This guy is obviously a law breaking debt collector.
Send somebody to somebody's house?  That's funny.
25% interest on a debt that has been charged off?  Very funny.
There are too many variables.  Fact is, if it's not the actual credit grantor, they know nothing about the debt except the boss told them to collect.
Happy holidays everybody!

Just a heads up to anyone who is contacted by these con's. Sed is the dumb one behind this outfit,employing and allowing the king of fraud Erik woldarski to scam hundreds of thousand of dollars from people who have no idea what's going on. First off word is Sed spends all his money trying to look the part of a big shot ceo,did I hear a sniffing? Big shot huh? Sniff another one. So Sed pays all of his crooks 25% over the actual balance of what they collect...ie- you owe 500$ ,fat boy calls you and scares you into thinking you owe 5000$? Still with me? Fat boy gets 25% of 4500$ and Sed gets a big bag. Oh ya and unknowingly there unsuspected partners the kelbacki construction company is getting there checks,but I bet they don't know that there in receipt of fraudulently recovered funds....and guys were not talking a few Hundo,were talking now...hundreds of thousand every year. Major fraud going on here. We hear the other guy is a scapegoat also,just taking orders from a guy who we hear can't even make it into the office,cuz you know....partying all nite. Fed's are now reportedly on the trail of Erik the fraud,after collecting a 10 thousand dollar acount from a old woman who only owed 457$!!!! Bye bye big shot's

From Federal Trade Commission Website ? FAIR DEBT COLLECTION PRACTICES ACT
Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
   use threats of violence or harm;
   publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
   use obscene or profane language; or
   repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
   falsely claim that they are attorneys or government representatives;
   falsely claim that you have committed a crime;
   falsely represent that they operate or work for a credit reporting company;
   misrepresent the amount you owe;
   indicate that papers they send you are legal forms if they aren?t; or
   indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
   you will be arrested if you don?t pay your debt;
   they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
   legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
   give false credit information about you to anyone, including a credit reporting company;
   send you anything that looks like an official document from a court or government agency if it isn?t; or
   use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
   try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
   deposit a post-dated check early;
   take or threaten to take your property unless it can be done legally; or
   contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
   Social Security Benefits
   Supplemental Security Income (SSI) Benefits
   Veterans? Benefits
   Civil Service and Federal Retirement and Disability Benefits
   Service Members? Pay
   Military Annuities and Survivors? Benefits
   Student Assistance
   Railroad Retirement Benefits
   Merchant Seamen Wages
   Longshoremen?s and Harbor Workers? Death and Disability Benefits
   Foreign Service Retirement and Disability Benefits
   Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
   Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

I just wanted to say this. I got a call from this company, and it wasn't even for me, it was for my boss at work. REGUARDLESS of if someone is owed or not there are LAWS about what can and cannot be said during a conversation. THREATING someone and telling them they need to get a lawyer is against whatever debt collection laws there are out there. I have sued a company and WON. If ANY debt collector harrasses you AFTER you request them to stop calling your number, put it in writing and send them a cease and disist letter requesting them to stop contacting you ON ALL CASES. IF after that they contact you ONE more time you can sue them. Plain and simple. NO contact means just that NO contact.

I received a call from Ruben and Yates stating that I had 48hrs. to contact them or I would have an injunction filed in my county.  I did check on "The Firm" and thought I'd call to see wtf was going on.  When the recieptionist took the call I asked three times if this is a law firm.  To which he replied yes we are the lawfirm of r & y.  They are NOT and that violates the fdpca.  When I spoke with one of the reps he claimed I had a verizon acct. from 2001 - 2003 that was pending legal action.  I have never ever had any acct. w/verizon.  also whomever the acct. does belong to (if it's even valid)  would be past the sol.  The rep became beligerent and stated it was fraud on my part to run up an acct. and not pay.  I reminded him that I have never had any business with verizon.  He became even more aggresive and said he was going to go ahead and file the lawsuit and hung up.  I called back and spoke with a supervisor Jason to see exactly what info they have to make sure this wasn't identity theft.  He wasn't quite as big a douche as the first rep , but was still a douche none the less. While speaking he adv he had my credit report and vzion was listed on there. He advised I contact verizon and gave me an acct.# to verify.  Well after contacting verizon and no one is able to locate ANY info with the act.# or my personal info I was transfered to the account verification/fraud department where they pulled my credit report to see if it was on there .  Wouldn't you know after 2hours on the phone with verizon there is ABSOLUTELY NOTHING on their records or my credit report.  What this scumbag company is doing is illegal ,if they proceed to harass me they will be hearing from my attourney!!!!

