ive had similar problems with these thick accented middle eastern callers saying a lawsuit is being put against my name and last four of my social security number, saying if i dont call back then they'll send their investigation officers and local police to my home or job, these are scams!!! dont give any money to them, regardless if u took out a payday loan online or not and just didnt pay it back and closed your account, the worse that can happen is it gets kicked to collections and if they are legit it just goes on your credit report until its resolved or timed out (if they are legit), they cant have you arrested or anything like that, its what they call ":Scare tactics" to scare you into paying these scam companies that wont give an address, real name, or anything you could use to track them down. just ignore them, i know these callers are extremely rude and threatening, if you do answer and talk with them, they just call you more and more, so please stress less and if anything get in touch with your bank or local law enforcement agency and maybe even a lawyer and they will put your mind at ease, these are scams!! they are crooks trying everything to screw you out of your money. good luck!

Recvd a call from 772-228-4008. The man who left me a messages stated his name was David Brown (had a very thick accent) and that he needed to speak to me immediately reguarding an important matter that he could not leave on my voicemail. I called the number back, not knowing what it was for. When I dialed the number someone answered and said "How can I help" I asked for David Brown and the man who answered said, I am David's supervisor Shane Watson. He asked me for the number that the voicemail was left. He tried to tell me that I took out a loan for $350 in 2008 between the months of April and June and never repaid it. I asked him for the name of company that I was in debt to, he responded with Cash Net USA, which is a part of the BBB. This man began to read off my email address, social security number, bank information, work information and also relatives of mine. Now feeling very nervous that someone had all my information and claiming I owe someone money he asked me if I am willing to pay off the loan including interest. My total would now be $620. He told me if I did not pay the amount today that my file would then be transmitted to the court system and that I would be arrest at my place of employment and not only would I probably lose my job, I would have to hire a lawyer which would cost me thousands, and it was just cheaper to pay the $620 now. Being familiar with the Fair Debt Collecting Act, I knew this was untrue. He then said he would need me to give my credit card imformation to him. I told him I would not give it to him on the phone, that he needed to fax me a Payment Authorization letter and also the legal paperwork to go with it. He said he would fax it over, he gave me a fax number to fax it back at 646-786-4435 and that I had 15 minutes to fax it back otherwise they would send my file to the court system.  I waited for the paperwork, on the forms there was nothing that indicated the company name, who the debt was being collected for, and a different name then the comapny he said he was with (National Affidavit Processing Service) I immediately called the Attorney Generals Office, the local police department, Federal Trade Commision, credit bereau, Cash Net USA, and my bank. While I was doing this I recvd 6 calls from 052466993. I faxed the form back (not filled out) with the Fair Debt Collecting Act, and that they have been reported to Attorney Generals Office, the local police department, Federal Trade Commision, credit bereau, Cash Net USA and my bank. They stopped calling. Beware and please do not give them any imformation! Call the same people I did!!!!!!

I received several phone calls from them saying that they were lawyers working for a payday loan company that they couldn't tell me the name of. They used common American names, when they were obviously Indian or Middle Eastern and I could hardly understand them. The first message I received was very polite from a Mark Spencer. I called them back just to amuse myself. The guy on the other end actually had the names of people I knew and said his name happened to be the same as my best friend and that's what really gave it away. They said I had three charges pending against me in federal court from this huge payday loan company that has 45 subsidiaries and that I could settle it out of court easier. I asked which sudsidiary I owed the money to and they couldn't tell me and that it was my responsibility to keep track of that information.  Well, if I had federal charges pending against me I don't think I'd be sitting at home. They kept asking me if I wanted to settle it in court or out of court, I just told them that I have paid or am paying all of my debts and that I know they are running a scam on me. I filed a complaint with the FTC and let them know that the next time they called and they asked me why I thought it was a scam and I hung up on them.

These people started calling me a month ago and said they were with the federal government of CA.  He told me I owed $1420.00 for a payday loan.  He told me to get a notorized letter said I would not stop payment.  After I started asking him questions he became rude and said he would send the police to arrest me.  That was a a couple of months ago.  The calls stopped then they started calling again.  My caller id says JC Communications but they say there name is ACS.  They even called my sister house.  I told her what was going on and when they called back she fussed them out.  They have not called her back as of today. They called me at work today and I told the man I knew he was a fake so stop calling my phone

That's common in over-seas call centers. They want their employees to use a 'American' name to hide the fact they are actually calling from abroad.

I am from India... I got a call from 64622498846 and the call back number he gave is 646-810-8635. This guy is not having Indian accent but it is strong Asian accent. I am saying this because he couldn't pronounce my name correctly as it is a pretty common name in India. He is threatening me saying some one gave my details as reference to the loan. The "some one" whom he is referring is totally unknown or I have no friends or family in that name.  It sounded weird to me. Good I searched on this spam before calling back...

Consumer Alert: Attorney General warns Kansans of debt collection scam

January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers.   Consumers are warned to not submit payments to these fraudulent debt collectors.

When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid.  Consumers state they have never obtained such a loan or paid off the loan years ago.  The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names.  It appears the phone numbers used by the scammers are ?spoofed? numbers, so that the number appearing on a consumer?s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.

When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent.  These scammers have been able to provide consumers with identifying information, such as the consumer?s social security number, home address, e-mail address, names of family members and the consumer?s computer IP address.  Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.

If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court.  Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union.  The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as ?We?re filing an affidavit against you? or by stating a lawsuit has been or is in the process of being filed against the consumer.

A hallmark of each scam has been calling consumers repeatedly at their place of employment.  This scam hit home when an employee of the Kansas Attorney General?s Office was repeatedly called both on her cell phone and at work.  Despite the employee?s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an ?officer?.

?I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ?If that?s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming?,? stated the employee.

?It is important for consumers to know their rights under the law,? Attorney General Six said. ?If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.?

Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact.  The notification should contain  information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer?s arrest, or using the threat of violence.

More information is available on the Federal Fair Debt Collection Practices Act at http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf.

To register a complaint with the Kansas Attorney General?s Consumer Protection Division, call 1(800) 432-2310 or visit www.ksag.org.
