 949 891 6981 saying I obtained a payday loan and they were take me to court and I would go to jail for seven days. Then they started calling off different payday loan companies that I never obtained a loan from and threatening me I am not that stupid because in order to do this they would have to go through your state so its a load of bull. Then he asked me if I was ever prosecuted for fraud and I told them if I was then it would be public knowledge so go look it up. I used a lot of bad language basically cussed him out. He got mad and called me back again and I did the same thing again. I get a call basically everyday from them its designed to scare you enough to so you will pay them its a scam don't fall for it. Most payday loan companies will write the debt off and turn it over to a collection agency and they will not go through a law firm because it would cost them more to try to get  the money back. So if they call you do not give them any personal information especially your social security number tell them give you a number and you will consult with your attorney then you will get back with them. This has scam written all over it do not pay them anything.

Ok I have no clue what is going on but I have to admit my curiosity got the best of me and I did go to Riverside Superior Courts website and check both of the names.  The Randy one had a long record of drug charges and has some type of burglary and probation violations that he goes to court on in November. The other party Pam shows some type of small claims looks like with place she rents or something.  Bottom line is I would not pay any of those company's.

Actually there are 2 owners of Weinstein, Mcregor & Collins, Pamela Mathews aka Pamela Conwell aka Pamela Rhodes, and she is a crazy meth addict that cooked it and used it and went to prison for it. Pamela robbed her own sons house with his 6 year old daughter in it at gun point. They were partners for years with 3 different companies, Trinity Acquisitions & Holdings & Orca Portfolio Management. She went off the deep end because of her meth use after her son decided to leave the companies and break away on his own,. She called the police and falsified a bunch of police reports about her son Randy breaking into their office they had together, and she had the cops believing her, and he got arrested for it, but the case is being dropped because of the false police reports that were given. I too got a call from them, and looked into this in depth. i am unsure what to think of the whole situation...

The owner of the company Randy Mathews is in California and he has stolen the payday loan files from another company. Daniel Swartz real name is DAVID Liebowits or something like that. They are located in Corona California he actually robbed the office his mother owned and stole the server.  He is living at the Deerwood Apartments in Corona with girlfriend Britney Wilson.  Go to the Riverside Courts look him up he just bailed out on Robbery case claims he did not have stolen items but this is proof he does.  What ever you do don't pay this company a dime they are the ones who stoled your information. They use aq company named Vocalocity to change there number to look like they are in a different state.  I will be turning this all over to the Corona District Attorney

The only information I could find  online was for a Orange County prosecutor.. McGregor, and Collins actualy spelled MacGragor  http://www.cmcdefense.com/ or this one in Newport Beach Ca..    http://www.yelp.com/biz/macgregor-and-collins-llp-newport-beach.  The company you posted does not appear to be legal/legitimate at this point and other posts indicate extortion scam.  Posting money to a "special account" smacks of scam anyway.. and the "you can keep 10% for your trouble"..  Somethings not right here, no company I know of myself works that way and gives me a big red flag! Then the account is closed you say..  I'm surprised they did not ask you to get a green dot card and pay them, maybe that is the next step, a untraceable card is another red flag!

If you have a legitimate debt, then contact the real company you have the debt with.  Cold calls are subject to extortion scam and the FDCPA law is clear, a phone call, email or fax are *not* legal proof..

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Debt Collector
I received a call from Daniel in July 2013 in regards to a debt from 2010 that was a real debt.  I did owe Payday Max.  I set up payment arrangements as I have been doing with other old debts.  I received a letter via e-mail confirming the arrangement.  The first 2 payments, 07/2013 and 08/2013, went through with no problem.  I thought the 09/2013 also went through with no problem.  I got a phone call last week saying that they had been hacked.  I was instructed to go to my bank, dispute all the charges, get the money back, and then deposit it into a special Wells Fargo account.  I was told I could keep 10% for my trouble.  I was also instructed to make my regular payments through that account.  I had only 2 left:  10/2013 and 11/2013.  I made my normal payment on 10/04/13 at Wells Fargo with no problem.  In the meantime, my bank refunded 2 of my payments.  When I attempted to deposit that money, less 10%, I found out that the account had been closed.  I can no longer get a hold of Daniel Schwartz.  I had the 646-666-8883 number as well as 646-374-3256 (Daniel Schwartz's direct line).

This is all confusing and scary because my debt was a legitimate debt, but is it still remaining unpaid?

I received a call from Daniel from Weinstein, McGregor and Collins.  They say they are a law firm that represents Trinity Acquisitions and Holdings out of California.  They said that I did not pay on a payday loan and needed to give them money, or they would take me to court.  I told them that the loan was already paid off.  They informed me that I got scammed and would sue.  I'm trying to find out if these guys are legit.  The person calling is Daniel Swartz @ 646-374-3256.  Somebody please help.

I was told at this number they has a summons for me to go to court and someone would come and serve me at my job tomorrow.  He said that I had an outstanding account with Ashland Enterprize Limited.  The number was from New York at 646-666-8883.  Weistein & Mcgregor& Collins. I never heard of these people before I looked them up and every blob says they are scammers.  The address they gave me was 1562 StenSuite 205 20025, NY.  I hope you find them and put them out of business.  Thanks so much.

I called this number and was told it involved a court summons.  The call was actually about someone I know and was told I would be sued and brought to court if I don't deliver information on this person.  I recommend no one call this number back. I couldn't make out the name of this company as well.
