Got a harrassing and threatning phone call from Kimberly Taylor stating that my daughter wrote a check in the amount of $750.00 and would be arrested with a warrant issued the following day if the amount had not been paid. I guess I will be contacting my Attorney General Office in Texas also.

My mother received this phone call stating it was KEMPER INSURANCE concering a LIFE INSURANCE POLICY #... when I called it was a debt collection investigator... being from a situation,  I would like to report this fraudulant number.

A lady name "Mary" leaves a message for myself and my nephew on my cell phone in reference to a complaint in my county.  Wants a recorded statement as to my involvement in the incident and due to the severity of this matter I need to contact them at 678-500-8444.  When you call you get the recording.  "Mr. Downs" answers for Delanor Kemper and Associates.  Guess I too will call my Attorney General office here in Texas.

They use ILLEGAL collection tactics.   Which would indicate they have NO PROOF debt is even owed
They intent is to cause PANIC and get you to pay them without them HAVING to PROVE they have any legal right to collect the debt. They DO  NOT WANT YOU TO DISPUTE THE DEBT as is YOUR RIGHT under Fair Debt Collections Practices Act.

Claiming to be an investigator implies they are police
Claiming to press charges for Check Fraud is falsely accusing you of committing a crime.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;

Debt collectors also are prohibited from saying that:

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

I recently investigated this number and it is legit.. I called ace cash express which is where i owed my debt.. and they sold my debt to delanor, kemper and associates which is a third party debt collecter that cannot prosecute they can only garnish your wages.. They doubled the amount that i owe and until it goes to the courts i am not going to pay it...

He is a scammer. He called for my wife using her maiden name. Mr. Sloan then claimed his system was down and he had no record of her name on file. I told him that he obviously did, due to the message that he left. He then asked for her Social Security #! I told him that if it were really for legal reasons, then a social would not be neccessary. We would have received something in the mail. He pretended to be talking to a police officer named Officer Malone. Too Funny...

He then stated it was a call to inform her of check fraud charges due to a Payday Loan. We will be getting a summons in the mail by the sherriff. Well, we never had a payday loan, nor are we in the state of Georgia! Really? Bring it on.

Please let everyone know that this is a farse!!!

my sister received a phone call today for my husband, and he told her his name was harvey sloan and if she really cared about him she would get ahold of him immediately. she called the number back and she got an answering machine when a lady answered my sister asked for harvey sloan the lady noone was there by that name. the number was 678-500-8444 he said he was an investagator and my husband had felony charges

One of my co-workers received a call fro Investigator Washington, who informed her that they were going to send a sheriff posted outside my job to arrest me if I did not contact them.They left the phone number, 1-678-500-8438. My co woker called me in a panic and gave me the number. When I called back to obtain details they could not provide me with any information or proof that I owed the debt.

Harvey Sloan called our house today.Asking for our daughter..HUM????
Said he was calling for Attorney DALE KEMPER @ 678-500-8444. Not a typical call for our daughter. Said it was time sensitive???
SO, I called, left a message.Told them if it was a scam, I would be calling the Attorney General Office.
Then I called our attorney's office , said it seemed like a scam. She looked up the attorney names , phone did not match....The she went on line and found all your notes.

I just got a message on my home phone from this number, and it was from a Harvey Sloan at Delanor Kemper, and he said he had been monitoring some negative activity on my husbands social security and there may be a compromise to his identity. Then he called my CELL phone as well, which I answered, and it was for my husband's two year old loan to ACE. He said it was check fraud, and that my bank has asked to press criminal charges. We are in good standing with our bank, it's a local credit union and I feel fairly certain that our three accounts there would not still be open if they were seeking legal action for a check that was written two years ago! Anyway, I asked him politely to give me the bank name, and of course he couldn't give it to me. I then told him that the check was written to pay a debt, and therefore cannot be considered fraud. I asked him to stop using bully tactics and just give me the information, and acceptable forms of payment. He then started yelling at me, told me I was not going to tell HIM what to tell me, or how he was going to tell it, and that he wouldn't speak to me any longer if I was going to bully HIM. I said, very calmy, "I am only asking for the basic information." He yelled, "You know what?? I'm not going to give it to you! Have good day!" then threatened my husband if he didn't call him back by 3:00 today ~ and hung up. I would love to help my husband get this mess clear up, but how on earth do we proceed now? This guy is a liar and a bully!!

I got the same call on MY CELL phone..... it wasn't even for my name... my husband caught it and checked it out on the internet... i was freaked out at first though.. just a warning to all it is still happening, luckily we did not give any information out, we have run into fraud before....  spread the word about that phone number, it even has an answering machine........

i got a call from a mrs williams and they told me the same exact thing that they were going to do felony charges and when i asked what was it for he told me cash america and then when i asked when was this done and other info he didnt know any of that info. so i told him to call me back when he had that info. well that was about two months ago and now they are calling me back to back and wont stop calling. i dont know if its a scam or not but if 2 people have said that it is it kind of sound like one. oh and they told me that i had 24 hrs. ive recently had my cousin that is a police officer check to see if there where any warrants out for my arrest and there are not any. i dont know what to believe

I received a call from investigator Downs, and he told me that he had a fraud check charge on me, from nofaxingpaydayloans.com. He told me the attorney Deleanor Kemper was the attorney handling the case on me. When I did my homework on it, I found it was a fraud like the last post/person left. They told me he would issue a felony warrant on me for the charges on the pay day loan. It is a scam, and if you get the call do not let them intimidate you nor give them any personal information about you and or your family.

A Mr Downs called asking for my wife, I said I was her husband and if I could take a message, he then started to tell me who he was, and the company of Delanor Kemper and Associates and that he was calling about a debt, that this is a courtesy and he did not have to call, as she can have civil and criminal charges against her for check fraud, because he already had the order to take it to court and would like to resolve it outside of court. He gave some more rambling, and then said the balance (twice the original debt-payday loan) I let him know that we couldn't pay anything right now, and that I was out running errands and we would have to call him back. He said he had to have suitable payment arrangements made, within 24 hours and that I needed to call him back by  3pm EST(I am 3 hours behind)I said that isn't 24 hours, and he told me he got this on his desk at 4 o'clock yesterday. So, it is 9:30 my time and that gives me only 2 1/2 hours to set everything up.  Unfortunately my wife called them back and set up 2 payments, using debit card info, they said that they would send an email to us verifying the validity of the debt and company. We called them back a couple of days later and asked where the email was, and they said they do not send it until the second payment posts, with that in mind, and we read comments here and on other sites, we stopped payment and canceled that debit card, and made sure that there were not any funds in that account....... Definitely scam stuff, I should have picked up on the fact that they gave me all information, when the debt was only in my wife's name, He never even hesitated about openly discussing all matters with me, that they are not allowed to do.  So it goes to show that we really need to pay attention to the little stuff and not let scare tactics get the best of us.
