Today I had a voice mail from someone claiming to be Steven Graham re: serving a summons.  The SAME PERSON called my spouse and gave his name as Michael Adgate - same name mentioned in an above post -. What a bunch of frauds.  They called me about a year ago with the same bull. I called them back to see what it was all about and was yelled and screamed at and finally hung up on, all by a supposed "supervisor". Never received any paperwork and no court documents were ever filed per the Clerk of Courts in the county they tried to use to threaten me. Nice try, but no dice.

They called me from 716--312-4122 and now the number has been disconnected. The man said his name was Adgate and there was going to be a warrant for my arrest if I didn't make payment arrangements with him that day. I tried to call him back to get more information but
as I said it is disconnected. So much for honesty .

I just got a phone call from "Jeff" and his senior advisor, "Michael Peacock".  Same thing...they had my social security number and DOB and said I was going to be served legal documents this afternoon in regards to some bank fraud.  They are using company name, International Asset Group, aka IAG.  They have a website where they "allow" you to conveniently go online to pay your debt so you won't be served papers.  Don't fall for scam.

Jacob Wallace of the law offices of Brewer, Michaels and Kane called to say he had information and SS # on my son (who has not lived with us for many years).  He said this was some sort of fraud case and gave a case #.  This is a fraud. The phone number of 1-888-774-1338 was given as a return #.  This number does not come up when googled as an active number.

David Ross of the law offices of Brewer, Michaels and Kane called to say he had some information and SS number on my daughter (who does not live with us) and even used her maiden name when she's been married for years.  Said it was some sort of fraud case and had a case #22157CV135.  I'm sure this is just a scam.

@indefense Its companies , and representatives, like you who give the collection agencies a bad name. Everyone hit financial walls, and we(consumers) are responsible for our debts that are in the staue of limitations. However if you harrass, and use illegal tactics that are not incompliance i.e scavenger debt collection. Coolection  agencies in The Ny area deserve any , and all punishment from the attorney general, and FTC.

All of you people that are complaining about collection agencies calling you, what did you guys think would happen if you borrowed money from an institution and didnt pay them back? Of course you will get collection calls you owe the money and they are going to find you to pay it back. Maybe if you didnt avoid calls all the time they wouldnt have to take further action to reach you. This business is obviously very sucessful. Maybe if all of you debtors paid back your loans there wouldnt be so many collection agencies. Its so easy to call out everyone elses flaws but look at yourself 1st. All of this business starts with you people that dont pay your bills. Regardless of your profession ( cop ) or whatever doesnt give you a right to hide from calls or repaying your debts. The only scam going on here is people borrowing money and not paying it back incase you havent heard that is stealing. thou shall not steal!!! U dirty debtors need to pay your bill and quit looking for a quick pay day!!

ALBANY, N.Y. (June 2, 2009) - Attorney General Andrew M. Cuomo today announced that his office has reached an agreement with three New York debt collection companies that failed to adequately supervise employees who engaged in deceptive and fraudulent methods to collect debts.

The three companies, Creditors Interchange Receivable Management, LLC, Capital Management Services, LP and Tri-Financial, LLC, have agreed to substantially reform their business practices in order to be in full compliance with the Federal Fair Debt Collection Practices Act and New York?s Debt Collection Procedures Act. The companies, which are based in Western New York but do business across the country, are also paying $245,000 to the state in penalties and costs.

?We will continue to investigate the myriad deceptive practices that debt collection companies, debt settlement companies and others employ as a means to exploit consumers who are already down on their luck,? said Attorney General Cuomo. ?These three companies have agreed to immediately stop these practices and reform their policies to ensure their collectors comply with both state and federal law. I call on other companies engaged in the business of debt to do the same.?

According to complaints received by the Attorney General?s Office, collectors at the three companies employed fraudulent tactics in an attempt to collect debts, including:

Contacting alleged debtors without a lawful justification for doing so and even after being asked in writing to cease all communication
Contacting consumers at their places of employment even though the collectors were aware that such contact was prohibited by the consumers? employers
Discussing consumers? debts with third parties (i.e. employers, neighbors, etc.), and doing so even after the third party told the company to cease such communications
Falsely claiming that the company was acting on behalf of an attorney and that the company or a creditor was about to commence legal action against the consumer
Failing to respond to consumers requests for debt verification
Under separate settlements with Attorney General Cuomo?s Office, the three companies have agreed to enhance their compliance protocols and make it easier for consumers to file complaints against individual collectors. All three companies must create a direct link on their respective Web sites to consumer complaint forms. The companies must also maintain an employee disciplinary history database, as well as a comprehensive database of all complaints made by consumers or third parties who were wrongly contacted by collectors.

For the violations, each company must pay penalties and costs to the state.

Tactics prohibited by both the federal Fair Debt Collection Practices Act, the New York State debt collection and consumer protection laws include: posing as an attorney, threatening lawsuits or other legal action which cannot be taken, saying a consumer committed a crime or will be arrested and talking with third parties except to get location information. The law further requires collection agencies to send a written notice within five days of initial communication with the consumer explaining how he or she can dispute the debt. If properly disputed, the collection agency must stop all collection attempts and send verification.

