Naturally the DNCR is "pretty worthless" when you try to apply it outside its scope. The federal Do-Not-Call registry exists to help enforce the Telemarketing Sales Rule. Please note the operative term ''marketing''. A debt collector is not a sales person and is therefore not covered. Here are the DNC service terms you were supposed to review at registration time:

Sssiighhh .... What's happening ARE "illegal debt collection practices". You can't just drop a note with the CFPB, FTC, or attorneys general saying "it's a scam" and walk away. Different business categories answer to different laws, therefore you need to determine what the thugs want in order to punish them.

The FDCPA covers people who genuinely owe, and those *alleged* to owe something, which by extension covers phantom debt. While the thug PDL collectors might be inventing dollar amounts and not caring who pays, they are typically exploiting real data lifted from real loan applications. Their extortionist tactics are about the same whether the debt accounts are real or imagined. It's simpler to treat them the same way if your object is to halt abuse and prevent honest companies from being disadvantaged.

Where exactly do you report these as scams.  All I can find are links to report illegal debt collection practices, not to report just outright scams.  Further guidance would be greatly appreciated, as these scammy pieces of garbage are calling us almost weekly now, from their 3rd different number.

I am getting several phone calls from this phone number saying that I have a judgement against me and will be served on my job with papers. I work in a business where I can look up judgements and I know for a fact that I have no judgements against me and I filed Bankruptcy 2 years ago, and have not acquired any other debt since. I want to know how to stop these phone calls, I do not want to change my phone number.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

These people are violating the Fair Debt Collection Practices Act big time! I'm going to SUE THEIR PANTS OFF! The first time they called they threatened me (I'm not even sure what this is about) and said they are going to call my work, my HR Department. Then today they called and said there was fraudulent activity attached to my name and ssn and they were going to press 2 charges against me! I have no clue what they are calling about and I checked my credit report and don't see anything. They said I was going to be arrested! These folks calling from (701) 491-7809 need to be stopped for their total violation of the Fair Debt Collection Practices Act! Very, very nasty and threatening and lying! They don't even say who it is or give the name of their company, just continued threats!

They call my cell, my work. Telling me I owe them money. Don't tell me who I owe. They are going to come to my work and summons me. Or i can call back and pay them over the phone.
They keep calling my cell. I put my name on a DO NOT CALL , but guessing since they have my number they are going to keep calling.
I live in Texas trying to find out how I can check to see if there is anywhere to check the claim out..

Received call from 701-491-7809, left message, part person part robo. State they were with the processing & clams dept and needed to verify my address & employer info. Said this was their third and final attempt, that they would be contacting my HR dept and would be serving me papers. Failure to respond today would be forfeiting my rights and I would have to appear in court unless I responded to the client today by calling them back today at this #. I'm not wasting my time, no idea...

I wish there was a way to make this number to stop calling us and harassing everyone.  It is a SCAM... we are all under enough stress to have to deal with these donkey butts.

I was told that it is a direct result of anyone who has applied for a cash advance through of those agencies in the past.  They get your details from those applications.  I am wondering if they are in cohorts with this place and has sold our confidential information to them.

Frustrating... I don't anyone any outstanding debts so it is truly even more aggravating...

4) Does not say what this is for

Please read through all of these posts and take action. Don't just ignore the calls. NOT because they are legit- they are NOT. They are NOT legal. Do not give them any information, do not pay them a dime. Please file a complaint with the FTC (they are your best bet- they DO work to get these guys out of commission). Also the IC3 division of the FBI and your Atty General's office. Our Atty General has taken a hard stance on trying to stop these predators. But none of tees agencies can help if you do not report these calls to them. What they are doing is illegal!!

Have received two of these stupid calls on my work phone from Ashley.. I don't answer the phone and they are a bunch of idiots. I called the FBI office in Atlanta and they are aware of this outfit, but couldn't provide specifics. Referred me to the Office of Consumer Affairs here at the governor's office. Also, put my number on FTC Do Not Call List, but honestly, that is a pretty worthless list, at least that is my experience.

I just got this same call, I haven't had a payday loan since back in 2007 and I have been married for almost 5 years now and they keep using my maiden name. I called back to get more information from them like their company name and the lady was very rude and refused to give it to me. She asked me if my name was so and so and I told her it was none of her business to know that information if she can't give me any information, then she hung up on me. I have two very young kids to take care of I don't need scammers trying to call and scare me they are going to send me a summons or arrest me.

received a call from 701-491-7809 from process and summons indicating there will be 2 charges filed against me in my county and I need to contact them before I receive a summons at my place of unemployment or at my home otherwise all rights will be forfeited by me.
Thankfully, I now know to google the phone number they want you to call back or the Name of the Company they say they are calling from BEFORE I return their call, then I can see that it is a company trying to use scare tactics into getting me to pay, unfortunately when some people receive this kind of call it can really stress them out and make them worry about getting a summons or even getting arrested.
A word to the wise-Google the number, so you know what and who you are dealing with before you call!
