I received a call from PCS at work today stating that I owed a debt to a payday loan company. This debt was from 2009 and was paid off over a  year ago. She was very threatening and then began setting up a payment agreement. While she was speaking I logged into my online account with this payday loan company. It showed that this loan was paid in full and that this was the only loan I ever had with them. They also stated that the account number and original loan amount given to me by PCS did not exist and that my state only allowed $500 or less in loans (they amount they gave me was over $1k). The payday loan company actually told me that this sounds very wrong and I should beware as I do not owe them anything. I immediately contacted PCS back and the women became very hostile. I told her that I would not be paying this as it was paid in full and that I would like a copy of the court paperwork for this so called case (she said she had a judgment from a court to garnish 100% of my wages - this is illegal - depending on which state you reside, only a maximum percent of your income can be garnished AFTER a judge signs off on a judgment to issue your employer a garnishment) to file a response to the court and show that the debt is paid. Again, I was never served, never got anything in the mail, never was contacted by this company before today and yet they magically ALREADY have a judgment against me? She stated that she could not get me that info b/c she did not handle my account but could have someone call me. No word from her again.

this guy named Calvin Johnson called me 4 months ago trying to give me a payday loan, which I declined because I don't obviously need one. He wanted to give me 3000 by going to CVS and buying a prepaid card to load my first payment on, and once it went through he'd wire me the money. HA. thanks but no thanks. now the SAME guy called me 2 weeks ago claiming to be from state investigations, and when i returned the missed call, they knew it was me returning the call (any legitimate conpany you follow prompts and identify yourself first) and told me that they filed a suit against me for fraud because they gave me money and i never paid it back--meanwhile i never dealt with them nor any payday company!!! he didnt tell me at first what it was--but right off the bat tells me to give my account number and routing number to settle this matter, which i obviously denied because i never dealt with them nor do i owe debts like that. now he left me a voicemail last week saying that there's an affidavit against my social security number and the local police are coming to arrest me. and now today he needs my lawyer. it's hilarious that he thinks that he can con me to pay money that I never even owed, and to try to scare me by saying I'm getting arrested.

is there anything I can do to retaliate against them? they're arrogant, nasty, and flat out liars. I can understand if I took a loan through them, but I never did and had politely declined their offer. now they won't leave me alone!!!!

I received a phone call from a "fraud investigator" with a local phone number. I called back to talk to the aforementioned "fraud investigator" and much to my surprise (not really) they don't have a fraud investigator. 716-240-6281 was "the direct line to his desk." Those of you who owe money, pay the business directly. Don't deal with these people. They are obviously liars and from my brief dealings with them, I would infer that they are also crooks.

You might want to invest in a call blocking device, amazon has a nice selection under 60, there's phones out also now with call blocking..

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

He was very rude and persistent I have never actually talked to him he keeps leaving voicemails on my phone  but in the vm he is threatening me to call him back before he takes legal action.. What a joke I owe no debt to PCS & Associates nor do I have any kind of payday loan... DO NOT GIVE THIS COMPANY ANY BANK INFO OR CREDIT CARD INFO

I got a call from an Adam Smith with a very strong Indian ancient. He called and asked to speak to someone I know does not work for our company and he go upset and said enjoy my 1,000 calls and hung up. And he literally called 91 times when we threatend to get the police involved, since he said this person committed a crime he stated that we were wasting his time and money and he hung up and continued to call when we told him to talk to the police who were here by then he hung up and has not called back since.

I got a call today from Veronica about a IMPACT Loan, I don't have one.  She told me i have two weeks to pay this account in full or she will file a pending claim with Mchenry County Courts.  i don't live in Mchenry County.  This is the fifth time in two months that she has threatened to take me to court.  Guess what I have an atterney who is sueing another debt collector, and this one will be next.  It is a Fraud.  They are trying to scare you into paying.  Not me.

Another number they use is 716-240-8045.  She calls me all the time too to collect on a debt and has the same threatening messages.  Well there is something you can do about it.  Sue them.  They are breaking the law with the threats.  I know first hand and so far I have sued Three debt collectors for misuse of the law.  I am a single parent and working on getting my debt corrected.  But like you said, don't let them bully you around.  I did and now i am standing up for my rights as a tax payer for this country.

They can't arrest people for not paying a loan. Sue them, yes. But nobody goes to jail for being overdue on a pay day loan,credit card or a mortgage."



Here's what they tell you: "This is different. You wrote a bad check" (if you gave a post-dated check). Or, "You committed bank fraud" (if you authorized a transfer from an account that had insufficient funds).

At the time the payday loan company accepted your post-dated check or future bank account withdrawal, they knew you didn't have those funds in your account. Duh. That's the whole point.


And how are they going to prove you didn't plan to have the money in your account later? Unless you were planning not to repay from the very start and they can prove it, they wouldn't stand a chance prosecuting you for a bad check. They know it. You haven't committed any crime. The cops wouldn't care.


If you want to eavesdrop on what would probably happen if they tried to get a cop to arrest you, here ya go. A fellow who works in a county office asks, what do you do when these payday loan companies come in, wanting us to prosecute people for bad checks? And most of the other counties tell him, we just ignore them. We don't like 'em anyway.



But it might get even better for you.

Payday loan companies are regulated in most states. Figure out which state laws apply to you. If you got the payday loan at a storefront business in the same state you live in, obviously the laws of your state apply. If you got a loan online, it might be the laws of the state the company is in, or the laws of your state, so check both.

Then look up the state laws written in plain language at this site. Another source of payday loan laws in each state is here. The laws might not be totally up-to-date, and the legal language is hard to wade through, but try looking for words like "criminal" or "prosecuted" and see if there's an actual specific prohibition against criminal charges.