The settlements announced today are part of a larger investigation by Attorney General Cuomo into unlawful debt collection practices. Last week, Attorney General Cuomo subpoenaed nearly twenty companies and law firms operating as debt collectors throughout the state. His office also shut down two collectors for threatening and intimidating consumers into paying debts that they did not owe. In early May, Attorney General Cuomo announced a lawsuit against two debt settlement companies for fraudulent business practices and false advertising by selling misleading debt settlement plans that very rarely deliver the promised benefits to consumers dealing with debt.

Cuomo also launched a website - www.NYDebtHelp.com - that explains consumer rights, allows victims of debt settlement companies quick access to the Attorney General?s office to file complaints, and outlines the stages of the Attorney General?s investigation. These three cases were handled by Assistant Attorney General Dennis Rosen and Senior Consumer Frauds Representative Karen Davis under the supervision of Deputy Attorney General for Regional Affairs David Sampson and Assistant Attorney General in Charge of the Buffalo Regional Office Russell Ippolito.

We've been receiving calls to a cell from this number and other numbers for over 5 years asking for a "Mike Peacock". They refuse to identify themselves. We've repeatedly told them we never heard of such a person, and that the number must have been someeone elses before being assigned to us by Verizon Wirelass. The callers are very belligerent. We've been forced to call Verizon Wireless several times to request the calling number to be blocked. They do it, but only after acting very surprised and helpless. This whole thing stinks! No legitimate collection agency could afford to make so many fruitless "live" repeat calls over so many years. There's some kind of a scam going on here that the authorities have not, or will not, figure out.

Said I owed $754.00 collection from a check cashing place....please!!! They were rude and couldn't even get their stuff together. When I told them that this debt was impossible, they implied that I had been a victim of identity theft and to go to local police dept. and fill out report and send to them. How dumd do they think I am??? Send them a police report w/ my S.S.#, Drivers liscense#, and address???? I think not!! Joke is on those a***oles!!

I JUST RECIEVED A CALL FROM THE TRI-FIANANCIAL STATING THERE WAS A POSSIBLE WIRE FRAUD ON MY BEHALF AND I NEED TO CALL THEM IMMEDIATELY.  THIS IS A TOTAL BLATENT LIE WHEN I CALLED THEY WERE RUDE AND WERE CALLING ABOUT A DEBT THAT I OWED AND THEY MISREPRSENTED THEIRSELVES.  THEY EVEN CALLED MY JOB AND LEFT A MESSAGE WHICH IS AGAINST COMPANY POLICY.

I just filed an FTC complaint against these guys- misrepresented themselves as attorneys, sent me false documentation, said I owed on a debt that I have already paid off. I hope others do the same to help get it to class action status. Also appear to have obtained my personal info like SS#, private phone 3.

They did exactly the same thing to me repeatedly i reported them to the FTC Federal Trade Commission if everyone does they will be investigated prosecuted..

Not sure how they found a unlisted cell number, but a Mr. Kristen called and left a message about his company CVS is filing title 15 against the person they are trying to contact.  Then proceded to say this was from Louisiana...they called from New York, can we say ...clueless, they are not licensed to collect let alone not licensed to collect in my state!

Here we go again?another slimy, illegal bottom feeder operation has popped up in Buffalo, NY trying to collect on old, worthless, out of statute debts. Owner Jamie P. Belstadt, a retread of the collection business is trying to collect on debts that are 8+ years old. The documents we saw appear to have been produced by a second grader.

John D. Yim, 36, of North Tonawanda, NY, Vice President of another junk debt buyer called CNE Associates; LLC is churning out the phony documents. Vision Credit Solutions, LLC and CNE Associates, LLC show NOT to have any debt collection license or Surety Bond in any state we checked.

In his phony paperwork, collector Yim refers to the consumer as a ?defendant? which appears to violate federal law. His ridiculous form would be better suited as toilet paper than anything worthy of validity. It is pure garbage, nothing he states is true, he makes statements that false, misleading and appear to violate federal law, the Fair Debt Collection Practices Act.

All of these bogus organizations are nothing more than smoke and mirrors to intimidate, harass, lie and mislead consumers into thinking they owe money on worthless accounts. This is typical ?Buffalo Style? debt collections that we?ve seen dozens of times.

These organizations are operating illegally, the accounts have no validity, and the statements they make are false, misleading and ripe with lies. John D. Yim has no idea of what he is doing; Vision Credit (started April 2008) and owner Jamie P. This company Tri Financial has been calling for an employee at my business.  I have explained that there are no personal calls and that I would give the employee the message.  They are very rude and go on to tell me this is a legal matter, I told them it doesn't matter to me this is a place of business and the employee can call them back on his own time.  They continue to call back everyday and continue to tell them the same thing.  How do I get them to stop calling?
