Debt Collector
I receieved several phone calls from someone claiming he is Johnathan Ortiz.  He asked me to pay my Integrity and Bottom Dollar paydays loans, using a Money Pak card.   I fell for it twice, and have given him (or his organization) a total of $500.  He claims that the Payday loan reps will file a lawsuit against me if I do not pay...these scammers are EVERYWHERE!!!!!!!

Debt Collector
I received a call telling me I have written bad checks and me or my attorney needs to contact them. The thing is I don't write checks except to pay rent and those can't be bad. They also told me they will freeze any account with my ss# attached to it.   Does anyone have any idea who this is?  When I call the number it says South East Financial.

Miss  Jones  from (possibly  Southeast  Financial ) about a  debt/loan  that I supposedly owe. A  debt/loan I do NOT  recognize,nor  incurred. It  may  be from an incident of  Identity Theft  over 4 years  AGO. Another  sleazy  "collection agency"  based in  New  York state  tried  the  same tactics. I kept  EVERY  voicemail (never answer  the  calls-let the "collectors" record  their  ILLEGAL  threats  on your  voicemail /answering  machine. Then  SAVE  every  recording. Also,keep a  record of  EVERY  call: day/time/ person calling  /etc.). I  contacted an attorney based in  NY state that  SPECIALIZES  in  debt  collection  violations. VERY IMPORTANT :  if  your  sue ,you  can get  $1000  per  PROVABLE  violation. But, you have  to  document  every  thing. I  told  that  sleazy  company in NY  state in a  letter  sent via  USPS with  RETURN  RECEIPT  REQUESTED ( which  proves  they  got  the  letter), every time they  called  after  receipt of  the  letter  they  were  VIOLATING  Federal  law and  the  company  was  LIABLE  as  were  each of  the collectors  INDIVIDUALLY. They  kept  calling. After  16  calls  they  stopped. I filed  suit  in  FEb. 2011 and  WON a large  settlement.  The low life that  own the company are  ALL  ex-cons(they  met  in NY state  prison). They  threatened  me over the  phone( again I  let them  record their  INCRIMINATING voice  mail  messages,which  I texted  to  my  attorney,who played  them for a  NY State  Judge who issued PERMANENT  RESTRAINING  ORDERS  against the  owners  of  the  company, the 4  collectors and he  ordered  the  company to pay  me damages  in the  5  figures. Plus court  fees,filing  fees,my attorney's fees,etc. They quit  harassing me . Now  this  Southeastern  Financial  Company in  metropolitan Charlotte N.C. is  trying  the  same  sleazy, ILLEGAL tactics.  I'm going to  do  the  exact  same  thing  and  let  that  low life  collection agency hang  themselves and  I'll  have  my  attorney  in North  Carolina  file  suit  in about a  month. And  I can wait  til  pigs  fly. Because a  lawsuit is  like a  savings  account: the longer it  goes  on , the MORE  the plaintiff gets  in  damages. I'm not  encouraging  anyone  to  go sue  these  low life,sleazy  companies  on a whim.  You  have  to  have  a  solid,PROVABLE  case. Always  use  an  attorney/lawyer based in the  state the calls  came  from and that  SPECIALIZES  in  collection agency  law ( do a  Google  search on the Area  Code and  the  complete  phone  #  including the  area code). Make sure the  attorney/lawyer  only  handles  FDCPA / Fair  Debt  Collection Practices  Act law. Those are  FEDERAL  laws  enacted  in the  1970's and  updated  subsequently to PROTECT  consumers  from such abuses. NEVER ever  say  any debt  is  yours: the  "collection agency/company" always  record  the calls  and  thry are  trained  to  trick  you into  saying  "yes" the  debt  is  yours. If  you  do  you're  screwing   yourself. Because  you  then  start  the  7  year statute of  limitations  and they  have  SEVEN years  to  try  and  get  money  you may /may not  owe. It  may NOT  be  your  debt,  the  collection agency/company  may  be  scammers trying to  con you out of  money,etc.

If she calls again demand she comply with 15 USC 1692 (Fair Debt Collection Practices Act) and send a debt validation notice via US Mail.  If she argues or refuses tell her she is in violation of Federal Law and you will be reporting them to your State Attorney General and the US Attorney for your district.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

The person calling by the name of Alexander keeps calling a school regarding legal documents for one of our teachers, however, they do not state which company is calling.  Our Teacher in reference stated that she does not know this person nor have they ever called her cell phone.

This is a business and we do not accept calls for anything of this nature.  All calls like this, regarding our staff, need to go to their home or cell phone numbers not their place of employment.

These people are IDIOTS, they claim to be  debt collector. They have called my husband's family, told them they were being served, etc. However, they will not provide proof to us on any of it. We refuse to give them any info until they can prove their claim to us. Do NOT give them any information. Ask them for proof in writing, they will start to yell at you and tell you you are being served on fradulant charges.

Dependent on state laws, creditors generally cannot garnish your state tax refund directly, and never without a court order. Excluding government debts and court orders, federal tax refunds are protected from garnishment. Additionally, the Fair Debt Collection Practices Act prohibits creditors from threatening to seize or garnish property or funds they are not legally entitled to claim. Report creditor harassment or violations to the Federal Trade Commission.

Seriously who would fall for this s***? These pukes have even gone as far as contacting my minor children telling them that I was in trouble and they were only trying to help me. There is a legal process to follow and they think they are above that. They call from an unknown number because they are bunch of shady losers. I have filed a police report with my local office but because they are out of state it makes it a little harder but I will find them and I will make sure that is the last time they call me or anyone else I know!