I am sorry to hear that you paid them, but these calls are fraud in them selves, I too received a call but was fortunate enough to realize what was going on. The guy probably said something like, The company (in my case B of A) has filed suite in San Diego with fraudulent charges against you for a unpaid debt. The case is currently in pre lit. and there is nothing you can do, you will have to appear and yes I was told the same exact amount 6000.00 will be what I awe after court costs and everything else, plus fraud charges? These guys are absolute crooks if this company really does exist which I doubt, they need to be taken down I opt for a class action! :) the thing which gave the scam away for me is I knew for a fact that I didn't owe B of A any longer and called them to verify, I then called these guys back and asked for a official doc. from B of A stating I owe this debt, wouldn't you know I never received a thing and haven't heard from them in 5 days. Sure gave me a scar though.

The more we blog about this, the more attention these A***OLES get, and the more scare tactics they will use. The answer is simple. It may cost a few bucks but just change your number or add call screening to your phone for a while. Once they realize they can't call you they will take no further action. Remember it costs money to try to actually collect a debt, good or bad, and they won't spend a dime. These are ONLY scare tacticts.They have no power.

Send them this "drop dead" letter VIA certified mail and request a return receipt:

Today's Date

Your Name

Collector's Address

VIA CERTIFIED MAIL

Dear {insert name of collector or company},

I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.

This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:

(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

I respectfully request that you provide me with the following information:

(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) Provide a verification or copy of any judgment (if applicable);
(4) Proof that you are licensed to collect debts in (insert name of your state)
Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
you cannot add interest or fees except those allowed by the original contract or state law.
you do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA;
Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.

I have disputed this debt; therefore, until validated you know your information concerning this debt is inaccurate. Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.

Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware of my dispute with this debt.

I recieved a very threatening call today( in which I saved)and my finace' was on 3-way heard this conversation. The women involved claimed to be from Rueben and Yates; "Ms. Davis" stated that a judgement was being issued under my name for a credit card account. I asked about the account because I once tried to dispute it because I was a victim of identity theft; however the account was closed. When I asked for a copy of the original agreement she said that I did not have to be given this info. When I asked the name on the account it was my middle name and a former room mates last name. I could not be given any information. This woman was extremely rude and insisted on a credit card number or check by mail. I spoke with her three times tonight with no resolve and checked all 3 credit reports and nothing is there stating what she has told me.

holy Crap! I'm not an English major, but at least I have my spell checker on.  I get the point, these people are idiots.  However, they must be dealt with legally, and professionally. If any of us end up in court, you must appear credible.  I am presently involved in a lawsuit, and instead of crumbling, I hired a great lawyer, and counter sued the schmuck for five times what he tried to get me for!.  When you deal with these people, keep a log complete with phone recordings, day date, time, names...everything.  Tell them what you have on them including all of these blogs. This is only one out of five blogs going on about this company. You MUST be able to prove what is happening.  It worked for me, and now that they have called me, I will be applying the same technique.  Don't even bother with the Better Business Bureau.  Go straight to the Attorney General!.  And as long as you have the proof, there are attorneys out there that will go to bat for you on a contingency basis. These people are poodles.  BE THE PIT BULL!!

If you work for these people then you should know you are breaking several federal laws by threatning and mis-representing yourself as lawyers and regardless if these people owe the debt or not you are not allowed by law to do this. I would be careful of incremenating myself. If anyone should be ashamed it should be an individual who would make a living by doing such.
