The FDCPA has a very low bar for debt validation. All you need to say is three things:

1) This debt is in dispute.

2) Please send validation.

3) All calls to all phone numbers at all times are inconvenient.

Close with your typed, not handwritten name, and give them your correct mailing address.

The FDCPA uses "inconvenient" as the criterion for when debt collectors can't call--so that word is VERY important.

As for all the threats, unless you attach a completed petition to your local court, they'll just laugh. Can you imagine how many times a day someone threatens to sue these losers?

Heh. Called my cell. They do not have permission. That's illegal. FDCPA says must have EXPLICIT permission to call a cell. Meaning, permission given directly to them. I didn't even know who the heck they were.

BTW: this is for a debt that a)belongs to my son and b)was out of the Statute of Limitations for collection 6 months ago. Even if I did nothing, it would have to fall off my credit report (I cosigned) a year from today.

They have sent me a letter, so I'll just send them a nice FOAD letter in return. If they decide to sue, I'll win, as you can try to collect on a SOL debt, but you CANNOT sue.

For those who are dealing with collectors for various reasons, and don't like listening to your phone ringing all day long, the simplest solution is to get a new phone number. The BEST, though, is to pick up the phone, tell the nice person that (USE THIS LANGUAGE) "All calls to all phone numbers at all times are inconvenient."

If they have sent you a collections letter, write them back, tell them that it's in dispute that that you require verification of the debt. Add the "All calls...." language. No matter what else you do, ANSWER THE LETTER. If you don't, they can go straight to suing you. That's how I learned all this: I got sued.

The FDCPA allows you to sue THEM for unfair collection practices. If they are calling a cell, and using an autodialer, BONUS! The TCPA has some pretty strict rules.

All this, beyond changing your number, requires the strength to talk back, to learn about the laws, to either find an attorney who'll take your case on a percentage basis, or to learn enough about the laws to represent yourself.

You can win, too, if you spend enough time learning about the laws. I won against a junk debt buyer. Was scared silly, but I won.

Not true- my son opened a account for storage and listed me as a alternate contact person with my name address and phone number only-several yrs later he lost the storage and the storage company turned his balance over to their collection agency- that 1 yr later sold the bill to a third party collections agency- that erronously reported me to all three credit companies and listed "joint acc holder{ once I was denied credit I found this information out and now I have to do the leg work and prove I did not sign anything and my name was on the file to be notified as a alternate contact person. My issue with the credit companies is how any company can legally put a negative mark on r credit without any proof and they do not have to have your social security number either. Once I get this off my report I plan to sue

I keep on getting calls from these people, one particular--Mr. Millard.  Just got a phone call from him at1126AM CST saying that he was calling about an application that I had put in and that he has had it since January 2012.  Of course, I acted like I was my sister and took a message. MMMMMM...last time I checked, I put the app in with Sallie Mae, not them, and the app was put in several years ago. If these people would learn to have more tact...I understand that they are just doing their job, but don't call my job trying to get money out of me.  YOU CAN NOT SQUEEZE BLOOD OUT OF A DEAD TURNIP!!!!  And then on top of that, I AM STILL IN SCHOOL!!!!  Hello people...just leave me alone and I'll deal with Sallie Mae and not a freaking collection agency!!

Got a call from 716-250-4800 but in the VM, the man says to call back an 888 number with an extension. That's kind-of shady! Anyways, was calling MY cell phone about a relative. That's just creepy! Caller did not leave the name of the company or the reason why he was calling, just said he was "Zack" and to call him back.

Left message initially and I called back to speak to someone which was impossible. I left a message inquiring about the debt itself and told them that I do not deal with 3rd parties on debt resolution.  They continue to call me.

The best way to deal with hang ups,robo calls or 'this is an important message please stay on the line" than you wait. Well when someone finally comes on the line tell them you thought it was the "phone sex" folks. Then go on to tell them in very descriptive terms . Or start asking them questions like "how big are your ____?" Or "how big is your ____" ask if shaved or what . the calls stop real fast.

       You act like a teenager. You cry when you don't get your way! You use insult to cloud your responce. Sure you make points that have fact. I'm the one who took down CAMCO. Google it. When on gets tired of your tactics one pounces on his prey! Last Year. I went to court over a medical bill that I paid. I did not to the letters or phone calls to my home. In court I showed the Judge the paid bill. There was a seven day grace period asked for by the plaintiffs Lawyer. He tried to argue a recording they made of a phone call they placed to my 87yr old Dads house. Dad said "These people keep calling me to talk to you".... I was not very polite! Judge dismissed the plantiffs case. I then counter sued.. Awarded $20,000! After 3 months they finaly paid! Jeff bold talk! Hard to get you folks to pay your debts!

Yes!! These people are soo rude! This lady calls my office all the time, and asks to speak to the Dr. I work for. He's always with pts, and she gets so offended and mad at me! Some woman called, I ask her to identify herself multiple times, and she just kept repeating her name.  I figured it was some bogus charity and said, "DO NOT CALL" again please.  I am keeping a record of some of these numbers, and forwarding them to the State and Federal Attorney Generals.  Have a nice day is usually the way I close the call.

There is only one way to deal with motherf*ckers who play this game: play it right back at them. Use different voices. Deny you are who they are looking for. If they persist, tell them that the person they are looking for has died, or relocated, or is missing in the Amazon. Better yet, tell them that they became an astronaut and are currently on the space station - and just as soon as they get back they will be happy to call them back.

If they keep calling, go to a store and purchase a large dog whistle - or, if you can, an air horn. Wait for their call. Get on, act like you are the person they are looking for. Then, hold the whistle/air horn up to the phone and BLOW.

Repeat as often as possible. Perhaps if we can make enough people in this sc*mbag industry go deaf, the better off all of us will be.

Try all of this - you will not only get these creepos confused and upset trying to find who they are looking for, or you will deafen them, but you will also get a few laughs at how much you have ruined their day and improved your own. It works - take my word for it.

There are back at it!  If you do owe money to some outfit, contact that place of business, and settle debt with them. the company that keeps calling you HAS to produce records of the Debt, which they probably do not have, No records, No debt.  But I am NOT a Lawyer, so feel free to check with your local Lawyer.

Number comes in to my mother's house for the EX Wife of a guy who rented a room from my mother about  5 years ago. Have no idea how they got this number other than the address was forwarded for this guy to her house when he left his apartment and moved here. They probably did a reverse address search to get the phone number. Either way, they have been told that she only met the ex wife once and that he is at work as far we all know. My mother is 86 years old so, she sure doesn't need this mess. Trying to find the guy to let him know. Then going to talk to a lawyer about getting the calls to my mother's number stopped.
