OP = Original Poster.  And the OP didn't say she had payday loans.  A payday lender cannot "dock" your pay - wage garnishment cannot be undertaken unless the payday lender has actually taken the debtor to court and won a judgment against him/her.  I'm not sure of the legalities of when they can collect their collateral - a car, for example - if it's tied to your account.  As far as I'm aware, PD lenders can only take out regularly scheduled payments - this link gives information on what they can take out - http://www.consumerfinance.gov/askcfpb/1605/h ... on-account.html.  Also, this link is helpful - http://www.publicintegrity.org/2011/09/30/681 ... t-have-repay-it

OP means "Original Post" or "Original Poster" .  I'm not certain anyone here give you advice on actual payday or title loans which were legally obtained from licensed lenders.  There is a rash of criminals who are calling people to collect payday loans that they do not owe.  These criminals are falsely claiming to be police or "federal agents".  Anyone who ever calls you on the phone about a debt and says that is a con artist.

For docking pay, that would take a court order.  First, the creditor has to sue you in civil court and get a "judgement".  Then, there is normally a second hearing after the judgement to garnish one's pay.

First off, I'm old, what does OP mean?  Second, she did mention they were payday loans. Third, from what I have seen on tv or ads the pqyday loan is backed by your checking account or car title.  Can they not dock your pay or reposses the vehicle?  I have not had to do this but I have came close so any help is just for future reference.

There are no payment arrangement to be made here --- no need for them.  Debt is a civil matter, not a criminal matter.  No one is going to take her to jail for this.  Either this is a totally illegal collector, or a collector who is violating the FDCPA by threatening a consumer with jail

The OP may or may not respond since they would have to come back and read your post. The OP doesn't indicate that he or she even had a loan. Be advised the post from Shill Kill is spot on with his info! It would be of your best interest to read through the following:

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I am sorry this is happening to you.  He is a scammer, plain and simply.  Try to ignore him but not responding to the calls and he will move on.  As you probably know, debt is a civil matter, not a criminal matter.  No one can be put in jail even for a legitimate debt.
