Received a call today asking for a person not known to me.  They said they would take me off the list, but that I might get another call or two before it became effective.  I have received another call.  They are very polite and it makes sense that they are a credit collection company.  A customer must have given a false phone number, and it happened to be mine.

10 FDCPA Violations From Credit One Bank

The Fair Debt Collection Practices Act, FDCPA, dictates how debt collectors can act when collecting a debt from you. These are things a debt collector can't do. If you need to reference the law, citations have been provided.

1. Ask you to pay more than you owe

9. Illegally inform a third party about your alleged debt
Unless you have expressly given permision, collectors are not allowed to inform anyone about your debt except:

constantly get calls, they dont leave a voicemail. I dont pick up calls of #s I dont recognize, I have seen a pattern though.. if you dont pick up the phone or if you block their #, they call from a different area code... trick is the middle 3 numbers regardless of area code is always 204.

Example:  xxx-204-xxxx

it began as North dakota, now its MN.. okay, not picking up. likely I inherited this spammer from whoever owned this # last.

Dear Princess,
This is Credit One Bank.   Go on to CREDITONEBANK.COM to find the phone numbers you are looking for.  Chances are someone stole the credit card offer out of your mailbox and activated the card.  You'll need to report it lost/stolen to get out of the charges they may or may not be accusing you of.

By the way, conveniently for them, the Fraud Department closes at 3:00pm Pacific Standard Time.

India/China/Mexico calls first, if you admit you are who they say they are calling, the call gets transferred to someone who speaks English.  Then the fun starts.  Accusations, threats of collection, all kinds of crap.

ALLISON is the big "B".  She tore me a new one right before I patched in my friend at the Attorney General's office on our phone call.

Here's hoping ALLISON doesn't have a job tomorrow.  Cheers!

They got me!  Or more to the point, the offer came to my house, a friend who was staying with me activated the card and started charging away.  that was 3 months ago and I just found out about it today.  A "B" named Allison called and in less than 2 minutes told me that I owed over $300 bucks on the card and in the next breath told me I was "going to collections".   Unbelievable!

Reported it stolen to Credit One on their phone line, but I can't log into the website because I don't have the card in question.  Then I reported it to my State Attorney General.  They are aware of Credit One and are investigating them and their "practices".

call shows up as anonymous on my caller ID.  I don't answer those calls but did this morning.  It was from this number.  Got 'em on three counts.

Geez, I'm getting a little tired of calling the FBI everytime this kind of crap happens.......

I got a call from 651-204-1376 as well.  I used my google voice number to call them back and the guy stated he was from Credit One Bank.  I told them I don't have an account with them and he wanted to know the phone number I was called at.  I refused to give it to them and he said they have my number anyway if I was called by then.  Then I mentioned you could have used an automatic calling program that randomly generates numbers for all I know.  Then he hangs up on me.  I then look up Capitol One Bank's number online and call them.  The operator there told me that the number calling me does not belong to Capitol One bank.  So be careful its a huge scam.

Also, my droid bionic has the option to send numbers straight to voice mail.  So I added the number to my contact list and named it (do no answer) and marked it send straight to voice mail.  If your phone has this option it will save you a lot of headache.

What it takes is not relying on verbal requests, which cannot be proven thus tend to be ignored. Lamet already copied the FTC's advice here over two years ago. Third parties to the alleged debtor like yourself don't get a lot of coverage by FDCPA, but it does say ''any person'' cannot be abused or misled by a collector.

To a ''not me'' case I always recommend putting the agency on notice, just as you would if you were the target and the debt claim was invalid. Send a cease-comm notice via USPS Certified with return card. The FTC and many consumer watchdogs explain how to draft one. This will set a legal landmine, as such a notice is ignored at their peril. This can also help pull the agency under the shadow of TCPA, which carries treble damages for ''willful'' violation.

THese people keep calling for someone who doens't live here and we have no way of contacting.  We have told them to stop calling us and they said they would remove our number from their list.  After that we recieved 2 more calls with no one one the line when we answered.  They called a total of 6 times in 2 days. One was as late at 9PM.  What does it take to get rid of therse people?

Except I don't live in the 651 area code, so I find a little discrepancy in your answer. And no, I wouldn't answer thinking it's work, I pretty much know my work number lol And if you answer because you think it's work, well, then I'd have to say you have other issues besides not paying bills :)

They call from "regular" numbers  so you pick up because you don't see its a credit company calling if you owe them money  your going to avoid them right?  so its more likely you would answer .. they called you from state your work company is located in and if you didn't know you'd think it was work calling and answer them.. cute huh?

Heh...  Odds on, a criminal used the number as the contact number for illegally obtaining credit on an ID Theft move.  The collectors have no concept of legality or that maybe, just maybe they might have erroneous information.  Some of it is that they "can't" really give room for this sort of thing- most of it, though, is because they really ARE bottom feeders of the worst kind.  Check into your State laws as to what Debt Collection Practices really are- most States explicitly forbid this sort of thing and it is $1000-1500 per pop to be breaking the law.  Why do I mention this?  Most people will claim the FDCPA as being the weapon of choice- only with a third party collection agency will this work.  FDCPA explicilty (which I question why...) exempts primary creditors- and they know this.  However, many of the States have similar laws on the books with even more teeth in them than the Federal law.  IF they're operating in your State in any capacity, you can explicitly haul them into your State's court system with sufficient evidence (Call log on the line will be enough...)- and if the damages (Remember...$1000-1500 per call, typically...) exceed $75k you can drag them into Federal Court and apply the State law in question.

i am having call from this no since 10 days before that they were doing call  from 800-720-9997...now it is almost a month they are calling on my number .... more then 10 times a day....really weird i dont have credit card from that comp....

I receive calls from I C Systems Inc, 10 or more times a day. Doing the weekdays and on the weekends. What is disturbing is they call on a Sunday all day long. Sunday is God's day why do these people keep calling me, and how did they get my number. I wish they would stop calling my number.
