I know it is illegal to call their work and the way the caller kept calling back 2-3 times at a time....

Lisa from American Processors keeps calling me-with a private nuber saying I need to be served papers. I don't know for what, but they keep calling me leaving threating messages.  How do I get them to stop?

i am glad i googled and found this site. someone by the name of ronald wright called my job and told a coworker that he was trying to serve me with a summons. i do not know anything about this. he left a  case number and sd that i had to call him back. the number he called from is 1-714-88-3392. i just want this to stop

I received a BLOCKED call this afternoon from a "Process Server" that wanted to know if I was available between the hours of 8am & 4pm to be served.  I said no.  He proceeded to give me a contact number for Barry Bradshaw, 714-459-2931 (714-888-6884 is the same number).  I called and it is an answering service that handles multiple law firms.  I asked to be connected with Barry Bradshaw and I received his voicemail...big surprise.  The American Process Servers and Legal Asset Recovery may be legitimate, but this is illegal and a violation of our rights (Fair Debt Collection Practices Act).  If you have a debt, deal directly with who you may have the debt with or their collection agency, if applicable.  My advice is to tell Mr. Bradshaw (or whomever) to "go pound sand".

People, do you notice at least three business names were reported here within a few months? This is but one tactic of yet another lawbreaking debt collector with no proof of claim of any "hot check" or payday loan. Their tiresome threats of arrest, litigation, and asset seizure are all serious federal violations. They are generally not calling workplaces and relatives to "obtain location" but to create false shame, which is also illegal.

For all we know the whole outfit is operating from outside the U.S. like the scores of fake collectors reported on this site and elsewhere. If you do obtain a valid biz name and address, document every utterance and file suit! Your rights are being trampled.

I have also been getting a call about this and being told that I am being summoned to court and have no idea what is going on. the phone number they gave me to call back 714-882-3480 and they just put me to voicemail. They have been threatening to call my job and my financial institution also the date they said I received a payday loan that I didnt even apply for sounds like a scam to me

One of my MANAGERS came to me and said that I needed to call LISA MARTIN at 714-882-3480 (same name/different number than before). When I called they said that Lisa was out on vacation for the week...HOW??? If she just called?!?! The guy I talked with said that it was the processors that called and not them. Seems the info they have on me is legit, but then pretty much told me I was screwed if they made attempts to serve me and couldn't get me. If they have my address, how hard is it to serve me?!?! Then when I proceeded to fuss at him about calling my J-O-B and telling someone else my business he got mad at me and hung up. I called back and he proceeds to tell me that I'm harassing them?!?!?!  Oh and he wouldn't give me an address for STONE & ASSOC. I'm glad I decided to look this up because I've been getting those harassing Indian callers, and I decided to look up Stone & Assoc just so I could get an address...came across this site! Scare tactics INDEED, but I will go to court and fight for sure!!

i just got a phone call from them twice saying that they tried to deliver me a summons at my job. not even at my house at my place of work. i tried to call barry bradshaw back and i got a rude guy on the phone saying that he cannot tell me what my summons is even about and transfered me to h is voicemail i didnt leave a message. i tried to call again and no answer once again. some lady called on the telephone asking for me i answered she said i needed to call him or get servered my summons. i said i will not tell you my place of work and that i just had tried to call him and no answer. she told me that barry had just emailed her and that it was odd that he didnt answer. i gave them my cell phone number and i have yet to recieve a phone call from him. i told them to stop calling my job it could get me fired.

Hi Julie, I received the exact same voicemail message today.  I was told to contact David Phelphs at 714-882-3480 ext 120.  Looks like the they are changing the telephone number but playing the same game.  I am so glad that I googled the name too and that you posted the new number they are using.  It is not uncommon for these scam artists to change their number frequently.

Received call from American Process Servers - Voicemail left stating that they were trying to serve me a summons to appear in court and this was the third and final time they would try to reach me.  That if I did NOT call them back right away, I would be receiving "non-compliance" or "failure to appear".  I was told to contact a Fred Fitzgerald 714-882-3480.  Looks like different names / numbers than what I see mentioned above, however - when googling his name and number, this site pulled up and sounds like exactly the same thing.

