The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

They keep calling and harassing regarding a debt collections and they are calling all the other individuals that are not related to me. Jim Scott, Zimmerman Young and Assoc. is very unprofessional. I called then today and spoke with Ms. Thomas and she states that she is mailing me an affidavit! I told her this is a scam and reported them to the Attorney General?s Office and BBB? They also stated a courier came by on March 24th, April 10th & 18th to deliver documents but nothing has surface. They are just a low life and trying to scam people!!!!!

Does it make you feel better to make a jab at person who might owe a payday loan?  I thought if was about phone scammers, these people take it a bit far.  Anyone that has taken a loan knows they owe it.  Calling and harassing doesn't make a person have the money to pay it back.

it's also immoral to rack up $1000 in charges over a measly $300 loan...I am just saying! They should know! If you are going to get a payday loan basically you are flat broke and no friend can loan you money because you probably have not paid back the previous loan...your credit is probably so bad the bank does not even want to look at you....so how and why would you pay them back.How do I know? I couldn't even understand the name that was left with the message.  The recording was extremely static-y and I never did get the reference #.  My bank account is fine, I rarely if ever write checks, and have had NONE of them returned.  If it was meant for me, which I highly doubt, my bank would have contacted me a long time ago first.

If you google information about internet payday loans they are unlicensed...and they do not have the legal ability to take civil action against you.  A Jim Scott called me from Zimmerman Young and Assoc.  They use robo calling and several different #'s...one is 1-716-335-9051 another 888-995-0693--They even had a man pretend to be calling me from my local Court...but he said if I called Zimmerman and Assoc that they told the court that they would be willing to mediate with me so that I do not have court costs and lawyers fees....Then I googled these phone numbers and lo and behold they are famous for illegal tactics.....

The problem is that these companies rape you with additional charges. I have paid back all loans and then some with outrageous fees and interest.They are not even legal in my state and these colletions companies can not take you to court if they are not licensed in your state!

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. Called me on Friday with a message saying that I was being investigated for check fraud and that if I didn't call them back immediately they had a federal warrant out for my arrest.  I received another call the next day and the message said the same thing.  Thankfully I googled their name before then and found this thread so I knew that this was a SCAM and didn't fall for what they were going for.  I thought that if I didn't call them back they would leave me alone.   NO they called my work and told them I was being investigated for check fraud and that they were going to come to my work and have me ARRESTED! My boss actually came down and told me this. When I called them back immediately after that they tried telling me my name was tied to someone else's.  A Maria Lopez, a name I have never heard before in my life.  When I told them that they told me it was fine and that they would take my name off the call list.  I asked the lady her name which she refused to give me.  I then asked her how she got my work phone number and contact information and she refused to answer, then hung up on me.  I have never taken out a payday loan in my life and I have nothing in collections.  Needless to say if they ever call me again they are getting a very very large piece of my mind.

They cannot file criminal charges on you for a Payday loan if that is what they are threatening/implying.
It depends on what state you took the loan out in. This company may not be licensed to collect in your state. If your loan is past the statute of limitations for debt in your state, making any payment will re-open and start the "aging" process again.  Do a lot of online research-there are tons of sites out there that will hel you.
8/27/13-Our company has gotten several calls and each time we pick up, it's a recorded message mid-way through about debt. I decided to call back today and see who (if the would tell me) they are trying to reach. The recorded message was a little hard to understand, so I pressed "0" as directed. Turns out it was a former  employee. I explained that we had a high turnover, and I did not recall the name. Just be aware that they have a "trap" on their phones that will show the number you are calling from, (and I'm inclined to think that applies to unlisted/private numbers as well) so if you don't want them to know your number-DO NOT CALL! The guy I spoke with was nice (I wasn't the debtor, of course-thank goodness!) and said he would remove the phone number from their records. We will see if that is the case.
