Keep getting daily calls from this numbner looking for someone named Carolyn.  I DONT KNOW ANY CAROLYN!!!  I've repeatedly asked them to stop calling, but they do it anyway.  This has been my cell phone number for 7 years.  This sounds like some kind of fraud attempt.

Second time from this number today - this time I answered. Had to say "hello" twice before man on other end started speaking. He asked for "Valerie", was very polite when told there was no one here by that name. End of conversation. Hope they do not become a nuisance.

Just called me.  It was a collector for Citi/Home Depot.  They worked out a payment arrangement with me for my delinquent account.  Did not ask for any "personal" information such as phone numbers/social security.  I wonder why I did not pick up the phone before.

The House Ways and Means Committee conducted a hearing recently and played this ABSURD and DISGRACEFUL tactic used by the CBE Group.

?During the rambling 10-minute call, a representative the CBE Group, a private debt collector out of Waterloo, Iowa, refused to give the taxpayer any information about whom the CBE Group was, or what the call was in reference to, other than that it was a ?business matter.?

The representative of CBE repeatedly asked the taxpayer for digits of his social security number, even resorting to asking for ?the middle two digits.? The taxpayer, rightfully concerned about identity theft and the evasiveness of the information being provided by the CBE representative, eventually gave up trying to figure out what the phone call was about and
hung up the phone.?

If you have been the subject of a CBE Group debt collection call that you believe violates the Fair Debt Act, please contact your nearest attorney and FILE A LAWSUIT AGAINST THEM.

A Des Moines bill collector who insulted and belittled people while demanding payments for their creditors has been fired.

Justin Saiz, 29, was a supervisor in the debt collection department of the CBE Group, a company that helps corporate clients, such as credit card companies, collect money from borrowers.

Saiz worked for the company from January 2005 through April of this year when he was fired for violating the federal consumer protection law known as the Fair Debt Collection Practices Act.

According to testimony at a recent public hearing dealing with Saiz?s request for unemployment benefits, his bosses had frequently asked him about his tactics in attempting to collect payments though telephone calls made to people owing mon

At a recent Congressional hearing:

Two IRS contracting firms, down from the three initially selected, have been making collection calls to thousands of taxpayers who owe less than $25,000 in taxes and have not disputed the debt. The firms, which keep up to 24% of what they recover, have collected nearly $20 million so far, IRS data show.

Highlighting the hearing testimony and exhibits was the recorded voice of an anonymous and clearly exasperated taxpayer who repeatedly rebuffed a private collector?s efforts to verify his Social Security number.

?I have been getting harassing phone calls from your company by people who refuse to leave their last names,? the man said to an employee of The CBE Group, one of the IRS contractors. ?It is incredibly annoying and frightening.?

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

No message just says missed call. I called them and they are looking for a Carolyn Echols. It cost me money each time they call and after three years, I am tired of this!

I have had this phone number since 12/2006 and have lost count as to how many messages and calls I receive from "collections" agency. I called this morning to verify and they are indeed looking for Carolyn!
