It does need some correction. The correct phrase is "original creditor", and the OC is always out of the picture when its accounts are sold to a debt buyer. While junk debt is a huge business right now, I don't know of any statistics which tell us whether the collection industry traffics in more sold accounts or assigned accounts.

With the rest I don't see a serious problem, whereas the "malicious ... borderline illegal" remarks are from the "concerned" shill. Completely to pattern, they assume that all debts are voluntary, all debt claims are valid, and all alleged debtors are naturally hostile schemers.

Debt Collector
Just so everyone knows, this guy is using a new number and company name, 706-535-4065 and the name of the company is Money Investigations. He is a complete jerk. My husband asked for the address for his office so he could come in person to pay and the guy threatened to sue him for harrasing phone calls, he is the one who called us! My husband was never going to give him money, we just wanted to know where to send the cops, and after talking to him, he proceeded to call our friend and say extremely derogatory things about mu husband. Total douche!

HEY IDIOT..how come you dont tell the debtors that in most states a NSF check SOL is two years and after the SOL has passed you cant sue anybody..
you say be responsible and pay your bills, why is that you pay say 5.00 for a 50.00 NSF check and try to collect one thousand dollars and i bet most of the checks your trying to collect on is from the 1990,s or early 2000,s
did you tell the debtors that you have to be licensed to collect money,i know your not licensed in ny i type in ARI and it says no info,so if your not license your not allowed to collect if your license please give me your license number so i can check it out,the law says you have to give it upon demand.
stop the lies about being arrested..you cant arrest s##t..IDIOT..
bottom line your nothing but a lying low life sleazy debt collector,..RIGHT IDIOT..

Betty, pls do your homework and evaluate the facts and the source of the facts. Contact whomever yourself and find out if you owe the just due debt or not then make arragements to pay it. KEEP IT SIMPLE and don't believe everything you hear or see online. If you think the Internet is Gospel then you are sadly deceived. Best Regards, Due Diligence

Do tell - please explain where the "malicious, borderline illegal information" is that Jane is "slinging" in her post?

You clearly have no clue about how this site works and the types of people that post here.  Countless people post here who HAVE NO DEBT, yet get called by illegal debt collectors trying to collect money that is not owed.  THAT'S why many people come to this site - to report the numbers and tactics of these people, and to learn their rights under the law, such as the FDCPA.

You've missed the point.  Of course people should pay their debts but only to the company or entity that is owed.  Just because some moron calls you up saying you owe a debt, doesn't mean you actually do!  And when they get abusive and refuse to validate the debt when asked, they are clearly the scammers.  The problem is rooted in scam debt collectors that violate the law and try to collect bogus debt from people that do not owe!

Jane, are u actually deceiving yourself that bad?  All someone has to do is call, act decently and retain the information. Then verify the info and move forward. You are a real PRO debtor and have pleanty of malicious, almost borderline illegal information that you are slinging online. Just keep it simple....Verify the information given, Act decently when you contact the agent/agency, and most of all accept responsibility for your actions if in fact the debt is valid. Jane, you can't be serious about your tactics to discredit when everything is in black and white from your credit report to the courthouse. Stop accusing and making falsified statements when you would not even be on this site unless you were contacted in regards to a FAILURE of obligation !!

It seems to me that this is all about debt, bad checks, etc. Don't we Americans know how to take responsibility for our actions and at least make some type of payment arrangements w/ our creditors and certainly to the collection agencies who catch hell just dealing with multitudes of scammers each day? Let us stop making excuses and work out our problems in a responsible manner. Let us all stop writing checks that we cannot honor on closed, frozen, or non-existent accounts. Even our NSF'S can be dealt with before it reaches the outsourced agent 6-36 months later. Wow ! I think the problem is rooted and starts with those that do not take care of their financial obligations and use the internet and sites such as this for a scapegoat and revenge because the agent/agency has mentally placed them in position of ownership and liability.

