Just missed yet another call from this company with a Houston # 832-460-4136; I ignored the call; called them back, they finally answered and I asked what company I was speaking with and the girl answered Evans Law Associates. I said "Thank You" and disconnected the call.

Interesting. I got a call from this group out of Charlotte, NC. They call themselves a law firm and left a message stating they need to "verify an address for a required notice" and to call them TODAY. Well, I have never heard of a legitimate law firm needing to "verify an address." If it is the real thing they will find you. I have no idea what this is about. I am current on anything I owe. I am not going to call them back as it seems disreputable from the information posted here.

You might want to read Alfalfa's post on page one, then file reports accordingly. The burden of proof is on them, and by law they have to send you debt validation within 5 day's of the phone calls..

*******************************
Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

Just got a call from these clowns yesterday.  They had all of my personal information - even my SSN.  They were inquiring about a debt from 5 years ago.  I just got my credit report today and there is no mention of that account anywhere.  They got my bank card number and said they were going to bill it.  Card is now cancelled with no attempted transactions.  Origination number was 512-351-7130.

These individuals have been calling all of my family members for an old account which the statue of limitations have expired. I mean come on, I don't live in one of the cities, nor will they send any documentation to me about the supposed 'debt" that I owe. I will be following up with the FTC and complaining through the BBB because this is unacceptable.

No one should ever give out their personal information to these scam artists.
Do not listen to a word they say, they will tell you anything to get into your bank account. They tried to get $5k from me, and that was on the first call, and without providing me any proof of a debt.
I owe no debt like the one they described. They told me that it was a brand new IRS debt that only they knew about.
I don't know who they thought they were talking to, but, I'm not ninety years old. I'm not even fifty yet, and even if I were, no fool is going to squeeze my personal information out of me, and certainly not over the phone.
Heed this warning!

My husband has been dealing with these people (Evans Law) for several months.  Each month they
would call and my husband would allow them to withdraw $100.  However they just went in to our account and withdrew over $1,000.  This money was our daughter's Communion gifts.  We are disputing this through the bank, however not sure if we will get our money back!!!  We are also now at a -$600 in our account.  This is all the money we have!!!

I have not had anyone come up to the door with papers, but if they have to file suit in your county to serve you papers.  Call  your county court and ask, they will tell you.  Also if the debt is over 10 yrs (colorado) 7 yrs (federal) they can ask to collect but you dont have to pay (Statue of limination).  I was involved with Evans Law, told them to shove it, and filed a greivence with NY Attorney General, and was not bothered again.  Now the sold it to some one else, Vargo & Janson, did the same thing.  I also sent them a letter to not contact me with this as per Fair Debt Collection Act.  Thsi is a copy of the letter I sent,

To Whom It May Concern:
Lets start of with the obvious. It is true, the owner of the account has the right to try and collect the debt.  The problem is the statute of limitations has expired and I am not legally liable for the debt.  I am sending you this letter telling you not to contact me, regarding this debt and under the Fair Debt Collections Practices Act you must comply.
Under the Fair Debt Collections Practices Act, you have 30 days to produce a debt validation notice, after by requested.  Your firm shows date of service as Febuary 27, 2009, which I believe was Febuary 27, 2010.  I did not receive the photocopy of the Wamu (Providian) statement until June 18, 2010.  This is 108 days.  This is unacceptable.  I am not an attorney, but I don?t believe a old statement from a defunct company consitutes a debt validation notice, as it could have been dug out of the trash at some point, with no assignments attached.  I would considered that you failed on that item.
Next is the false statement made in your itemization that your client ?Marshall Recovery LLC for Chase-Wamu?.  Chase has not owned this loan since early 2000.  I had settled with them on several other loans, and they chose not to collect this one.  It was sold to ?junk collectors? for pennies on the dollar.  You are about the second or third attorney ? collection agency to contact me, and about the fifth or sixth time it been sold that I know of.
Now, if I can find this many faults, and not being an attorney, I feel that something is wrong.  I am providing a copy of this letter, along with all paperwork funish by this law firm to the Attorney General for review.

Hope this has help you

I was wondering if anyone out there who has had trouble with this so called Law Firm Can tell me if these people can actually serve you with papers and have you sign for them? They called and then someone keeps coming to the house that we don't know and has papers. Is this another one of their ploys? or is this a separate issue? Has anyone ever experienced them coming to the door? This is in Colorado now. Thanks to whomever can answer me.

Got a call this evening from someone saying he was from the Evans Law Firm.  Phone number was 716-685-8470, which is based in Buffalo.  The guy was very vague saying that he was calling on behalf of HSBC Bank for Discover Card, due to collections.  He then asked if my last four digits of my SS # were ___, and I said no, and then he launched into, "I don't understand" rather rudely.  Where do these people come from???

Bud Says:

The debt collection scams, cons and fraud out of Buffalo, NY never stop. Here is the latest entry into the world of the sleazy debt collectors, using the name Evans Law Offices. The problem is that New York State records do not show this organization and information we received purports to show that Attorney Jason J. Evans may be committing perjury and other illegal acts in his debt collection venture.

I am in receipt of a document titled: SWORN AFFIDAVIT OF DEBT printed on Evans Law Offices stationary and containing a signature of Jason J. Evans, Esq. which (based on the attorney expert I showed it to) appears to violate federal debt collection laws. These are claims for old Discover accounts and attorney Evans makes statements that are false and misleading in his sworn affidavit. (perjury?)

My advice to anyone receiving these bogus notices is to send (attorney?) Evans a debt validation notice, demanding all documentation that validates the alleged claim. Do not be impressed by his bogus affidavits of debt, they are worthless. Make him prove everything. Expect  his hyped-up debt collectors will threaten everything under the sun, as most desperate debt collectors from Buffalo do. The good news is you can locate a NACA attorney from www.naca.net who are REAL experts on debt collection laws.

Problems with Buffalo attorneys should be directed to:

This is a "pending disaster" collection agency although they represent themselves as "Evans Law Office" or "Evans Law Associates" wanting to "assist you" in a "pending legal action" - make no mistake. This is a commission based collection agency with a very good phone script. One of their agents left a message that they were about to submit my "documents to the IRS" and I needed to "call them back today." As a rule, attorneys' won't call you regarding debt collection... unless it's your lawyer and you're getting billed for the call.

Evans Law Firm(?)called several times and threatened judgement.

I was home the 4th time the called. They always mummbled when I asked for provable facts. They refused to mail me any sort of documentation. They insisted that they were only a law firm. They would not verify whether they had bought the debt of were representing the debtor.
