Message was left on phone regarding a debt owed by me. Caller advised that I was to be arrested unless I contact them. Googled this number and found out that "caller" is located in Santa Ana, California!!! I'm in Norfolk, Va!! I am not at all comfortable with some stranger calling my number threatening to "arrest" me for some "alleged" debt! I called them back but they did not give ANY information!! He put me on hold AFTER I gave him my name, but never actually put the phone on hold. It was as if he was just sitting on the other end listening! How creepy is that? He continued to have me hold while he "searched" for something.....I finally hung up. He never called me back. He has a very heavy accent. Could not tell where he was from. This is very disturbing!

I received a call from this number, left a message saying that they were going to send the cops to have me arrested either at my home or at my job. Told me to call the number immediately, at the end of the call she said May God Bless your soul. SCAM

Lori 2013-10-27 00:57:25 Unknown
I got basically the same message. That someone would come to my homeplace or work place to arrest me. I told them to come on. I work at a federal institution that has our own police. They won't be arresting anyone where I work.
Tracey 2013-10-26 14:45:09 Unknown
I got the same call. They said they were from some law office and told me there were all these chages againt me for some loan I refused to pay. They even named companies, but I have not heard of any of them. I told her to send me proof of this and she said I would be getting papers delivered to my home the next day. I said ok sounds good. I will look at them and if I have done something wrong I would take care of it. I never recieved anything the next day at home or work. I never recieved anything in the days to follow either.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?
Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:
Misrepresent Him or Herself
A debt collector may not misrepresent himself as an attorney or law enforcement officer.
Use the Telephone to Annoy or Harass
A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.
Threaten Arrest or Lawsuit
A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.
Use Abusive or Threatening Language
A debt collector may no use abusive or profane language in the course of communication related to the debt.
Publish a Bad Debt List
Publishing the consumer?s name or address on a "bad debt" list is prohibited.
Contact By Embarrassing Media
A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.
Contact a Consumer at Work
A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
Seek Unjustifiable Amounts
A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.
Contact a Consumer Represented by an Attorney
A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.
Communicate With a Consumer After Receiving a Validation Request
If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.
Communicate With Third Parties
A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.
Bills.com FDCPA FAQ
Below are questions Bills.com readers ask frequently:
Can a Collection Agent Call My Cell Phone?
Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.
I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?
No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.
A Collector Says I Will Be Arrested if I Do Not Pay
This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

this is probably a scam -- woman left message that something? - could not understand - i think a debt - anyway was referred to her department and i had better call back at that number or i would be arrested. these are scams -- cannot be arrested for personal debt in USA -- this is not the 1600s in England. As i also understand it in texas where i live now you cannot have wages garnished for unsecured loans. as an fyi -- i had payday loans and got behind -- finally used a company in florida and they handled everything -- great job -- just google payday loan debt consolidation or similar and get help with these payday loans - there is a way out. They settled with 10 companies and i will have them paid back in about 2 years total. anyway -- this company warned me about scam calls from overseas that use america style phone numbers -- never talk to these people, they are scam - never give them your personal information if you do talk to them

Like numerous complaints above, these people called and left a message on my phone threatening to arrest me at my home or workplace because of a complaint filed against me. I called back, got no answer and was directed to a voice mailbox in which I could not understand a word this person said. Hung up without leaving a message, too. These people just suck...
Really? 2013-10-22 16:48:02 Unknown
You have nothing better to do than to call people and threaten them... Recorded voice of a woman, claiming that someone would be arrested... lol Get a life!!

Gunnar 2013-10-22 09:52:25 Unknown
Ignore her. She's just a low-life foreign fraud. Her threats prove it. Block her calls or simply let her go to voicemail to be with the other insignificant pests.
Live Well.

Jo Ann Carpenter 2013-10-21 02:02:15 Unknown
I receive a call from this number and the female left a message very similar to the above complaints. She sai this call was for (my name) and that I would be arrested at my home or office and to call her back immediately. I suppose from reading about it, it's a California number. I immediately knew it was a scam, but I would think reporting this to the state attorney general would get results. This is harrassment.
Cindy 2013-10-19 23:12:04 Unknown
Called saying I would be arrest for my work or home. Did not call her back. Do not remember her name if she left one.
not Michael 2013-10-19 18:34:14 Unknown

CALLING TELLING ME THEY HAVE A LAW SUIT AGAINST ME I KNOW NOTHING ABOUT THIS
JoAnne 2013-10-18 15:25:55 Unknown
I got a call from this number and the first part of the message was cut off so I didn't get a name or who they were with. But she did say that if I didn't call her back that I would be arrested at my home or my workplace. No matter who it is, if they threaten you like that, that's illegal. Any real company won't threaten!
