Yes, to get them to stop, find out what bill YOU NEED TO PAY, research it, since they are OBVIOUSLY a third party that has the right to collect the debt now since you DIDN"T PAY the original person/group you were supposed to pay. SO PAY YOUR BILL!!!!

My Caller ID showed "Elite Recovery" w/716-270-2217 phone # - on 11/05/2007, no message left.  Then on 11/08/2007 caller stated there name (inaudible) and that it was the IRS calling.  This phone was 877-702-7876
Gave an extention (2043) and a reference #.  What!!??  I've never known the IRS to use a collection agency!!  Sounds fishy to me

Caller called my business and asked for an individual who was not at work. I told him he was not in and he hung up while I was still speaking.  I called back and asked for a supervisor and was connected to the man who hung up on me.  He said "You are not the person I was asking for, this is none of your business!"  So, now I am trying to track them down and make a formal complaint to the state.

I can't believe this.  I think I know what it is they want from me. I was paying a credit card I went to court to pay through a law firm, out of Chicago, recently, they sent me a letter saying I ddn't have to pay them anymore.  No I get phone calls from this ERS place.  I was paying the other place $25 month, according to an agreement we had.  I guess they didn't like it. They can't garnish my wages, I don't make enough. So now they try this tactic. Guess what I still enough.
This is more stress than I can handle.

thanks for listening

ers has recently contacted me about a credit card that debt that i have and am only 4 months behind. the person who originally called me transferded me to his superviser who started to ask me personal questioned about my family and who lives with me and so on. i told him that it was none of his buisness aboaut my personal life. and then he siad that my kids were going up with a loser of a father. i hung up after a few choice words and then called back to complain and was put right back on with the same guy. this company deserves to go down im not going to pay a penny. im going to my attorny and have him deal with it. i would suggest if you have the same problems and can afford it you do the same. i have also found out that these poeple even when you do pay them often take your money plus what ever else they want in your account. DONT GIVE THEM ANYTHING CONTACT YOUR PREVIOUS CREDITOR. thats it... well and visit budhubbs.com for more info on this and other junk debt collectors                                                                                                                be safe and be sure

One you Must understand that if your on a do not call registry it doesnt mean a collection company cant call it means solicators cant call.. As they are trying to locate people that once knew that number or had that number and placed it on an application for credit.

Secondly If you are having such harrassing calls changed the number

Three verbal request to stop the calls arent takeable as per the fdcpa you need a ceast and decease letter.

Fourth if they are calling your place of work advised them of that if it continues request to speak to a floor manager as supervisor are just as rude as collectors..

Do NOT pay these bottom feeders a DIME, until you have received proof from them that you LEGITIMATELY owe this debt!

Here's what you do:

First, send them this letter VIA certified mail, demanding validation of the debt they are calling about and request a return receipt. This is your legal right under the FDCPA (Fair Debt Collection Practice Act). Do it NOW, and keep copies of everything you send:

Today's Date

Your Name
Your Address

Collector's Name
Collector's Address

VIA CERTIFIED MAIL

Dear {insert name of collector or company},

I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.

This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:

(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

I respectfully request that you provide me with the following information:

(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) Provide a verification or copy of any judgment (if applicable);
(4) Proof that you are licensed to collect debts in (insert name of your state)

Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
you cannot add interest or fees except those allowed by the original contract or state law.

you do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA;
Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.

I have disputed this debt; therefore, until validated you know your information concerning this debt is inaccurate. Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.

Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware of my dispute with this debt.

Second, pull your credit reports from all three bureaus (Transamerica, Experian and Equifax). If they have placed any derogoratory remarks on them without furnishing proof that you legally owe this alledged debt, it's a slam dunk. You can take them to court and sue the @$%&! out of them:

Who         Why            Precedent/Law                  Fine

Creditors if they report your credit history inaccurately.
Defamation, financial injury (US Court of Appeals, Ninth Circuit, No. 00-15946, Nelson vs. Chase Manhattan). Extent of damages incurred by the wronged party as deemed by the courts.

Creditors, if you dispute a debt, and they fail to report it as disputed to the credit bureaus Protection under the FCRA (FCRA Section 623). $1,000.

Creditors if they pull your credit file without permissible purpose  Injury to your credit report and credit score  (FCRA Section 604 (A)(3)). $1,000.

If you dispute a debt, the collection agency fails to report it disputed to the credit bureaus Protection under the FDCPA (FDCPA Section 807(8)). $1,000.

