Yup. Andrew Foreman called my mom's ex husband who is "Paul" above. They hadn't been married since Jan 2001!!! I have no idea where this guy came from or what he wants, but I called him back and told him I can't talk until after 5pm. He has called 12 times since leaving a message saying I need to "clear up a matter."

Andrew Forman from "P&B Capital" called my wife and then me, claiming to represent someone regarding a second mortage foreclosed about a year ago.  He was rude to my wife and called her a liar.  When I called him, and asked for documentation or proof of who he is, he threatened me with litigation, and hung up.  I called him back 5 times to harass him.

I just received a called from this rude man claiming I owe on a bill that I've been paying on.  He told me I was irresponsible and that they were going to settle it in court.  I told him I needed to speak with his manager because he was absolutely rude and he said no and hung up in my face.  But he did answer the phone when I called him back and told me he had nothing to say and hung up again.  But wouldn't give me a name.  Who ever this gentleman is needs to be shut down and sued.

I have been getting calls from this number for about a year from both male and female callers, and my whole household is tired of dealing with them.  There is no company name on the caller ID, it just says Buffalo, NY.  They are always asking for someone with my last name, but it's always someone I don't know. They won't identify who they are, only to say they need to discuss a business matter.  I did credit and collections many years ago, and I can smell a bill collector a mile away.  I'm pretty sure this company bought up some old bad debt and anything they can get collected will be almost all profit, so they have nothing to lose by being rude.

Got a call from a very unprofessional person who would not give his name.  He was looking for my girlfriends son who has not lived with her for years.  He called on her cell phone and when she stated that he no longer lived at home and was responsible for his own debts, said that she was lying.  I have been living with her for 5 years and I saw him once in the last two years.  He lives out of state and is on his own.

This "Andrew Forman" should not be allowed to threaten third party people by being rude and insulting.  Anyone using his services for collection should be held responsible for his actions and the Attorney General, BBB and whatever other federal agencies that protect consumers should be put on notice as to collection tactics.

my parents are being harrassed by some companies for credit card debt that is not theirs.  the callers...marlon, compu credit, credit check, and blocked calls...are harrassing them with threats of lawsuits if they don't respond to the calls by a certain time.  they call repeatedly.  they call and the ansering machine gets it and the callers play with chains or something to make noise.  they call and hang up, call right back and do it over and over.  they call all hours.  my parents called the federal trade commission and were told that there was nothing they could do about even if the debt wasn't theirs.  that my parents would just have to live with the harrassment.  the numbers that are calling are 678-258-5058, 678-258-5000, marlon is at 866-274-4794 ext. 4127.  these are credit companies that went bankrupt and were bought out by other companies.

I received a call on July 20, 2009 at 20:50 FROM (716-270-5517).  He asked for Thomas and I explained that there were no Thomas in the home.  The man proceeded to ask for a number which I do not have and said he would call tomorrow when I got the number.  I asked him not to call back and hung up.  At 20:51 the same man called from (718-558-5854) and told me I was rude and I should expect more calls tonight.  Once again I informed him to stop calling me that he was waking the children and stop threatening me.  He became angry and stated when did I threaten you which was explained when he threatened to make more calls tonight. When I spoke to my mother she had also received a calls however did not document the information.  What more can I do to stop these calls?

Someone from this office called my 85 year old Mother yesterday and told them they needed to get in touch with me in order to avoid a lawsuit.  She was very upset and confused about what they were telling her.  Now, that is the ultimate.  It is time for a complaint to the FTC.  I don't have a problem with filing a complaint. I also think they have been calling other family members.  I have already written them telling them not to contact me at my place of employment and called them, left a message telling them to correspond via mail only.

Bradley W. Spoor, Tampa, FL
Ryan D. Kazmark, Amherst, NY
Sean J. Welch, Cheektowaga, NY

Another ?Buffalo Style? debt collector with all the common lies, threats and extortion you expect from the Debt Collection Capital of the World.

Owners, Spoor, Kazmark and Welch are out buying up old, mostly worthless debts, then calling consumers with threats of immediate lawsuit, garnishment and seizure in their illegal attempts to collect at highly inflated numbers. We were NOT surprised when a search of state records showed NO licensing or bonding as required by law. The name they use is typical of how many debt collectors want you to think they are a law office, when they are not. Expect their collectors to lie and state they are attorneys, which is a felony in most states. These are the lowest of the low-lives, the losers who can?t find work anywhere else. Their job is to lie, cheat and extort your money under the guise of fear.

The enclosed email describes their collection tactics:

?They first called our parents and threatened to serve court papers to put a lien on our house in 20 minutes unless we called them. Our parents are old and do not need to be harassed.

They also called our daughter-in-law and threatened to send someone to kick the door in at her house.

But worst of all, when our daughter called the 800 number and asked what they needed, the person there (apparently Glenn) started shouting obscenities and used the "F" word. Our daughter was so upset she was unable to determine which creditor, if any, this company represents.

We can find no record of any mail correspondence from this company.?

Bradley W. Spoor, Ryan D. Kazmark and Sean J. Welch Can be held accountable for their actions in a courtroom, we can assist you to that end.

Dear {insert name of collector or company},

I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.

This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:

(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

I respectfully request that you provide me with the following information:

(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) Provide a verification or copy of any judgment (if applicable);
(4) Proof that you are licensed to collect debts in (insert name of your state).

Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

Because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
you cannot add interest or fees except those allowed by the original contract or state law.

You do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA.

Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.

I have disputed this debt; therefore, until validated you know your information concerning this debt is inaccurate. Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.

Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware of my dispute with this debt.

*For those of you who are being harassed by this and debt collectors and you are NOT the debtor, read this article written by a consumer attorney:

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

I totally agree with you.  If it is a ligitimate debt, you don't need more frustration and harassment when you have already been through hardships one after another and are already struggling.  I have had several debt collectors call me at work and discuss my situation with co-workers.  I have reported them to the Federal Trade Commission.  The debt collection agency just responds with more lies.  Talk about frustrated!!!!!!!  I am working out my financial problems one at a time and can't do more than I am doing at this time.