My goodness, somebody needs a time out.  Mr. Hayes (surely not your real name) typing in all caps is the digital equivalent of yelling.  Most of you so-called "debt collectors" are private individuals who purchase junk debt then incorporate your name so as to call yourselves a legitimate debt collection agency.  Junk debt has usually be written off by the original debtor and you buy it for pennies on the dollar in the hopes of making a fast and most certainly furious, fortune.  Sometimes you succeed in accessing the actual debtor but more often than not you contact a relative or some unfortunate soul who happens to have the same last name or phone number as the original debtor.  You are anything but professional.  Take some business administration classes.  Learn how to deal with people and make a legitimate profit.  Cruel and outlandish yelling does little for your reputation as a professional.  As to those who owe money, times are hard.  Contact your original loan agency and try to negotiate with them before they sell your debt to such incorrigible, despicable people such as Mr. Hayes.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

We received a call from Mr. Hayes as well.  He was trying to reach one of our employees.  He is violent, abusive, provocative and this behavior was given to people who were actually trying to help him reach the proper person.  He is obviously disturbed, but it is still scary to hear his threats.  We are lodging a complaint with the FCC.  If enough people do this, maybe we can shut him down or shut him up for good.  Here's the address:  Federal Communications Commission, Consumer & Governmental Affairs Bureau, Consumer Complaints, 445 12th Street-SW, Washington, DC 20554

Mr. Hayes called to let me know that I had a debt that must be paid before a certain time or I was going to go to jail and loose my kids.  He refused to give me any type of proof that I even owed this money to anyone, telling me to do my homework.  I thought is right funny actually that he would continue to speak over me as I was asking him the simple questions that any person would ask if owed money for a debt.  However, I know that some people might really send him money and this is a SCAM!!!!!

I did call. I also called my attorney. And Mr. Hayes is a Junk Debt Collector. If anyone has a legal claim against you, tell them to sue you and you'll meet them in open court. If they can't even do that, ignore them. They're just blowing smoke up your a***. He's a telephone tough guy, nothing more.

If anyone has a legitimate claim against you, you will find that claim on your credit report. If it's not there, just hang up on them. If they can legally report your debt, Experian, Equifax & Trans Union will have your debt logged, who it's from, when it's from and who the Originating Lender is. Nobody should be afraid of a junk debt collector. Tell them to send you a letter "Verifying the Debt". If they don't, then ignore it. If they can't even meet you in open court and prove their case, piss on them. Just hang up the phone. It's a Hayes calling. Or is it a scumbag. Probably doesn't matter imho. Good luck.

To the horses a*** who tells people to pay their bills; We the People pay our bills better than the corporations do. We don't get a Bail Out every time we run out of money because we've been irresponsible. So stuff that in your crack pipe tough guy. This Mr. Hayes or Hayd, whatever's scratched upon the turd shingle over his Days Inn motel room office he crawls around in doesn't even have an office? Come on. He was asking for some Geneva lady, who just happened to have the same last name as mine. And then he asked me if I live in a certain town and he is correct, I do. Then I get home and there's his puss on my home phone again, after he's called my mothers' house already. There's one way to stop these criminals from terrorizing us; SUE THEIR A***S OFF. If you are debt free and you have no legal obligation to pay a debt or pay it any longer Per The Law, don't !! Just be prepared for these whale scrotum smegma cheese dicks to call you. And also be prepared to sue them for fair debt collection rules & regulation violations. They'll eventually end up paying you more than they pestered you for. Keep calling tough guy. My lawyer's writing it all down. And then, we'll go after the people who hired you too. I put scumbags like you behind bars each and every day. It's my job. What else you got, tough guy?

If he calls you again, ask them who they're collecting for. If they're licensed and legit, they know the rules. Tell them (if you don't have any legitimate outstanding debts) that you don't have any reason to receive any collection calls, you don't know the other person they're trying to get ahold of, you know they are a junk debt collector and not to call your house or anywhere else you frequent again if they do you'll turn them in and all the information over to your lawyer and local law-enforcement, pending legal action. - But of course, if you legally owe a debt, pay it off. Lots of places will work with you. - And by the way Mr. Hayd, my lawyer is standing by waiting for you to make a mistake. So go ahead. Make me rich.

Debt Collector
The rude pompous a** just called my moms house looking for Geneva. He knew who I was
And then knew what town I lived in and the entire time he showed his a**. I sir, know you know
Who I am. The last four numbers of the phone you called in NY is2644. I am debt free per The Law
and you bully ppl and try to scare them into paying what they do not Legally or don't owe anymore.
You're a Junk Debt Collector. If anyone owes another money, they will be able and willing to "Verify
The Debt". They won't because the debt they are collecting is outside the Statute of Limitations and
again, the limits of the law. Get a name, address and business address and send them a letter, telling
Them to Verify the Debt and they have 45 days to do so. Once you let them know you know the law
And won't be bullied, they will seek another victim. I have a lawyer on retainer and lock up crooks for a living. So go ahead and keep calling and talking tough. My relatives have been instructed to hang up on
You from now on. Bye bye
