'Charity' Lies About Helping Disabled, AG Says
By BARBARA LEONARD
MINNEAPOLIS (CN) - A Minnesota man dupes consumers into buying household items at "grossly inflated prices" by falsely claiming the profits go to the disabled workers who created or packaged the products, Attorney General Lori Swanson claims in Hennepin County Court. She says the so-called charity "is designed to generate profit" for the owner, "and does very little to help individuals with disabilities."
"Defendants are perpetuating a fraud on Minnesotans by deceptively exploiting Minnesotans' charitable goodwill for their own financial gain," Swanson claims.
James Bushinski, president of the Florida-based Northern Handicapped Products and the now-defunct Northern Handicapped Assembled Products, falsely claims his companies employ more than 30 physically and developmentally disabled workers, according to the complaint.
Bushinski allegedly suckers consumers into buying everyday items such as garbage bags, light bulbs and greeting cards at significantly inflated prices by claiming that his disabled workers created or packaged the merchandise.
"What the defendants do not disclose to consumers is that the only person with disabilities who counts, packages and assembles these products is Bushinski himself," Swanson claims. "This is especially misleading in light of numerous representations made by defendants companies that they benefit many workers."
Swanson says Bushinski buys some of his merchandise from state-run and nonprofit organizations that employ workers with disabilities, but he never donates the proceeds of his sales to charities. And much of his product line comes from retail stores like Wal-Mart and Sam's Club, Swanson says.
"Defendants create the impression that the money from the sales will go toward supporting the individuals with disabilities they 'employ' and who purportedly created or packaged the products being purchased," the complaint states. "In fact, defendant companies are for-profit entities that do not directly employ third-party workers with disabilities."
The nonprofits that sell some products to Bushinski's companies have reported that "defendants' purchases are not of a sufficient volume to improve or otherwise affect the lives of workers with disabilities who work at the state or nonprofit facilities," according to the complaint.
If Bushinski stopped ordering products from these companies, no disabled worker would lose his job or earn less money, Swanson says.
Swanson says Bushinski sells primarily to Minnesotans, but has also defrauded consumers in Pennsylvania, Wisconsin, Florida, Illinois and Michigan.
In addition to the "inherently deceptive" names and logos of Bushinski's companies, his telemarketers allegedly use a sales pitch that implies that profits from sales will directly benefit the disabled workers the companies claim to employ.
One line from the script tells consumers: "The more you can take and use, the more work you will be providing for our disabled workers," according to the complaint.
"Defendants' scripts also direct defendant companies' sales representatives to refer to the merchandise as a 'gift,' which implies that the consumer is not actually purchasing a product but receiving the product in appreciation for giving money to a charitable cause," the lawsuit states.
Bushinski sells his merchandise for up to 800 percent of their retail value, Swanson claims. For example, he allegedly buys 24 light bulbs for $26.95 and resells a dozen for $99.
Swanson says the business "is designed to generate profit for Bushinski and does very little to help individuals with disabilities."
She says Bushinski uses the profits he earns to pay for dining out, groceries, liquor, hair salon visits, musical instruments and his children's school fees.
The attorney general's office investigated a Bushinski company for operating a telemarketing scam in 1996, and Bushinski settled the matter by agreeing, among other things, "not to engage in charitable solicitation fraud," according to the complaint.
Swanson seeks restitution and civil penalties, alleging charitable solicitation fraud, consumer fraud, deceptive business practices and false advertising.

I should point out to newbies that the surest sign that a business is a scam of some sort is when they start sending people here to shill for them with false testimonials of how wonderful they are.

Go away, shill.

I've been ordering products off and on from this company for years. They are never high pressure. The products are fine. I cannot always afford to buy, but I do when I can.

I work for Jim, this is my first week. He's physically fit, in his early 30s and is in no way physically disabled. There are about 12 employees of his that I've seen in the entire building, and only one of them is disabled.
CON ARTIST 2012-06-07 01:14:11 Unknown
The guy is the biggest con artist around. He buys these items t costco or another store..takes em home.. packages and sells em to you for insane prices. He does NOT have any handicapped people helping with this in any way WHATSOEVER!... So what to the people that say theyu got a thank you card from one of his facilities...YEAH RIGHT.... why dont you ask to visit one of them so you can see first hand where your money is going..???... if you do... he will double talk you and try to come up with a reason why you cant visit...dont let him... this guy has been doing this and getting away with it for years...and he lives like a king...off of your money!!!