For example, in Arizona, the law actually says: An individual who issues a personal check to a payday loan place is not subject to criminal prosecution. In Kentucky, every payday loan place has to actually post a sign that says nobody will be prosecuted or convicted of writing cold checks or of theft by deception.

If you're really lucky, you might even find out that out-of-state internet loans are illegal in your state, and the company was breaking the law by loaning you the money in the first place.


But here's the bottom line: Don't let collectors bully you. Find out the law. You're not going to find any cops knocking on your door.
You're not going to jail.



That doesn't mean you can just forget about paying back the loan. You do owe the money, and they can probably sue you in civil court, add a bunch of costs and fees and interest, garnish your wages or put a lien on your property. You don't want that. Talk to them before it gets that far. Try this, if it's not to late. Or see if you can get another loan, or borrow money someplace else to pay it back, or do anything you can rather than default.



But don't let them scare you. You're not going to jail.

And yes, you may know somebody
who's actually been arrested for that.
"Geez," you think, "This is bad."

But it's not. Heck, they might even be

the ones breaking the law.

I'm not a lawyer (thank god), but this is
how I understand it. To find you guilty
of writing a bad check, the prosecutor needs to prove that you intended to write a bad check and that the company accepting the check didn't know there were no funds.

and it would be a civil matter

I too got a v-mail from a "Veronica" which more then likely is not her real name.  This so called business also traces back to the UK, so now I really know that theres something really fishy going on.  DO NOT NEGOTIATE WITH THIS VERONICA.  If this is truely a large business law firm then why is there only one person making these calls?

I have received messages as well, the numbers I have are 347*327-*6497 and 323*432*8769 and they say they are from PCS Legal Services, they leave very threatening messages on my voice mail such as, if you do not call within 5 minutes, we can't help you and will call the Attorney General and have you arrested.  I unfortunately have fallen for this twice and paid the bill they said I owed, only to have them call again and tell me the same thing, I have been tracking the calls and the debt that they say I owe and guess what, it always the the same debt.  Don't be stupid like I was, tell them to go to hell.

I have the same company calling me and threatening me, I unfortunately did have an outstanding payday loan, and they even named the company, I paid it and now they keep calling me and telling me the same thing only I get a Shawn Davis, Eric Masters, and a whole lot of other names.  I have contacted my local authorities and filed a complaint, when investigated, all the numbers that the give are thru Happy Jack and cannot be traced and they are out of the country. DO NOT PAY THEM.

SCOTT; This lady called me and she said she had nothing on her records on me, but since she left a voice mail, i had to know someone else that owed money. big scam if you ask me and i told veronica in not so much good words-she was a fake and hung up on her. she called be back and left a nasty msg and i called her right back and told her she does not know who she is messing with. also told her that i have turned her number over to the FBI and she said big deal! i told her when they shut you down, you will know its  a big deal! have not heard from her since last week. beware! scam artists!

I have gotten calls from this number over the past couple of days saying that my wife took out a payday loan in April of 2007.  This is 2011!  Veronica said that the loan was not paid back and that her client wants his money paid in full, if not they will call the state attorney's office in our area and file charges against my wife.  This is called PCS legal Services. i asked for information on this matter and was told they it would be sent via e-mail.  My wife said that she paid this debt off.  Veronica has been very nice on the phone. Kinda woundering now if this is a real company or just a scam to get money!!  Can anyone help me with this?

Just called again I told her it was illegal for her to call after 8pm she told she could do what ever she wanted to collect a debit from a dead beat like me. I asked her who she was calling she Said DeMarcus Sharp In regards to a payday loan case # 1121-61

She really went ballistic when I told her he was not here and did not live here and that I have had this same phone number for over 25 yrs.

These people keep calling and asking Demarcus Sharp.....Veronica PCS Legal Services. They are now threatening legal action in San Diego County, wage garnishment etc. etc. They have called everyday for the past 2 weeks. They called a couple of months ago and called me every name in the book and some I have not heard before when I told her that the person they are looking for doesn't live and has never lived here and the person is not even known here.

These people call everyday of the week except Sunday. between 9:15 AM and 1:30 PM. They go thru their message then they demand and ask for a person named Damarcus Sharp, says her name is Veronica with PCS legal Services.
Says that they need a return phone call from this Mr. Sharp or a Lawyer representing him in regards to pending legal actions in San Diego County he has 24 hrs to call them back.

I answered the telephone this morning when they called.....I told the lady that there was no one by that name at this phone number. She did everything short of calling me a carpetbagger, flimflam man and a liar.

this lady named Veronica keeps calling harassing me. Tries to threaten me by saying she has filed civil actions against me and that she is a lawyer saying that she knows the law. Apparently she doesn't know the law. she's a fraud. she won't get no action out of me!!!!  Then when I tried to tell her my rights she said that she is filing misdemenor criminal charges, as her way of trying to intimidate me and others. When I tried to express my views she over talked me and was rude and wouldn't listen.  Come to find out that Veronica is independently employed, her company is not a real company.  She says she works to collect debts independently.  She is not a lawyer and she is not calling from a real business.  I had a friend pretend to be a concerning person and asked Veronica what kind of business she worked at and she stated that it wasn't an actual business, and that she worked independently.

Has been calling my phone for the last few weeks.  Won't give me any type of information at all, when I asked them to send me something in the mail they refused to send it and instead sent an email.  Veronica tries to give back attitude when you give her one or ask for  information. Filed a complaint with FTC, hopefully something can be done about this.

"Veronica" keeps calling me and said that she is a lawyer and threatening me about a lawsuit that I have no clue about.  I know I didn't do anything wrong and I didn't get any loan so I never returned the call. She is harassing me and its soooo ridiculous!!!! Can anyone tell me what to do about this???