Collection agencies if they do not validate your debt yet continue to pursue collection activity (file for judgments, call or write you)  Consumer protection afforded by the FDCPA (FDCPA Section 809 (b), FTC opinion letter Cass from LeFevre). $1,000.

Collection agencies if they have not validated your debt and they still continue to report to the credit bureaus  Consumer protection afforded by the FDCPA (FDCPA Section 809 (b),FTC opinion letter Cass from LeFevre).
$1,000.

To Everyone,
Don't forget to tell them they are in violation of the Fair Credit Act.  They cannot legally continue to call parties that are not the debtor under the law.  If you write the AGO make sure to include this in your response and copy in the Elite Recovery Services.  Also don't be surprised if another agency takes over where they left off.  This is the third one for me.

I have continued to get calls on a fradulent debt from not only this collector but others.  I have repeatedly informed them this person does not live here and never has but they continue to call.  I sent a letter to not only the AGO but to them as well showing I had copied in the AGO and indicated that each and every call would be reported from here forward.  Thank you for the information.  I pay my debts and do not appreciated harassing calls for someone elses.

I have been receiving voice mails on my home phone from Elite Recovery over the past week. Their message asks for, get this, my ex husband's third wife.  I was his first wife and we divorced 16 years ago.  We live in different states, have different last names and he and I never shared this phone number.  So, today I decided to search for information and I'm so glad I found this site!  Thank you!  I decided to call them back even though some messages here didn't make me too hopeful that I could have a decent conversation.  So I called and asked for the extension that was given on the voice mails.  The person asked if I had a case #, which I did and gave it to her.  She then started calling me by the name they called for and I just said that was why I called, no one by that name lives here.  She asked if I knew how they could reach her.  I said that I don't know anything about her (which is the truth).  She said this person used my number as the emergency contact (that would never happen) but then she apologized for the mistake if I don't know her and said that I wouldn't receive any more phone calls.  That was a surprise, but we'll just have to see if it will be true.

Paul Niedzelowski and Doug Mackinnon (GioveLaw) used to paint houses together in the Buffalo, NY area, years ago and Doug once used Niedzelowski as a front for collecting on his bogus debt portfolios.

One sleazy law firm who is handling their dirty work is Hosto & Buchan out of Little Rock, Arkansas with a reputation for not being the brightest lawyers in the courthouse and fails to show for a LOT of suits they file.

It does not take brain surgery to defeat these brain-dead debt collectors and their so called attorneys; you are already smarter than them for finding this site. The have what is known in this industry as a ?deficiency? which is an inability or failure to be able to LEGALLY validate the trash they are collecting on.

A check of records shows that Elite Recovery Services has not complied with state licensing and bonding requirements as required by law. That is no surprise because any operation associated with the MacKinnon?s appear to take the attitude that the law governing debt collections don?t apply to them.

Contact me for assistance. There is a way to deal with these bottom-feeders and make them go away.

There is nothing to be gained in giving Elite Recovery Services your money, you may not even legally owe on debts they are collecting.

This is rediculous!  I have received about 11 phones calls from these rude poeple and they refused to give you any details.  I asked for more details and the continued to harrass me saying that if I didn't pay up, they would see me in court.  What kind of collection agency becomes threatning???  They too hung up on me when I asked to be taken off the list.

Someone kept calling for me by my maiden name.  I have been married for 4 years.  Weird.  I printed out my credit report and there is nothing on there for them.  They sounded polite in their voicemail, but by reading everyone elses experiences I think I will not be giving them the satisfaction of a return phone call.

This is a collections agency, Elite Recovery Services, address:
255 Great Arrow Ave., Second Floor, Suite 15, Buffalo, NY 14207
(866) 780-6165.
If you are getting harassing phone calls from them, and they are obviously a mistake, ie asking for the wrong person and when you tell them correctly that person doesn't live there, and they get nasty and continue to call you, PLEASE write a complaint to the NY Attny Generals office, address:
107 Delaware Ave, 4th Floor, Buffalo, NY  14202
They WANT to know.  This company has done a ton of illegal stuff (threatening you, harassing you, yelling at you, etc) and they need to be investigated for it, so, do your part to help stop some of these super agressive collections companies from making peoples lives a living hell, especially those who don't deserve to be harassed in anyway by them!  Detail the time, person if you have a name, they tend NOT to use names, date and anything else you can get and send it off to the NY AG.  Trust me, they do NOT want the AG investigating them at all!!