Prohibited conduct

The Act prohibits certain types of "abusive and deceptive" conduct when attempting to collect debts, including the following:

   * Hours for phone contact: contacting consumers by telephone outside of the hours of 8:00 a.m. to 9:00 p.m. local time[8]
   * Failure to cease communication upon request: communicating with consumers in any way (other than litigation) after receiving written notice that said consumer wishes no further communication or refuses to pay the alleged debt, with certain exceptions, including advising that collection efforts are being terminated or that the collector intends to file a lawsuit or pursue other remedies where permitted[9]
   * Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously: with intent to annoy, abuse, or harass any person at the called number.[10]
   * Communicating with consumers at their place of employment after having been advised that this is unacceptable or prohibited by the employer[11]
   * Contacting consumer known to be represented by an attorney[12]
   * Communicating with consumer after request for validation has been made: communicating with the consumer or the pursuing collection efforts by the debt collector after receipt of a consumer's written request for verification of a debt made within the 30 day validation period (or for the name and address of the original creditor on a debt) and before the debt collector mails the consumer the requested verification or original creditor's name and address[13]
   * Misrepresentation or deceit: misrepresenting the debt or using deception to collect the debt, including a debt collector's misrepresentation that he or she is an attorney or law enforcement officer[14]
   * Publishing the consumer's name or address on a "bad debt" list[15]
   * Seeking unjustified amounts, which would include demanding any amounts not permitted under an applicable contract or as provided under applicable law[16]
   * Threatening arrest or legal action that is either not permitted or not actually contemplated[14]
   * Abusive or profane language used in the course of communication related to the debt[10]
   * Communication with third parties: revealing or discussing the nature of debts with third parties (other than the consumer's spouse or attorney)[17] (Collection agencies are allowed to contact neighbors or co-workers but only to obtain location information;[18] disreputable agencies often harass debtors with a "block party" or "office party" where they contact multiple neighbors or co-workers telling them they need to reach the debtor on an urgent matter.[19])
   * Contact by embarrassing media, such as communicating with a consumer regarding a debt by post card, or using any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram, except that a debt collector may use his business name if such name does not indicate that he is in the debt collection business[20][21]
   * Reporting false information on a consumer's credit report or threatening to do so in the process of collection[22

I am so glad I googled and found this site. I just had the same thing happen to me this morning. Someone from American Process Servers called me at work and said they had been hired by this Barry Bradshaw character to serve me a summons to appear in court. Then they gave me a number to call him back at 714-888-3392. Called and got nothing but voicemail.....this can't possibly be right. Can't something be done about this type of thing? This has had me stressed all morning and of course they never showed up!

Caller left a message saying they needed to serve papers to my residence and left a bogus case number and an "attorneys" office. I have read about this before and it is an illegal bill collecting maneuver. When entered into google, there is no listing for the number. If it were a legitimate attorney, it would show up.

OK so I've been harassed by these idiots for a few weeks now.. What i don't get is that I've updated my address with them, TWICE, & they cant seem to reach me? They call my job every other day, informing them im being issued a summons.. That is defiantly NOT COOL!! Im sure this is a scam as i felt it was from the beginning.. What also gets me is that the number they call me from is BLOCKED.. And the address they have "on file" is my OLD address.. OF COURSE I'm not home to get it!! Stupids!!

Received a message asking to call this number, I did and they do not tell you who they are, what it is in reference to.  They said this was a civil matter.  (?)  Okay I never heard, received anything until this phone call.  Sounds extremely suspicious.

I got a called at my moms house and my 16 yr old nephew answer and a Lisa Martin talk to him.  She told him that she was taking me to court (mind you he's only 16) and I had until 10am the next business morning to call her back before she appear in court.  Two years ago, these same ppl done the same thing to me, I comply pay them, and call back for a reference number once i got down to the last payment, and the number was change.  After that, I moved, change my number, and vow to never do that again.  It is creepy and they do try to scare you in the worse way.  Stick to your guns ppl.  These pple have game.  Deal with the bill collector yourselves if you can.  Good Luck...

Saying they were suing me, he was Steven Steinwicke from finalization department, he was sending this out to the judge and since i say it is fraud, he is going to file a police report himself and if i am lying, i will be charge with filing a false police report, etc...threatening me with non compliance and failure to appear...I mean, come on...I told him it is fraud, I am going to report it to the credit bureaus and he continued to freak out ....freaking me out