Shelly or Mai bushinski who was the owner of northern handicapped assembled product for 15years was the one responsible for taking advantage of her disabled veteran husband and his disability money, she is the piece of s*** that caused all this confusion and false and misleading info against her husband, get a life you looser!!
Shelley 2012-03-08 20:11:40 Unknown
This is NOT true. Bushinski did NOTprove to the attorney general that they helped anyone. In fact, the Attorney General's office sued them and won. This company does not employ individuals with disabilities - they buy products from nonprofits who do. For example, Bushinski buys a candle made by a person with a disability for $5.00, then sells it for $18.00+. He receives all the profit while stating he is "helpIng" people with disabilities. Legal? perhaps.... misleading? absolutely, yes. Taking advantage? absolutely, yes.

Yea when you purchase helps to keep over 30 physically and developmentally disabled gainfully employed
Sedaalora 2011-06-06 20:53:51 Unknown
This company is definitely a scam. Any charity will have a charity ID number. My husband serves, so I really am disgusted that these people are using our patriotism and sympathy to get money. Go get a real job! They called me this morning and I tried to listen about the products and I didn't have a problem giving money...but I asked for their id. The rude woman said no one has every asked that and said they are on BBB. That doesn't mean anything. She got mad at me and said, "So you aren't going to help us?" And I said, "Not without an ID number". She told me to "go to h*ll" and hung up. I was polite the whole time. This confirmed my suspicion that it was a scam. I don't know anything about these people on this post...but whomever is calling from this number is definitely not an upstanding individual.

Selling $60 rolls of garbage bags to the elderly does not constitute "gainful employment".

I purchased from this non-profit a few times. Their products were pricey but good quality. They said they were a non-profit supporting an employing 30 disabled gulf war vets. So I ordered a couple of times. Called 612/770-8162 today and this number is no longer working. Neither is the web address: easysite.com/NHAP. I got this info from a letter from James Bushsinski when I first contributed in 2008. I am glad it's not a scam.
Information does come up for Northern Handicapped Products Inc.
He must have gone out of business due to our economic times. I pray he can regroup and come back strong. We need to support our local vets. Plan to send James a check at his address in Woodbury!

northern handicapped products owner james bushinski is a disabled gulf war veteran. his company was looked at by the attorney general due to 2 other companies northstar handicapped helpers and northern handicapped and blind workers. these guys are scammers and thieves. northern handicapped / james bushinski proved to the attorney general that thay help keep well over 50 physically and developmentally disabled workers gainfully employed. all of you who wrote these awful comments without even a slight bit of the truth should be ashamed of yourselves in slandering a disabled veteran and especially one who helps more disabled people than i know!shame on all of you!!!!!

Hey Everyone,
This is a professional con-artist who has multiple locations in florida and in Minnesota. It is the Bushinski family. They have various company alias names but the one they use when they try to get money is Northern Handicapped, but they pose as an organization that employ's the handicaped, and try to get you to donate money. Do NOT do it. Report them to the Minnesota Attourney general's office, at 651-296-3854. They are currently investigating them for fraud.

I've received a number of calls from them. I did leave a call-back number, and when they called, I was able to obtain their company information from them. I've registured a complaint with the FTC, and I'm going to be filing suit in the local court : )

Using the information above the house is owned by a Gerald Bushinski. He is mentioned in a fund raising scam from 2002 in a Virginia court case as a being a subcontractor to a charity fraud network. He used to live in Duluth MN in 2002 it looks like. I had answered a phone call from probably that number last week and they tried to sell me light bulbs, plastic garbage bags, etc that handicapped people made. It sounded fishy so I told them to send me some info. The info is from a Northern Handicapped Products Inc. at 8362 Tamarack Village in Woodbury MN 55126 with a cell phone number from the Minneapolis area, Woodbury is an Eastern St Paul suburb with 651 area code.
